motion was received and filed.

which was granted, subject to the approval of the City Engineer.
A.W.Jamison applied for a permit to his son Daniel to drive an Auto, which was granted, sub-

The report of the City Engineer and of the En gineer for the State Fire Prevention Bureau

provision for the payment for the same, which was read the first time. Aldermen Harding moved
that the Rules be suspended and the Ordinance placed on its second reading. This motion was secon-
ded by Alderman Jackson and received the following vote; ayes Aldermen Drake, Harding, Jackson,
Mintun, Phillips; nays none; absent end not voting Aldermen Price and was declared passed by the

the Board of Public Affairs did on the 15th d y of January,1925 enter into a contract
with the American- LaFrance Fire Engine Company of Texas to purchase One(1)"Type 75" 6-cyl., 105
H.P.Triple,Comb. Pumper,Hose and Chem. Car,with 750 -gal. Rotary Gear Fire Pump,at and for the
agreed price of Thirteen Thousand Nine Hundred Forty Dollars (413,940.00); Four Thousand(44,000.
df said amount to be.paid in cash,and the balance to be paid by City Warrants,payable in the

said Fire Pumper has been received,tested.and approved by the Sate Fire Prevention Burea 4 -
the City Engineer and the Board of Public Affairs,
NOW,THSREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:
SECTION ONE:
That the contract entered into by the Board of Public Affairs with the American La -
France Fire Engine Company of Texas,on January 15th,1925,for the purchase of said Fire Pumper and
the acceptance of said Fire Ptmper by said Board of Public Affairs be, and the same is in all
things approved and confirmed, and the purchase of said Fire Pimper is approved,and the same here
by accepted.
SECTION TWO;
' That pursuant to said contract the Mayor and City Clerk of the City of Fayetteville,
Arkansas are hereby directed to issue and deliver to the American- LaFrance Fire Engine Company o
of Texas a warrant for the sum of Four Thousand dollars,$4,000.00,drawn on the "Fire Sinking
Fund" of said City to pay the cash payment according to said contract and to draw five other
warrants on said fund and deliver the same to the said American -La France Fire Engine Company of
Texas,to be made payable for the amounts and on the dates as follows;

six to five, and to change the =ounts of said warrants from the sums originally stated in the Or
dinance to the amount of $1,120.00 for each warrant,and that the Clerk be authorized and directed
to make slid changes in the text of said Ordinance. This motion was -seconded by Alderman Mintun

Drake; absent and not voting Alderman Price, and was declared passed by the Mayor.
Alderman Jackson then moved that the Ordinance be placed on its third reading and final passage.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKAidSAS: '
SECTION ONE:
That repairs and improvements be made upon the following named streets in the City
of Fayetteville, Ark nsas,at the places herein named, to -wit;
Hill Avenue andoStone. Street, Hill Avenue and Putman Street, Hill Avenue and Treadwell
Street, Hill Avenue and Center Street.
SECTION TWO:
That said improvement shall consist of paving of the intersections of said streets
and the construction of the necessary culverts and drains to take care of the drainage which m
must pass under the paving from the paved streets from the adjacent territory next to said
intersections of said streets.
SECTION THREE: '
The City of Fayetteville, Arkansas, by the City Council of said City hereby cont^
tracts with the Phoenix Construction Company of Fort Smith, Arkansas,for the said Phoenix
Construction Company to do and perform the work ,nd lavor, and furnish the necessary material
for therepair and construction as herein set forth on said streets,and at said intersections
of streets as herein mentioned,said improvements to be according to the plans and specifica-
tionson file in the office of the City Engineer of the City of Fayetteville, Arkansas.
The City of Fayetteville, Arkansas, agrees to pay said Company for the same as follows;
For all work, labor and material furnished:,the City of Fayetteville agrees to pay as
follows;
For Intersections, Drains and Culverts $5,600.00,which amount the City Council finds
to be a fair and just compensation for said material furnished and work and labor to be per-
formed,in such improvement. "
SECTION FOUR: I •
Upon the completion of repairs and improvements upon said streets at the places
hereinbefore described by the Phoenix Construction Company,and the acceptamce of said mater-
ial used and work and labor done in said repairs and improvements,by the City Council of the
City of Fayetteville, Arkansas, --said City of.Fayetteville agrees to'pay said Phoenix Con-
struction Company Fifty-six Hundred (5,600.00) Dollars to be paid out of the General Revenue
Fund of said City by warrants drawn in favor of said Phoenix Construction Company, or bearer,

to pay said owner of said warrant the sum of eight per cet interest per _.nnum on said
amount of said warrant from d to of sach default, until the said amsumt is fully paid, as an
agreed and stipulated penalty and as damages for failure to perform its part of its contract
with said Phoenix Construction Company, or the owner of said warrant.
SECTION FIVE:
This contract shall be binding upon the City of Fayetteville ,Arkansas, from and a `
after the passage, approval and publication of this Ordinance,and the acceptance of the same
by the s;.id Phoenix Construction Company, in writing, filed in the office of the City Clerk of
the City of Fayetteville, Arkansas, and compliance with its terms by the said Phoenix Con-
struction Company on its part. I -
The City of Fayetteville, Arkansas, hereby pledges itself, and all of its officers, to
the faithful performance of this contract as herein set forth in this Ordinance,upon the full
performance of the contract herein set forth,on the part of the said Phoenix Construction
Company,
SECTION SIX: A

approval and publication.

WE, the Board of Improvement of West Mountain Street Improvement District Number One of"thy
City of Fayetteville, Arkansas, herewith submit the plans and specifications of the proposed
pavement, and the estimate of the cost of the same.
We hwve employed as Engineer for the proposed X;1tJXII l improvement,E.M.Ratliff of Fayettev
ville, Arkansas. He has made surveys, and the plans and estimates,as submitted, are based on t
the surveys. The plan of the pavement is attached herewith,, and marked ".Exhibit A" to this
report.
Total estimated cost of the construction, exclusive of interest, and inclusive of con-
tingencies, is $15,000.00.

and A.M.Byrnesas the Board of Improvement of West Mountain Street Improvement District Number
One of the City of Fayetteville, Arkahsas,their report,.together with the plans of.the work to
be done in the construction of the improvement contemplated by said Improvement District,and
the said report h&wing been read in open meeting of said Council,and said plans having been exhib
ited to said Council,and to each member thereof, with a full and complete explanation of all the
details thereof,and it apperaing, from said plans,that the estimated cost of X091100#009
the construction of said improvement,exclusive of interest charges, and inclusive of contingen-
cies, is the sum of $15,000.00, and the said Council being satisfied that said plans will best
