REGULAR MEETING OF 'THi: CITY COUNCIL HELD
Dii:CEMBER 29th,1924.
Present; the Clerk, Aldermen Drake, Harding, Jackson, Mintun and Phillips; absent, the Mayor
and Alderman Price.
On Motion duly made put and carried, Alderman Harding was chosen as pro tem
The minutes"of the previous meeting were read add approved.
The annual report of the City Health Officer, Dr', A.S.Gregg was read to the Council and on
motion ,carried by.the unanimous vote of the members present was ordered received and filed.
In compliance with the recommendation of the City Health Officer, Alderman Phillips moved that th.9-
City Engineer be directed to investigate the matter of installing an incinerator, and report to
the Council the probable cost of the dame. This motion was duly seconded by Alderman Mintun and
received the following vote; ayes Aldermen Drake', Harding, Jackson, Mintun,.Phillips; nays none;
absent and not voting Alderman Price, and was declared passed by the Chairman pro
tem.
Alderman Phillips moved that the Sanitary Policeman be directed to file a report as to the
number of surface closets in use anal as to the number which had been ordered discontinued, and
whether or not the order had been complied with; also to collect the oil cans used for the
'~ distribution of kerosine in the fight on musquitos and store them for future use. This motion
was seconded by Alderman Drake and received the following vote; ayes Alderman Drake, Harding, Jack
son, Mintun, Phillips; nays none; absent and not voting Alderman Price, and was declared passed
by the Chairman pro tem.
The report of the Street Commissioner for the Week ending Dec. 27th, 1924 was ordered receiveoL
and filed.
Alderman Pgillips moved that the payroll of street laborers be allowed and the Clerk directed
to issue wqrrants for the same...This motion was seconds by Alderman Jackson and received the
following vote; ayes Alderman Drake, Harding, Jackson, Mintun, Phillips; nays none; absent and not
voting Alderman Price and was declared passed by the Chairman pro tem.

Alderman Drake introduced the following resolution and moved its adoption. This motion was
seconded by Alderman Jackson and received the following vote; ayes Aldermen Drake, Harding, Jack-

Arkansas,by proper resolution did appoint D.R.Eoff, J.E.Dowell and J.VI,Murphy three owners of
real property within the limits of North Levebett Avenue Improvement District Number One of the a --
City of Fayetteville, Arkansas,as a Board of Improvement for said District, and
WHER.:AS,the said J.W.Murphy has declined to qualify and act as a commissioner of said DtstYr
District,

SECTION ONE:
That D.R.Eoff, J.E.Dowell and Henry Smith, three owners of real property within the
limits of North Leverett Avenue Improvement District Number One of .the City of Fayetteville, Arka—
aneasbe, and they are hereby, appointed as a Board of Improvement for said District.
S::CTION TWO:
That all resolutions and parts of resolutions in conflict herewith be, and the same a�
are hereby, repealed, and this resolution shall be in force and effect from and after its passage
and approval.

Improvement District Number One of the City of Fayetteville, Arkansas,did on the 29th day of
' December,1924,deposit with the City Clerk of the City of Fayetteville, Arkansas, the assessment
roll of Wall Street Improvement District Number One of the City of Fayetteville, Arkansas, duly
subscribed by each of them;

That the City Clerk of the City of Fayetteville, Arkansas be, and he is hereby,re-
quired to cause to be published in the Fait$teville Democrat, a daily newspaper published in the
City of Fayetteville, Arkansas, a notice, statbng that said Assessment has been so filed by said
'Board of Assessment,and that the same is now subject to inspection
SECTION TWO:
That all Orders and Resolutions in conflict herewith be, and the same are hereby
repealed,and this resolution shall take effect and be in force from and after its passage and
approval.

The time for the hearing on the Second Petition in West Mountain Street Improvement Dist'
trict Number One of the City of Fayetteville, Arkansas, having arrived, and there being no ons
present either for or against the said Petition; Alderman Phillips moved that in order to
give ample time and opportunity to such persons as might desire to be heard in the matter, the
hearing �� on said second Petition in West Mountain Street Improvement District Number One be
continued to X� January 5thl 1925. This motion was seconded by Alderman Drake, and received
the following vote; ayes Aldermen Drake, Harding, Javkson, Mintun Phillips; nays none, absent

The time for the hearing on the Petition to form Annex Number One to Improvement �
District Number One of the City of Fayetteville, Arkansas, having arrived, Alderman PPi11-1-ips��
moved that in order to give ample time and opportunity to such persons as might desire to be
heard in tG matters; to be present and state their reasons for. or against the formation of
said Annex by the Ority Council, the hearing on said Petition be continued to January 5th 192

Alderman Jackson offered the following motion; That hereafter,the purchase of supplies of
any kind for any department of the City shall be first referred to the Chairman of the Com-
mittee in charge of that department, and be authorized by him.This motion was seconded by.Ald"
erman Drake and received the following vote; ayes Aldermen Drake, Harding, Jackson, Mintun,
Phillips; nays none; absent and not voting Ald rman Price* and was declared passed by the
Chairman pro tem.
The Ordinance providing for the bonding of salesmen under certain conditions,being on its
second reading, was reported back by the Ordinance Committee with the recommendation that it
be placed on its third reading and•final passage and Alderman Mintun so moved. Thio motion waie-
seconded by Alderman Harding and received the following vote; ayes Alderman Drake, Harding,
Jackson, Mintun, Phillips; nays none; absent and not voting Alderman Price. The Ordinance was
read the third time. The O4M4afa�1 pro tem then called for the vote on the passage of the Odie
nance; which was as follows- ayes Aldermen Drake, Harding, Jackson, Mintun, Pbillips; nay
none; absent and not voting Alderman Price, and thg Ordinance was declared passed by the
Chro tem. A copy is as follows;-
p ORDINANCE NUMBER 536
AN ORDINANCE TO BE ENTITLED '-" AN ORDINANCE TO REQUIRE SOLICITORS OR SALESMEN IN CERTAIN
CASES TO TAKE OUT LICENSE AND MAKS BOND ,AND FOR OTHER PURPOSES."
BE IT ORDIANED by the City Council of the City of Fayetteville, Arkansas;
SECTION ONE:
s�� That hereafter all persons soliciting or taking orders in the City of Fayettevill
5r��rkansas,for goods, wares or merchandise upon which a deposit is asked or taken for goods so
6' old at the time of taking the order for said goods, -wares or merchandise,shall, before
taking orsolicitingorders,deposit with the City Collector a bond for the sum of Five Hundre
'r Dollars ($500.00) to be approved by the. City Collector conditioned that all of said goods so
ujd-rV�. sold by said solicitor shall be delivered, and when delivered to the purchaser, shall be as
represented in quality, color, material, and in every other respect.
SECTION TWO:
^d That hereafter all solicitors or salesmen soliciting orders or taking orders for
��c yj any goods, wares, or merchandise in said City and taking a deposit with said order shall, in
addition to giving a bond herein required,pay to the City Collector the sum of $25.00 per
.annum for the privilege of transacting business and collecting said deposits. -Should -any pers
son desire the privilege of soliciting and taking orders and receiving deposits for a shorter
period than one year they shall pay to the City Collector the sum of X15.00 for six months; t
the sum of :10.00 for one month; and the sum of $6.00 for one weak, and shall give the bond
required in.Section One of this Ordinance
STATION THREE:
'6, That all persons buying goods and making a deposit to solicitors' or salesmen
1I shall have the right to sue upon said bond in any court having competent jurisdiction,and sai
bmnd shall be liable for any damage sustained by any person so depositing moneyor giving
orders for any goods,wares, or merchandise from any solicitor or salesman.
SECTION FOUR:
rr" That any person violating the rovisions of this Ordinance shall be fined in
Fy any sum not less than 25.00 nor more than 9200.00, and each day orders are soii.:.�e;a and
0„ deposits received.shall constitute a separate offense under this Ordinance.
SECTION FIVE:
That this Ordinance shall take effect and be in force from and after its passage
approval and publication.
