HomeMy WebLinkAbout1925-11-03 Minutes1091. REGULAR MEETING OF THE CITY COUNCIL , HELD NOVEMBER,V, 1925. PRESENT: the Mayor, Clerk; Aldermen Drakel Harding, Mintun,.P.hillips, Price, Wages. MINUTES of the two previous meetings were read and approved. REPORTS: of the Police Judge, the City Collector and the Fire Chief were presented and on motion were referred to the Auditing Committee. Also the monthly,report of the City Inspector was presented and on motion was ordered filed. The Finance Committee submitted a report.favoring the issuance of $73,000.00 bonds of the City. Alderman Harding moved that.the.report be received, filed, spread of record and approved. This motion was seconded by Alderman. Drake., and received the following vote;ayes Aldermen Drake, Harding, Mintun,.Phillips, Price, Wages; nays none, absent and not voting, none, and was declared passed by the Mayor. A copy is as follows; - To City Council, Fayetteville, Arkansas. Fayetteville, Arkamsas Nov. 2nd, 1925, Gentlemen; We, the Finance Committeewishto report and recommend for approval by the Council the following items; - 1. TM#X/ That a bond issue of $73,000.00, face value,bearing interest at the rate of 5,% per annum be created. 2.That a tax levy of not more than 2 mills on the dollar of assessed values be made to run for a period of sixteen years to creste a sinking fund for paying interest on the bonds and for redeeming the bonds as they fall due, as outlined in the attached schudule. 3Thah the Budget System of handling the.City's expenses be adopted.and that the Mayor appoint a Committee to outline for the year 1926 a budget and submit the same to the Council for their consideration. BILLS: The following bills against the City were submitted with the approval of the Auditing Committee;- Jim Mitchell, 7 days work $21.00 Andrew Munds do, $28.00, ( Street Cleaning). J.W.Shelly, $6.00; Patterson -Blair $73.50; John Zillah $10.00*W.S.Duggans $2.40; Read's $1.20; W.G.Barron $4.80; Goss -Rogers $4.40;Heerwagen Bros Co. $1.65; and $19.36; W.L.Crouch $4.15; Southwestern Be111Tel Co. $18.90; J.B.Black $13.70; Lyle Culvert and Road Equipment Co. $25.40;Harrison Hale $1B.00;W.A.Gregg $6.50.Alderman Harding moved tha t the bills be paid and the the Clerk de directed to issue warrants for the same. This motion was seconded by Alderman Mintun and received the following vote, ayes Aldermen Drake, Phillips, Prive Wages Harding, Mintun, and was declared passed by the Mayor. On motion it was ordered that in future the Fire Chief make his report in duplicate and file one copy with thw Water Plant Managers. On motion the Clerk was directed to notify the appellants in Mont Nord that their appeals will be heard on November 9th,_1925, at the regular meeting of the Council. ORDINANCE: Aldermn Price introduced an Ordinance to amend Ordinance 226, which was read the first time. Alderman Harding moved that the Rules be suspended and the Ordinance placed on its second reading. This motion.was seconded by Alderman Phillips and received the following vote;ayes Aldermen Drake, Harding, Mintun, Phillips, Pricw, Wages; nays none absent and not voting none and was declared passed by the Mayor. The ordinance was read the second time. Alderman Pries moved that thr Rules be further suspended and the ordinance placed on mts third reading and final passage. -.This motion wasseconded,.by-Alderman-Mintun and _received the f following vote; ayes Aldermen Drake, Harding,.Mintun, Phillips, -Price, Wages; nays none; absent and not voting none and was decilared passed by the.Mayor. The ordinance was read the third time. The Mayor then called for the vote on the.passage of the ordinance which was as follows; ayes, Aldermen Drake, Harding.Mintunm Phillips, Price, Wages; nays -none; -absent and not voting none and the Mayor declared -the ordinance passed. A copy is as follows;- (An DINANCE NO.579. Ordinance to be entitled "An Ordinance to Amend Ordinance No. 226 passed and approved on the 24th day of February,,1908." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION ONE. That sections 28 and 29 of Ordinance No. 226 passed and approved on the 24thhday of February, 1908 which provides for an.iron doable. vent._trap,.:vith_fresh air..inlet.to be pla- ced on all house drains, be modified.so that..the.said_double trap and fresh air inlet shall on ly be used for the most effective working of the plumbing:system._In.doubtful cases the Plumb4 ing Inspector will decide whether.or not..they may be used. SECTION TWO. That the following clause in Section-.31-bf..Ordinance.No.. 226 passed and approved on the 24th day of February 1908,.be repealed;- "No connections to lead branches for water clo- sets or slop sinks will be permitted, except the required branch vent." SECTION THREE. That the following clause in Section 33 of Ordinance No. 226 gassed and approved on the 24th day of February, 1908;- "All traps must be protected from syphonage and back pressure and the drainage system ventilated by special lines of vent pipes," shall not apply to drum traps. " WHEREAS, at a meeting of the City Council of the City of Fayetteville, Arkansas, held tho 19th day of October, 1925, a Petition signed by more than ten owners of real property within the district hereinafter described in Section One of this Ordinance, was presented to said City Council, asking that it take steps toward the making of an improvement consisting of constructing and maintainging an adequate water system for the benefit of property owners sithin the territory therein described. WHEREAS, in said Petition it was further prayed that the Council lay off a stipulated portion of real estate into an Imvrovement District for making said Improvements, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANBAS: SECTION ONE. LOUIS _ SAN FRANCISCO RAILWAY COMPANY WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS:" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section Ones'=:That the Mayor of the City of Fayetteville. Arkansas, be, and he is hereby authorized to enter into an agreement with the St. Louis - San Francisco Railway Company, for and in behalf of the City of Fayetteville, Arkansas, with reference to the laying of a sewer li line under the Right of Way of the St. Louis - San Francisco Railway Company within the City limits of the City of Fayetteville, Arkansas. HEARING OF APPEALS in Mont Nord Improvement District was deferred to November 16th, 1925. about the purchase of Fire Hose COMMUNICATION from the Board of Punlic Affair/ was read to the Council and action thereon was deferred. A PETTTION FOR SIDEWALK was presented by Berl Dodd et al, and on motion by A lderman Price seconded by Alderman Harding the City Engineer was diredted to establish a grade therefor. ' BOND OF HARRY E. HAMILTON as Plumber was filed with the City Clerk. APPROVAL OF BOND SCHUDULE; Alderman Phillips moved that the S bhudule prepared by Alderman Drake for the retirement of the proposed Issue of City Bonds be approved,accepted and adop ed, and that a vote of appreciation be extended to the Finance Committee and its diligent ' and efficient Chairman. Alderman Price seconded this motion which received the unanimous vote of the Council ROY VICKERS, COMMISSIONER of School Avenue Improvement District. Alderman Mintun moved that Roy Vickers be appointed to be a member of the Board of Improvement for School Avenue Im. provement District Number One. This motion was seconded by Alderman Harding and received the following vote; ayes Aldermen Drake, Harding, Mintun, P illips, Price Wages; nays none absent and not voting none and was declar ed passed by the Mayor.
