The Mayor being absent from the City, the Clerk announced such absence and -called for nom- inations for President pros tempore. AlderWa Harding named Alderman Phillips for the posi tion and the clerk called the roll with the following rrasult;-.For Alderman Phillips as President pro tempore, Aldermen Drake, Harding, Ehntun, YOMM, Qv,tce and Wages ; against, none, and the Clerk announced Alderman Phillips duly elected to be President pro tempore. PRESENT: Aldermen Drake, Harding, Mintun, Phillips, Price, Wages and the Clerk. MINUTES of the previous meeting were read�A an it being ascertained that opf/ at the meeting of November 2nd, 1925 the Clerk hadexpressed the intention of the Council to defer the hearing in the matter of Water Improvement District Number O�woto the meeting of the Council on the 9th of November, 1925 as having been done by motion duly passed, when in fact the matter had been overlooked to the extent that no such motion was really made, it was therefore ordered by the Council that said statement be stricken from the record. Also, it was ordered by the Council that the Resolution setting forth the finding of the Council showing a majority in value of the p�FJ#Xy/owners of real property within said District to have signed the Second Petition therefor, as the same is set out on page 1096 of this record, be stricken from the record. This action was had by motion mdde by Alderman Drake, seconded by Alderman Wages, and passed by the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; nays none, absent and not voting none and so de- clared by the President pro tempore.( Said parts of the record are accordingly marked, it in green ink with the words Stricken from the record by order of the Council, November 16th, 1925, J.C.Massie, Clerk." at pages 1095, 1096 and 1097 of this record. The President pro tempore then announced that the minutes as ammended were approved. BILLS: The followinfjbills agagnst the City were presented, and having been approved by the auditing Committee, Aderman Harding moved that they be allowed and the Clerk directed to issue warrants for the same. This motion was seconded by Alderman Wages and received the following vote; ayes Ald rmen Drake, Harding, Mintun, P illips Price Wages.; nays none and was declared passed by th President pro tempore. BILLS Jim Mitchell, 7 days work $21.00, Andrew Munds, days work $y28.00; John Zillah, Y$113.75; Ozark Filling Station $17.00;,Democrat Publishing Co..$111.68; Phoenix Construction Co. $103.38; and $150.00; James Dinwiddie $34,00. WATER COMMISSIONERS of Water Improvement District No. Two filed their Oath of office with the City Clerk. Also their First Report was so filed. Alderman Harding moved that F.F.Stice be appointed to be a member of the Board of Im- provement of Douglas Street Improvement District Number One of the City of Fayetteville, Arkansas. This motion was seconded by Alderman Wages and received the following vote; ayes Ald rmen Drake, Harding, Mintun, Phillips, Price, Wages; nays none and was declared passed by the President pro tempore. , •a HILL AVENUE Commissioners reported that the cracks in the pavement on Hill Avenue had been repaired to their satisfaction. DEBT ORDINANCE, Alderman Drake introduced an Ordinance, declaring the indebtedness of the C City of Fayetteville, Arl-ansas, which was read the fir st time. Alderman Price moved that t the Rules be suspended and the Ordinance placed on its second reading. This motion was seconded by Al rman Mintun and received the following vote; ayes Aldermen Drake, Harding, Mintun, Pric,Wag s; nays none; absent and not vo�2tg, none and was declared passed by 01 Prestdent pro tempore. The Ordinance was read the second time. Alderman Mintun moved that the Emergency Clause as set forth in Section Three of -the said Ordinance be adopted. This motion was seconded by Alderman Harding and received the follow - Ing vote; ayes Aldermen Drake, Harding, Mintun, Phillipe Price, Wages; nayes none; absent and not voting none, and was declared passed by'the President pro tempore. Alderman Mintun then moved that thr Rules'be further suspended and the Ordinance placed on its third reading and final passage. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE DECLARING THE TOTLL AMOUNT OF INDEBTEDNESS OF THE CITY OF FAYETTEVILLE. ARKANSAS, OUTSTANDING AT THE TIME OF THE ADOPTION OF AMENDMENT NUMBER ELEVEN TO THE CONSTITUTION OF THE STATE OF ARKANSAS." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, AR7KANSAS: SECTION ONE: It is hereby ascertained and declared, in accordance with, and as required by Section One of Act number 210 of the Acts of the General Assembly of the State of Erkansas, for the year 1925,entitled "An Act to Facilitate the Funding of the Debts of Counties, ' Cities and Incorporated Towns,"approved March 23, 1925,that the indebtedness of the City of Fayetteville, Arkansas, outstanding At the time of the adoption of Amendment Number Eleven to the Constitution of the State of Arkansas, on October 7 „ 1924, was Seventy-seven thousand Five Hundred and Thirty-four and 47/100 (t-77,534.47) Dollars, all of which indebtedness is still outstanding. SECTION TWO: This Ordinance shall be published immediately after its passage and approval, for one insertion , in the"Fayetteville Democrat ", a newspaper published in the City of Fayetteville, Arkansas. SECTION THREE: It is hereby ascertained and declared that,by reason of the heavy indebtedness hanging over the City of Fayetteville,.Arkansas,it is unable to procure or maintain proper facilities for safe guarding against fire,proper police protection, or proper public health measures, and that, therefore,an emergency id decalred to exist, and it is necessary for the preservation of the public peace, health and safety,that this Ordinance should go into effect immediately, and, therefore, the same shall take effect and be in force from and after its passage, approval and publication. Alderman Drake moved that an advertisement be inserted in some financial Journal calling for bids for the Funding Bonds of the City of Fayetteville, Arkansas, the Council to reserve the right to reject any and all bids. This motion was seconded by Alderman Harding an� received the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; j nays none, 4bsent and not voting none, and was declared passed by the President pro tempore. The Finance Committee was directed to publish such advertisement, by 4ts Chairman,Alder. man Drake, over his signature as such Chairman. 1102 .� APPEALS: The time having arrived for the•hearing of the appeals -in Mont Nord Improvement District, from the re -assessment thereof, the appeals of W.S.Campbell and of Mrs. Jas, J. Vaulx abd Julia Vaulx were read to the Council; whereupon the C ouncil proceeded to the investigation of said assessments and having fully .investigated the same, Alderman Mintun moved that it is the opinion of the Council, and their finding that the said assessments ` are not unreasonable nor unjust, and that therefore the appeals for a reduction of the same be denied, and that the seeessments shall sXX)4 stand as the same are now of record , on the assessment roll of said District. Alderman Price seconded the motion which received the following vote; ayes A1dFrmen Harding, Mintun, Phillips, Price, Wages; nays none; Alderman Drake was excused from voting, on -account of.the.fact that.he is one of the Commissioners of the said District. The President pro tempore declared the motion passed. EXEENSE ACCOUNT. City Attorney Geo, A. Hurst presented an account of his expenses to Little Rock(to investigate the matter of the issuance of funding bonds) to the amount of $34.44, Alderman Harding moved that the account be allowed and the Clerk directed to issue a warran for the same. This motion was seconded by Ald rman Mintun and received the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips,.Price, Wages, and was declared passed by t_h the President pro tempore. GRADE FOR WALK; The request for athe establishment of a grade for �sidewalk, made by H.L.Jett was allowed and the City Engineer was directed to furnish same. Alderman Price intr&duced an Ordinance Contracjing with the Phoenix Construction Co. which was read the first time. Alderman Mintun moved that the Rules be suspended and the Ordinance paleed on its second reading. This motion was seconded by Alderman Drake and re- ceived the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; nays none, absent and not voting none and was declared passed by the President pro tempore. ' The Ordinance was read the second time. Alderman Harding then moved that the Rules be furthe suspended and the Ordinance Placed on its third reading and final passage. Thos motion was seconded by A lderman Drake and received the following vote, ayes Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; nays none, absent and not voting none and was declared pass ed by the President pro tempore. The ordinance was read the third time. An Ordinance to ve entitled " An Ordinance contracting with Phoenix.Const- uction Company, to Repair and Make Improvements on Certain Streets Within the City of Eay- ^/etteville, Arkansas, and to Furnish the Necessary Material, Work and Labor for the game, and ' to Provide for the Payment oa Said Material, Work and Labor." ke it Ordained by the City Council of the City of Fayetteville, Arkansas: CSection One That repairs and Improvements be made upon the following named streets )in the City of Fayetteville, Arkansas, at the places herein named, to -wit: �+ Wall Street and Government Avenue; ' Wall Street and Hill Avenue; (gyp, Wall Street and Duncan Avenue. Section Two: That said improvement shall consist of paving of the intersection of sa said s*reets and the construction of necessary culverts and drains to take care of the drain ape which must pass under the paving from the paved streets from the adjacent territoty next to said intersection of said streets. Section Three: The City of Fayetteville, Arkansas, by the City Council of said City hereby contracts with Phoenix Construction Company for the said Phoenix Construction Company to do and perform the work nd labor, and_furnish..the.-necessary material for the re- pair and construction.as herein set -forth on.said.s.treets,._and..at said intersections of streets as herein mentioned, said improvements..to.be according to the plans and specifications on file in the office of the City Enginedr of the City of Fayetteville Arkansas, The City of Fayetteville agrees to pay said Phoenix Construct ion Company for the same as follows: ' For all work, labor and material furnished, the City of Fayetteville agrees t to pay as follows: The sum of 1000.00.: For intersections, culverts and drains $3000.00 Total amount to be paid by the City in this Contract is the sum of $4,000.00, which a- mount the Council finds to be a fair and just compensation for said material furnished and work and la.bor to be performed in such improvement. ' Section Four: Upon the completion of repairs and improvements upon said streets at the places hereinbefore described by said Phoenix Construction Company and the ac- ceptance of said material used and work and labor done in said repairs and improvements by the City Council of the City of Fayetteville, Arkansas, said City of Fayetteville a- grees to pay said Phoenix Construction Company $4,000.00, to be paid out of the General Revenue Fund of said City by warrants drawn in favor of Phoenix Construction Company, o or bearer, payble in the following amounts and on the following dates, to -wit: 1st year, November 15, 1926 ...................800.00 2nd year, Notember 15,, 1927 ...................$800.00 3rd year, November 15, 1928 ...................4800.00 4th year, November 15, 1929 ...................x;800.00 5th year, November 15, 1930 ...................$800.00 If the City of Fayetteville makes default in he payment of any one of said sums when the same becomes due and payable, the City of Fayetteville agrees and stipulates with the owner of the warrant, representing the amount of the sum in which the City has defaulted in the payment of , to pay said owner of said warrent the sum of eight per cent interest per annum onr:said amount of s id warra" t from the date of such default, un til the said sum is fully paid, as an agreed and stipulated penalty and as damages for failure on its part to carry out its contract with daid Phoenix Construction Company, or the owner of said warrant. Section Five: This contract shall be binding upon the City of Fayetteville, Ark- ansas, from and after the passage, approval and publication of this ordinance, and the acceptance of the same by the said Phoenix Construction Company, in writing, filed in ": the office of the City. Clerk of the City of Fayetteville, Arkansas, and compliance with its terms by said Phoenix Construction Company on its part. Section Six: The City of Fayetteville, Arkansas, hereby pledges itself, and all of its officers, to the faithful performance -of this contract as herein set forth in this ordinance, upon the full performance of the contract herein set forth on the part of the said Phoenix Construction Company, Section Seven: This ordinance shall take effect and be in force from and after its passage, approval and publication. The second Petition for City Park Improvement District was filed with the Council whereupon Alderman Harding moved the same be received, filed and spread of record. Alder- man Mintun seconded the motion which received the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips, Price and Wages; anyes, none; absent and not voting, none;and was declared passed by the President pro tempore. A copy is as follows. -11o4 F To the.Mayor and City -Council of the City of Fayettetille, Arkansas, The Undersigned, Your Petitioners would -respectfully represent and show that a peti- tion signed by more than ter property owners in the City of °ayetteville, Arkansas, and within the territory described within said Petition, was presented to ,your Hon- orable Body on the 10th day of August, 1925, praying that your Body take all neces- sary steps and pass all necessary Ordinances, Resolutions en Orders to hay off the whole of s id City of Fayetteville, Arkansas, into, and to form, an Improvement Dis- trict for the purpose of purchasing sufficient real extate and personal property and doing all things necessary to properl construct o-erate and maintain a modren and s sanitary City Perk and Public Camp Ground, which shall be equipped with a first class modren and sanitary swimming pool or natatorium and such other buildings or modes of pleasure, entertainment and convenience as may from time to time be deeumed wise - said District to be known as City Park Improvement District Number One of the City of Fayetteville, Arkansas, the boundaries of which District shall be the corporate lim- its of the said City of Fayetteville, -Arkansas. That your Honorable Body passed an Ordinance, Numbered 565, laying off the t territory described in said Petition, and herein set forth, which Ordinance was duly passed on the 17 day of August, 1925.
