REGULAR MEETING OF THE CITY COUNCIL
HELD MAY 4th,1925.
Present; the Mayor, Clerk, Aldermen Harding, Idintun, Phillips Price, '.'rages; absent Alderman
Drake.
The minutes of the two meetings on April 13th, _.nd of the meetings of April 20th,and 27th,
' 1925 were read and approved.
The regular order of business= was deferred ,in ord.:r to hear and consider the matters
presented to the Co..ncil by several visiting citizens.
Mr. .Jim Williams presented the matter of providing for an elevator at the City Hospital,and
the members of the Council informally agreed_ to arrange for the raising of the sum of 96,000.00
' for that purpose.
The matter of securing better depot facilities was presented by Dr, Gladson, representing
the Chamber of Commerce. Mr. Craig also spoke on the same subject. Following their remarks,and
some discussion by the Mayor and members of the Council, the Mayor appointed a committee composed
of the Mayor, Aldermen Price and Mintun to confer w1th the r ilway Officials and in conjunction
with representatives of various civic organizations,to endeavor to secure improvements at the
Station.
' Mr. DeVorcheck and lar Will Hamilton presented the matter of band concerts during the summer
months; which on motion +ria referred to the C ity Attorney for an opinion as to the legality of
appropriating public funds for the purpose.
The reports of the City Collector and the Police Judge were presented ynd on motion were
referred to the auditing Commi tee.
The report of the Fire Chief was read and ordered receive and filed.
A petition of Ivlr. J.H.Ray for relief in the matter of his sidewalk was referred to the
Chairman of the Street Committee and the City engineer
The resignation of Mr. 2rank ,lilliams as Street Commissioner was presented and on motion was
accepted as of April 15th, 1925.
Mr. 4, _.Cravens and I:Ir. Jerome Reynolds offered their resignations as members of the City Boa
Board of Health. These resignations were, on motion duly accepted.
The Mayor then appointed Mr. Fred Readles, and Mr. Norm -..n IrIcCartney as members of the Board
of Health.,Alderman Phillips moved that the appointments be approved and confirmed. This motion w
was seconded by Alderman Harding and received the unanimous vote of the Members present.
On motion by Aldermaninintun secondef by lderm n Harding the following bills ag inst the City
having been approved by the Auditing Committee were ordered paid and the Clerk was directed to is
issue warrants for the same.

Or_ motion duly p t and ;:_rried the Chairman of the Street Committee was directed to confer +
with Mr. Dinwiddie in an effort to devise some equitable plan for controlling the water on Maple
Street adjacent to Mr. Dinwiddie's property, and to report ay the next meeting of the Council.
On motion by Alderman Harding, seconded by Al erman Mintun that the salary of Patrolman
Neil Cruse by raised to the sum of 970.00 per monTyh, effective Ma.y 1st, 1925, the vote of the ftTY
Council was as follows;- ayes Aldermen Harding, Mintun, Phillips, Price, Wages; nays none; absent
and not voting Alderman Drake; whereupon the Illayor declared the motion passed,and the salary of
Mr. Neil Cruse set at 070.00 per month, from and.after May lst, 1925.
The bill of the Street Sweepers,D.C.Condra, $24.00 and Jim Mitchall ?18.00 was presented and
AldermEn Mintun moved that the same be allowed and the Clerk directed to issue warrants for the
same. This motion was seconded by Alderman _rice and received the following vote; ayes Aldermen
Harding, i.Iintun, Phillips, Price ';Mages; nays none; absent and not voting Alderman Drake, and was
declared passed by the MayFr.
Aldermen '.;ages and Phillips V�'ith the City Engineer were appointed a committee to confer with
Kelly & Phipps with reference to better protection of pedestrians at the corner of College and 5e
' Center.
On motion by Alderman Harding, se.;onded by ,Merman Iti4intun and carried by the unanimous vote
of the Council, the City ngineer was directed to establish a grade for the paving of 50 feet of
the alley,westward from College Avenue,along the North side of the lot occupied by Kelly& Phipps,
Alderman Mintun introduced an Ordinance levying t��hgg� Asup sment on West Mountain Street Improves
ment District Number One of tile City of Faytttevill e�;'�hiOV was read the first time.
Alderman Harding moved that tPe Rules be suspended and the Ordinance placed on its second rea
reading. This motion was seconded -by Alderman _Mintun and received the following vote; ayes
' Aldermen Harding, Mintun Phillips, Price, Wages; nays none; absent and not voting Alderman Drake
and was declared passed by the Mayor. The Ordinance was read the second time.
Alderman Mintun moved that the Rules be further suspenderknd the Ordinance placed on its
third reading and final passage. This motion was seconded by j1derman Price and received the foll
i owing vote; ayes Alderman Harding, Ivlintun, Phillips, Price, Wages; nays none; absent and not vot-
ing Alderman Drake, and was declared passed by the Mayor. The ordinance was read the third time.
The Mayor then announced the question to be shall the Ordinance pass, and called for the vote on
the passage, which was as follows;- ayes Aldermen Harding Mintun, Phillips, Price, 17ages; nays
none; absent and not voying Alderman Drake, and the Mayor declared the Ordinance passed.

AN ORDINANCE. TO BE ENTITLED,"AN ORDINANCE TO LEVY THE ASSESSMENT UPON THE
REAL PROPERTY WITHIN WEST MOUNTAIN STREET IMPROVEMENT DISTRICT NUMBER ONE OF THE CITY OF
FAYETTLVILIE,ARKANSAS".

WHI]REAS,the majority in•value of the property holders owning property adjoining the locality
to be affected,and situated in West Mountain Street Improvement District Number One of the City o
of Fayetteville, Arkansas,organized for the purpose of grading, rolling and paving with Asphaltic
Pavement, the Streets and parts of streets within said West Mountain Street Improvement District
Number One of.the City of Fayetteville, Arkansas,have petitioned the City Council of the said Cit„
of Faybtteville, Arkansas,for the -construction of said improvement,and that the cost thereof shall
be charged and assessed against the real property within said Distriet,according to the benefits
to be received; and
WHEREAS,said benefits received by each lot or block or parcel of real property situated
within said District,equals or exceeds the local assessment;and
WHsREAS, the estimated cost of said improvement is $11,500.00;
NOW,THEREFORE,BE IT ORDAIN_:D BY THE CITY COUNCIL OF THE CITY OF FAY ETTEVI LLE,ARKAN SAS:
SECTION ONE:
That said several lots, blocks and parcels of real property within said District,be
assessed according to the assessment list for said Improvement District,as the same now remains
in the office of the Recoolder,or City Clerk;and that ten per centum on said lots,blocks and (arca
parcels shall be paid annually on or before the first Monday of November until thw whole of said
local assessment shall be paid.
SEC`T'ION TWO:
That all Ordinances and parts of Ordinances iii conflict herewith be, and the same are
hereby,repealed,and this Ordinance shall take effect and be in force from and after its passage,
approval and publication.
Passed and approved this 4th day of May, 1925.

The-.Iinuted of the previous meeting were read and approved.

W.M.Black presented a request for grade for sidewd.1k on Oxark Ave. The Clerk was directed
to inform Mr. Black that it is the custom of the Council to grant such requests only when
petitioned to do so by a majority of the property holders aff._cted.
On request, permit was granted to Miss Jane Moore to drive a car on the streets of the Ci
ty, subject to the approval of the Chief of Police.
Alderman Harding moved that the bills approved by the Auditing Committee as listed below
be allowed and the Clerk directed to issue warrants for the same. This motion was seconded by
Alderman Phillips and received the following vote; ayes Aldermen Harding, Mintun, Phillips,
Price, Wages; absent and not voting Alderman Drake, and was declared passed by the Mayor.

The reports of the City Collector and of the Police Judge for the ISonth of April were re-
turned by the Auditing Committee,endorsed as correct, and on motion were ordered filed.
Alde rman Hading was appointed to serve with the Committee charged with the duty of inve
investigating mlir. Black's property as to an adequate outlet therefrom.
The Street Committee was directed to confer with Major DavidF,on,and to report a plan for
control of the drainage affecting the davidson property, and report at.the next meeting,
The City Engineer was directed to submit a plan for control of the drainage at the Din-.
widdie Place on :iesi Maple Street.
Alderman ':Mages introduced an Ordinance providing for an appropriation for a n elevator at
the City Hospital which was read the first time. Aldertpan Phillips moved that th Rules be
suspended and the Ordinance placed on its second reading. This motion was seconded by Alderma7ft.N
Price and received the following vote; ayes Aldermen Harding Mintun, Phillips, Price,:Iages;
nays none; absent and not voting ::lderman Drake',and was declared passe d by the Iviayor.
The Ordinance was read the second time.
