PRESENT: The Mayor, Clerk, Aldermen Harding, Mintun, Phillips, Price and Wages; Absent Alderman Drake. MINUTES of the previous meeting were read and approved. �o r � MOTION, by Alderman 1Tages, seconded by Alderman Mintun,and passed by the unanimous vote of the members present, the Council was declared in Executive Session. ORDINANCE, repealing Ordinance No. 56 , introduced by Alderman Harding and read the first time. Alderman Phillips moved the Rules be suspended and the ordinance placed on its second reading. This motion was seconded by Alderman Mintun and received the following vote; ayes Aldermen Harding, Mintun, Phillips, Price, Wages; nays none; absent and not voting Alderman Drake,and was declared passed by the .Mayor, The ordinance was read the second time. Alderman Phillips moved that the Rules be further suspended and the ordinance placed on its third read ing and final passage. This motion was seconded by Alderman Price and received the following vote; ' ayes Aldermen Harding, Mimtun, Phillips, Price, Wages; nays none; absent and not voting Alderman Drake and was declared passed by the Mayor. The ordinance was read the third time. The Mayor then called for the vote on the passage of the ordinance, which was as follows; Ayes Aldermen Harding, Mintun, Phillips, Price, Wages; nays none, absent and not voting Alderman Drake, The Mayor declared the Ordinance passed. A copy is as follows; - ORDINANCE N0.566. _ AN ORDINANCE TO BE EBTITLED "AN ORDINANCE TO REPEAL ORDINnNCE NO. 560,PASSED AND APPROVED ON THE 20th DAY OF JULY, 1926. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That Ordinance Number 560,passed and approved on the 20th day of July, 1925, be and the same is is hereby repealed. PASSED and approved this 27th day of August, 1925. Approved; Allan M.Wilson, Mayor. Attest; J.C.Massie, Clerk. This motion was seconded by Aldrman Harding and received the following vote; ayes Aldermen Harding, Mintun, ' Phillips, Price, Wages; nays none; absent and not voting Alderman Drake, and was declared passed by th Mayor. The ordinance was read the third time. The Mayor then called for the vote on the passage of the ordinance, which was as follows; Ayes Aldermen Harding, Mintun, Phillips, Price, Wages; nays none; absent and not voting Ald erman Drake. The mayor declared the Ordinance passed. A copy is as follows;- ORDINANCE N0. 567. ^I I AN ORDINANCE TO BE ENTITLED " AN ORDINANCE TO REPEAL ORDINANCE N0.561,PASSED AIZD APPROVED ON THE 20th DAY OF I� JULY, 1925. —! BE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY OF FAYETTEVILLE, ARKANSAS; SECTION ONE:That Ordinance Number 561, passed and approved on the 20th day of July, 1925, be and the same is hereby repealed. PASSED and approved this 27th day of August, 1925. Approved; Allan M. Wilson, Mayor. Attest; J.C.Massie, Clerk. ' ORDINANCE, providing for Management of the City Water Plant, was introduced by Alderman Phillips, and read the first time. Alderman Harding moved that the Rules be suspended and the ordinance placed on tits second reading, this motion was seconded by Alderman Price, and received the following vote; ayes Alderman Harding, Mintun, Phillips, Price, Wages; nays none; absent -and not voting'Alderman Drake, and was d Glared passed by the Mayor. The Ordinance was read the second time. Ald rman Price moved that t#/ Section Four of the ordinance be amended by inserting after the word "them" the words "after ten days notice has first been given such member of said Board". This motion was seconded by AldermanPhillips and received the following vote; ayes Aldermen Harding, Mintun, Phillips, Price; nays Aldrman Wages; absent and not voting Alderman Drake. The Mayor de- olared the motion passed, and the words were accordingly inserted,by interlining with "pen and ink". After discussion, the names of the following men were inserted in Section Two, as constituting the proposed Board of Managers,to-wit J.H.McIlroy, W.J.Lewis, C.W.Appleby, B.F Campbell and James English, these names being written in with "pen and ink". Alderman Harding moved that the Rules be further suspended and the o-dinance placed on its third reading and final passage. Alderman Mintun seconded the motion which received the following vote; ayes Aldermen Harding, Mintun, Phillips, Price, Wages; nays none; absent and not voting Alderman Drake. The Mayor announced that he would with -hold his approval of the ordinance under the authority vested in him by the State Laws. A copy of the amended Ordinance is as follows;,, ORDINANCE N0.568. (See next page) 104 ORDDINANCE NU.568. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE TAKING OVER THE WATER PLANT OF WATER IMPROVEI:IENT DISTRICT NUMBER ONE OF THE CITY OF FAYET'TEVILLE,ARKANSAS,NAMING A BOARD OF MANAGERS FOR SAME,AND FOR OTHER tURPOSES." WHEREAS a number of years ago there was duly created in the City od Fayetteville, Arkansas,an Improvement District known as'Water Improvement District Number One of the City of Fayetteville, Arkansas; WHEREAS, bonds were duly issued by the duly appointed Board of Improvement,and said Water Plant was duly con- structed; WHEREAS, each and all of said bonds have duly paid off and retired; WHEREAS, the City Council of the City of Fayetteville, Arkansas,now elects to exercise its rights under the 1 law and take oversaid Water Plant for the purpose of naming a way to manage the same; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIELE, ARKANSAa: SECTION ONE: That the full management, operation and control of the Water Plant of'Water Improvement District Number One of tfie7City of Fayetteville, Arkansas,be, and the same is hereby,taken over by the City of Fay= etteville, Arkansas, to be managed, -operated and controlled as hereinafter set forth., SECTION TWO: That the management, operationX and control of said Water Plant'of Water Improvement District Num- ber One of the City of Fayetteville, Arkansas,be turned over to a Board of Managers consisting of Q J.H.McIlroy, W.J.Lewis, C' Appleby, B.F.Campbell and James English, qualified electors of the SECTION FOUR: The said City Council specifically reservesthe right to, at any time, dispose of the services of either one or all of said Board of Managers, with or without cause, and with or without a hearing being given them,after ten days notice has first been given suchmember of said Board, and said Board shall be subject,st all times, to the directions of the City Council of the City of Fayette- ville,Arkansas. SECTION FIVE: This Ordinance shall take effect and be in force from and after its passage, approval and publicam tion,and all Ordinances and parts of Ordinances in conflict herewithbe, and the same are hereby repealed. SETION THREE: Within ten days after the passage, approval and publication of this ordinance,said Managers shall take the oath of office required by the Constitution and laws of the State of Arkansas,and shall forth- with meet at some convenient place,by notice to each member,and proceed'to organize by electing one of their number as Chairman, and such other officers as they may see Pit --said Board of Managers to adopt their own rules with reference to the time of meeting and prodeedure of business.
