SPECIAL MEETING OF THE, CITY COUNCIL HELD AT THE MAYOR'S
OFFICE,2;00 P.M. JANUARY 15th, 1925.
Present, the Mayor; Aldermen Drake, Jackson, Mintua Phillips, Price; absent Alderman Harding;
Alderman Jackson was elected actine Clerk.
The Mayor stated the object of the meeting to be the consideration of bids for the sale to t7r
City of a Fire truck.
The first bid.opened was that of Obenchain Boyer Co., submitted by Ned Finney in the form of
a telegram offering a 600 gallon combination at $9.000.00; to•a 750 gallon tripple combination
at 10 $109000.00

at $7,879.00
Alderman Harding entered at this -time..
The third bid was that of the Seagraves Company, which was $12,500.00 for a triple combination
750 ga%lon truck.
The flurth bid was that of the American La France Co, which was $12,500.00 for a triple combi-
nation; also 500 gallon and 600 gallon at lower prices.
The fifth bid was th t of Aron- Fox Co, which was$13,900.00 for a
triple combination, 750 gallon combination.
At this point the Council went into executive session to hear the arguments of the repre-
sectatives of the various Companies who were present and desired to be heard.
Each representative was given 30 minutes to state his ease;after which the Council,in execu-
tive session considered the claims and merits of the various machines .
® After due and careful consideration, Alderman Mintun moved that the Board of Public Affairs b^
be instructed to contract with the American LaFrance Fire Engine Company for the purchase of one
Triple combination 750 gallon motor driven Fire Truck for the sum of 012,500.00,delivered at Faye^
etteville, Arkansas, This motion was seconded by Alderman Phillips and received the folowing vote
Ayes Aldermen Drake, Harding, Jackson, Mintun, Phillips and Price; nays none; absent and not
voting,none and was declared passed by the Mayor.
Alderman Drake moved that the Board of Public Affairs be direct to purchase 1,000 feet of
Paragon Brand Fire Hose from the Eureka Hose Company,at�/1, s per foot,
including interest on the deferred payments from June lst,1925; the payments to be made in one
and two years from said date. This motion was seconded by Alderman Price and received the follow
ing vote; sues Aldermen Drake, Harding, Jackson, Mintun, Phillips, Price; nays none, absent and
not voting none and was declared passed by the.irle
The Council then adjourned.

REGULAR MEETING OF THE CITY COUNCIL HELD
JANUARY 19th,1925.
Present; the Mayor, Clerk, Aldermen Drake, Harding, Jackson, Mintun, Phillips, Price.
The minutes of the previous meeting were read and approved.
The report of the Street Commissioner was received and filed. Alderman Jackson moved that
the payroll pf the street laborers be paid and the Clerk directed to issue warrants for the
same. This mopion was seconded by Aldemman Phillips nd received the following vote; ayes
Aldermen Drake, Harding. 2ackson, Miritun, Phillips, Price; nays none, absent and not voting none,
and was declared passed by the Mayor.

Thq following bills against the City were referred to the Auditing Committee;-
Ozark Filling Station $26.10; C.A.Moreno y'110.75 Pierce Oil Corp. 0.00. .R.Hooper $50.00
Dr. W.L. Bleeker $28.00.
Alderman Phillips moved that the bills of W.A.Gregg for cash paid for Police service, $15.00
Geo. J. Kayer & Co. for tags, $38.85; and 85% of the Pho enix Construction Co.'s bill -for paving
on University Street, $948.12 be allowed and the Clerk directed t o issue warrants for the same.
' Alderman Jackson seconded this motion which received the following vote; ayes Aldermen Drake,
Harding, Jackson, Mintun, Phillips, Price; nays none, _bsent wnd not voting none and was declared
passed by the.Mayor.
Alderman Harding moved that the following bills, which were returned by the Auditing Committe
with approval;to-wit John Zillah §15.00; J.,W.Shelley $10.25; Southwestern Bell Tel. Co. $10.50;
and W.G.Barron Post Co. $25.50, be paid and the Clerk directed to issue Warrants fort the same.
Alderman Drake seconded this motion which received the following vote; ayes Aldermen Drake,
Harding, Jackson, Mintun, Phillips, Price; nays none, absent and not voting none, and was declare
passed by the Mayor.
On motion by Alderman Jackson seconded by Alderman Price, the hearing of complaints on the
Occupation Tax was set for Wednesday, January 28th, 1925.

Thearsignation of .F.Campbell.a a member of the following Boards, via. Sewer Improvement
District Board of Assessment. -Also the Boards of As essment of North Cibllege Avenue Improve-
ment District; East Center Street Improvement District; and Wall Street Improvement District
was presented to the Council;, whereupon Alderman Harding moved that the resignation be accepted,
and Mr. Campbell released from further service on said Boards. This motion was secohded bit Alderm
Jackson and received the following vote; ayes Aldermen Drake, Harding, Jackson, Mintun, Phillips

Price; nays none; absent and not voting none, and was declared passed by the Mayor.
The resignation of E.L.Nettleship as member of the Board of Assessment for nnex'to Sewe
Improvement District was presented to the Council and Alderman Mintun moved that the same be
accepted. This motion was seconded by Alderman Harding and received the folowing vote; ayes
Aldermen Drake, Harding, Jackson, Mintun, Phillips, Price; nays none, absent and not voting
none and was declared passed by the Mayor.
Alderman Drake introduced an Ordinance granting permits to business and other occupa-
tions, which was read the first time. Alder, man Harding moved that the Rules be suspended an
and the Ordinance placed on tts second reading. This motion was seconded by Alderman Phillip
and received the following vote; ayes Aldermen Drake, Harding, Jackson, 11intun, Phillips and
Price; nays none; absent nd not voting none and was dec&red passed by the Mayor. The Ordina
Alderman Phillips then moved that the Rules be further suspended and the Ordinance-paleed on
its third reading and final passage. This motion was seconded by Alderman Jackson and receiv
ed the folAowing v(1te; ayes Aldermen Drake, Harding, Jackson, Mintun, Phillips, Price; nays
none; absent and not voting none and was declared passed by the Mayor. The Ordinance was
read the third time. The Mayor then called for the vote on the passage of the Ordinance whic
was as follows; ayes Aldermen Drake, Harding, Jackson, Mintun, Phillips, Price; nays none;
absent and not voting none and the Ordinance was declared passed by the Mayor. A copy is as

)I ' That the City Council of the City of Fayetteville, Arkansas, shall have the powe

authority to grant building permits for any purpose at any place within the city limit
of said city,and the granting of a permit by the Oity Council ,to build a building for any
purpose at any particular -place in said City, will also eery with it the right to operate in
said building the business for which said building is constructed,provided the privilege and
1, other taxes are paidas required by law;provided further that no permit to build a building
V. shall be granted except in accordance with the building code now in force.
SECTION TWO:
That this ordinance shall apply to all -building permits heretofore or hereafter
issued by said City Council.
SECT THREES

Fransisco Railway Co. to construct a sidewalk across thier Right of Way, on the Vlest side of
Hill Avenue. This motion was seconded by Alderman Price and received the following vote; aye
Aldermen Drake, Harding, Jackson, Mintun, Phillips, Price; nays none, absent and not voting,

The Report of the Board of Improvement for No Leverett avenue mprovement District wa
was presented to the Council. Alderman Har ding moved that the report be received, filed and
spread of record. This motion was secondedby Alderman Drake and received the following vote
ayes; Alderman Drake, Harding, Jackson,'LUntun, Phillips, Price, nays none; absent and not
voting, non ; and was declared passed by the Mayor.The report is as follows;-

REPORT OF THE BO.:RD OF IMPROVEMENT OF NORTH LEVERETT AVENUE IMPROVEMENT DISTRICT NUNBI,R ONE
OF THE CITY OF FAYETTEVILLE? ARKANSAS.
TO THE HONORABLE CITY COUNCIL OF THE CI'Y OF FAYETTEVILLE,ARKANSAS;
We, the Board of Improvement of North Leverett Avenue Improvement District Number One of
the City of Fayetteville, Arkansas;respectfully beg leave -to report that we have -secured the
services of E.M.Ratliff,of Fayettevi le, Arkansas, civil engineer,as engineer of said Improv
ment District; that he has made the necessary plans, surveys and estimates to determine the
typr of pavement to be used within said District, and to determine the cost of the same.
Estimates of cost were submitted on various types of pavement,but the type of pavement
which has b an adopted is commonly known as CVoncrete pavement,which shall be constructed on•
a base suitable to withstand heavy trcffic.
Detailed estimates of costs and plans,which were prepared by said E.M.Ratliff,are sub-
mitted herewith for your consideration.
The highest estimated cost of said Improvement,exclusive of interest charges, is the
sum of $190000.00.
To assess the benefits against the various lots, Blocks :and parcels of real estate
within said District,we recommend that your Hanorable Body appoint by resolution,as assessor
three qualified electors of the City of Fayetteville, Arkansas.

Alderman Harding introduced a resolution approving ther port of the Board of Improvement
of North Leverett Avenue Improvement District Number On and moved its adpption. This motion
was soconded by Elderman Jacksonoand received the following vote;ayes Aldermen Drake, Hardin
Jackson, Mintun, Phillpps, Price; nays none; absent and not voting none, and was declared
passed by the Mayor. A copy is as follows;-

WHEREAS, at a meeting of the City Council of the City of Fayetteville, aArkansas,held on the
19th day of January,1925,there was presented to said City Council,by D.R.n'off, Henry Smith,
and J.2.1owell,as the Boaft of Improvement bf North Leverett Avenue Improvement District
Number One of the City of Fayetteville, Arkansas,their report, together with the plans of th
the work to be done in the construction of the improvement contemplated by said Improvement
District,and the said report having �een read in open meeting of said Council,and said plans
' having been exhibited to X&I s`arild Council ,and to each member thereof ,with a full and
complete explanation of all the details thereof,and it appearing, from said plans, that the
estimated cost of the construction of said improvement,exclusive of interest charges, and
inclusive of contingencies,is the sum of $19,000.00, and the said Council being satisfied th
that said plans will best subserve the purposes of said Improvement District,and that the sa
same are correct;
NOW,THEREFORE; BE IT RESOLV:D BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE;ARKANSAS
:
That said plans and said report be, and the same are hereby approved and adopted, and that s
said improvement be constructed according to said plans„and at a cost not to exceed,exclu-
sive of interest charges, and inclusive of contingencies, the sum of $19,000.00.

Alderman Mintun moved that the City Attorney be directed to prepare a•petition to the
Arkansas Rail Road Commission asking them torequire the Western Union Telegraph Compa
ny to maintain a 24 hour service at Fayetteville, AXX// 0#1 Arkansas. This motion was second
ed by Alderman Jackson and received the following vote; ayes Aldermen Drake,%Harding, Jackso
Mintun, Phillips, Price; nays none; absent and not voting none an�:.was declared passed by th
Mayor.
On motion by Alderman Mintun,seconded b y Alderman, Price ans carried.by the unanimous
vote of the Council the Chairman of the Fire Committee was directed to arrange with the
Goss -Rogers Electric'Co., the terms of a contract to be entered'into as to the use of the
South wall of the Fire House,
The Finance Committee reported that, while they rrealized that the Taxi owners were payer
ing a large sum for their privileges, the amount charged by the City was not excessive, and
they therefore recommended that no change be made in the City license. On motion by Alderma
harding, seconded by Alderman,Jackson and carried by the unanimous vote of the Council, the
report was ordered received'and filed,

' The time having arrived for the consideration of the Occupation Tax Ordinance,the matter
was introduced by the Mayor who made a statement of thelegal status of the Ordinance,showing t --
the same to be extremely precarious;in view of which fact he stated that he had directed the
Collector to discontinue all collections under the Ordilnace. There followed a discussion of
the Ordinance in which members of the Council and a number of citizens took part.
' Finally Alderman Harding in6r6quced an Ordinance repealing Ordinance Number 531,the
Occupation Tax, which was read,the first time. Alderman Jackson moved that the Rules be sus.
pended and the Ordinance places on•its second reading. This motion was seconded by Alderman
Drake, and received the following vote; ayes Aldermen Drake, Jackxon, Mintun Phillips; nays
none; absent and not voting Alderman'Price,and was declared passed by the Mayor.The Ordinance
was re -d the second time. Alderman Phillips then moved that the•Rules be further suspended
and the OrdinJnce placed on its third reading and final passage. Alderman Harding seconded,
this motion which received the following vot.el ayes Aldermen Drake, Harding, Jackson, Mintun,
Phillips; anys none; absent '�nd-not voting Alderman Price, and was declared passed by the Mayor �
who then called for the vote on the passage of the,Ordinance which was as follows; ayes,
