REGUL-4R IhL:ETING OF THE CITY COUNCIL
HELD JUNE 16TH9 1924.
Present, Mayor Wilson, Clerk, Aldermen Drake, Harding, Jackson, Mintun and Phillips; Absent
Alderman Price.
A number of Citizens being present, the Regular Order of Business was suspended,and the
Council was addressed by Rev. h4.L.Gillespie, Dr. Otey Miller, E.L.Nettleship and J.F.Moore
in opposition of a reported project for the erection of a Lumber Yard on ':lest Dickson Street
near the Central Presbyterian Church.
Following a discussion of the matter,a motion was passed which in its amended form reads
as follows; -"That the matter be reffrred to the City Attorney for consideration of its legal
features,and that he with the City Engineer be directed to prepare a zoning Ordinance,which
shall provide among other things th-t certain industries shall be localized,and particularly
that Churches, Schoolsand Hospitals as now located shall be protected by prohibiting the
location of Lumber Yards, Poultry Houses, Garages &c within a certain definite distance;and tH_
that the City Clerk be directed to give public notice that such an Ordinance will be present-
ed for the consideration of the Council.
At this time the minutes of the previous meethng were read and approved.
Bills against the City were presented as follows, and on motion were refered to the Audit-
ing Committee;-

The weekly report of the Street Commissioner was read and ordered filed.

The pay -roll of the Street Laborers was ordered paid and the Clerk was directed to issue
warrants for the same as follows;

>lderman Harding moved that the Street Committee be authorized and directed to purchase a
dump cart and a set of harness,and to employ a mt:n with a horse to work in connection with the
Street Cleaning force,and to see to the direction aad supervision of his work. Alderman Iefintun
seconded this motion,which received the following vote;- Ayes Aldermen Drake, Harding, Jackson,
Iiintun, Phillips; Nays, none; Absent and not voting Alderman Price,an d declared passed by the Ma
mayor.
A number of appeals from the assessments in !lest Meadow Street Improvemment District Number
One were presented and filed with the Clerk;which being read to the Council, Alderman Phillips
moved that June 23rd,1924 be set as the date for a hearing on the same; and also on the appeals
from the assessments in South College Avenue Improvement District. This motion was seconded b;,
Alderman ISintun and received the following vote; Ayes Alderman Drake, Harding, Jackson, Mintun,
Phillips; Nays, none; Absent and not vojing Alderman Price,and declared passed by the Mayor
Alderman Phillips moved that the Clerk be directed to notify the ',later Plant superintendent
that the work of Paving School Avenue will be undertaken at an early date,and to request that
he and the Crater Commissioners confer with the Commissioners of the District with ref nee to th
placing of water mains and sewer lines. 7
No further business appearing, the Council adjourned.

vote of the members present the report of the Street Commissioner was ordered received and

Present;- the Clerk, Aldermen Drake, Airding,Jackson, Mintun, Phillips Price.
In the absence of the Mayor the Clerk called the Council to oitder,and on motion by Alder
man Price, Alderman Phillips was elected Chairman Pro tem.
The minutes of the,previous meeting were read and approved.
The report of the Street Comr. for the week ending June 28th was read and on motion was
ordered filed.
On motion by Alderman Harding, seconded by Alderman 11intun the payroll of the Street
laborers was ordered paid and the Clerk was directed to issue warrants for the same as
follows; -Charles Wilcox; ;18.00; Ed Malone, w18.00; For hauling gravel $13.20,paid to Frank
Williams for disbursement;T.N.l7ebster, 010.10
The following bills 2,Vainst the City were approved and on motion by Alderman Price,sec-
ended by Alderman Harding and carried by the unanimous vote of the Council the Clerk was dir
directed to is:D-ue warrants for the same; -
Fayetteville Printing Co. for transcript blanks, 015.00; Mrs Grace B. McIntosh, for express
on tags, 07.35.
At the request of Mr J.B.Clark for. sidewalk grade, the City Engineer was directed to
make the grade as requested along the front of Lots6,7,8,9 in Block 9 Ferguson Addition.
On motion duly put and carried a permit to drive an Auto was granted to Liiss Mary Franci '
Harding, subject to the approval of the Chief of Police.
Alderman Harding introduced an Ordinance which was read the first time,whereupon Alderman
Price moved that the Rules be suspended and the Ordinance placed on its second reading.Alder-
.an Mintun seconded the motion which received the folloeing vote; Ayes aldermen Drake, Hardin
Jackson, Mintun, Phillips Price;Nays none Absent and not voting None,and was declared passed
by the Chairman Proptem. Alderman Price then moved that'the Rules be further suspended and
the Ordimance placed on its third reading and final passage. This motion was seconded by Alde
erman Mintun,and received the following vote; Ayes, Aldermen Drake, Harding, Jackson, Pr?intun.
Phillips and Price; Nays none; Absent and not voting, none; and declared passed by the Chair-
man pro tem. The vote on the passage of the Ordinance was then called for and was as follb.r+s;

BE IT ORD INED BY THE CITY COUNCIL OF TIE CITY OF FAYETT'EVILLE,AR.KA.NSAS:
' SECTION ONE:That hereafter it :hall be unlawful for any person to establish, maintain,
1 operate or construct,or be4interested in the establiahing,maintaining, operating, or construe,
Ning of any canning factory, steam laundry, poultry house,livery barn, lumber yard,planing mil
vev 2/0 machine shop,blacksmith shop, public garage, filling station or any other noisy or offensive ,
avocation within 300 feet of any church house public school house, or hospital within the Cit
of Fayetteville, Arkansas,except such businesses as may now be established and in operation

SECTION TWO: That hereafter all business houses that are built or constructed within 300

violated shall be a separate offense under this ordinance.
