HomeMy WebLinkAbout1924-03-31 Minutes83 Mr London appeared before the Council in reference to side -walks and Fire Hydrants being install- ed on east•Spring Street; On motion made by Aldo Mintun,seconded by Aldo Price and passed by the unanimous vote of the Council and so declared by the Mayor, the Clerk was directed to issue the necessary notifications to property owners on both sides of Fast Spring Fitreet from Colege Ave- nue to South Willow Street to construct side -walks in front of properties abutting on East Spring Street . The City Engineer was directed by the Mayor to furnish the Clerk with the names of prop- erty owners on East Spring street effected by the above action of the Council. Dean G.111. Droke appeared before the Council in reference to aid from the City to Hill Avenue Improvement District Number One. Attest: WV No further business appearing the Council adjourned at 9:I5 P. Present: The Ma.yor,Clerk,Aldermen Price, Harding,Jackson,Phillips,Stephens,Mintun. Absent : None. On motion made by Ald. Price,seconded by Ald.Phillips and carried by the unanimous vote of the Council,the reading od the minutes of the preceeding meeting was deferred until the next meeting of the Couz)cil. The following bills against the City were returned to the Council approved by the Aud- iting Committee,and on motion made by Aldo Harding,seconded by Aldo Stephens and catried by the unanimous vette of the Council said bills were allowed and the Clerk was directed to issue warrants to cover same as follows: John Zillah, 6I.25; Chas. Winkelman, I6.69; Hill City Lumb, I.50; J.M. Schelly 8.00 The Report of the Street Commissioner for the week ending March 29,I924 was submitted to the Council,and on motion made by Aldo Harding',seconded by Aldo Price,and carried by the unanimous . vote of the Council,said Report was received,filed,and the Clerk directed to issue warrants to cover cbst of labor shown by said Report as follow s: Dillard Quarles, I5.00; Claude Boyd, I2.50; Ed. Wilcox, 12.50; Charlie Wilcox, I8.00; Floyd Meadows, 8.00; Doc Taylor, I0.00; Edgar Williams, 8.75. ' The Mayor made a statement.to the Council in reference to the condition of the paved streets of the City,and on motion made by Aldo Price,seconded by A1d.Mintun,and carried by the unanimous vote of the Council,the Mayor was authorized to employ an extra man to help with the cleaning of the paved streets,said helper to be employed during the pleasure of the Council. The Mayor stated that this was the date for the hearing as to the sufficiency of the 2d. Peti- tion of West Spring Street Improvement District Number One of the City of Fayetteville; on motion made by Aldo Phillips,seconded •by Aldo Price and carried by the following vote; Ayes, Aldermen P-rice,Harding,Jackson,Phillips,Stephens,Mintun, Nayes; None,and so declared by the Idayor,action on this hearing was postponed until April, 7,I924 at 7:30 P. M. Mr A. M.•Byrnes.submitted a bill for 750.00 for rent of the City Wagon Yard for the year ending IvTarc4 3I.1925, and on motion made by Aldo Price,seconded by Aldo Harding,and carried by the unanimous vote of the Council,this bill was allowed and the Clerk was directed to issue a warrant drawn on the General Fund to Mr. Byrnes for 750.00. Ordinance No. 508 was introduced and read for the first time;whereupon Aldo Phillips moved that the Rules be suspended and the Ordinance be placed upon its second reading; this motion was seconded by Ald.Jackson,and the vote thereon was as follows: Ayes, Aldermen Price,Harding,Jack- son,Phillips,Stephens,Mintun, Nayes; None. And so declared by the Ma yor. Aldo Phillips then moved that the Rules be further suspended and the Ordinance be placed upon its third reading and .final passage; this motion was seconded by Ald.Jackson and the vote thereon was as follows; Ayes, Aldermen Price,Harding,Jackson,Phillips,Stephens.Mintun, Nayes None,and so declared by the Mayor. The Mayor then called for the vote on the passage of the Ordinance which was: Ayes; Aldermen Price, Harding,Jackson,Phillips,Stephens,blintun,. AN ORDINAIlCE TO BE ENTITLED" AN ORDINANCE APPROPRIATING THE SUM OF 5,500.00 OUT OF TIM GENERAL REVENUES OF THE CITY TD D.OVERiTHELCOST OF PAVING AND OTHERWISE IMPROVING THE NORTH ONE HALF OF WEST.DICKSON STREET: WHEREA6,'The city 9ouncil of the City of Fayetteville,Arkansas,did,on.the:I4th day of January,I924,adopt the following Resolution: "WHEREAS,.the property owners on West Dickson Street from the. East line of Duncan Street to the East line of Garland Avenue have filed with the City Council of the City of Fay- etteville,Arkansas,a petition purporting to represent a majority in value of the property own- ers in the territory described and set forth in said petition and said petition being for the purpose of forming an Improvement District to be known as Annex Number One to University Improve ment District Number One of the City of Fayetteville,Arkansas,and; "WHEREAS, The County Quorum Court of Washington County,Arkansas,at the October term of said court,I923,passed a Resolution appropriating a sum not to exceed $ 309000.00 for the pur-. pose of paying one-half the cost of1paving in University Improvement District Number One of the City of Fayetteville,Arkansas,and; Whereas, The property owners on Dickson Street other than those embraced in Umiversity Improvemennjr District Number One have formed Annex Number One to University Improvement District Number One, and; 894 "WHEREAS, It becomes necessary at this time in order that the said Annex Number One of University Improvement District, Number One of the City ,Of Fayetteville,Arkansas,may proceed,for the City of Fayetteville,Arkansas to make some provusion for the paving of -,.the North side of. said West Dickson Street which is adjacent th the grounds of the University of Arkansas, and there be- ing no arrangements at this time by which said Street can.be improved; " THER F ORE,BE IT=RESOLVED BY TIE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: "SECTION ONE: That the City Council of the City of Fayetteville,Arkansas,agreed and oblig gates itself to make tile necessary arrangements to provide the necessary.funds to cover the cost of paving the North half of West Dickson Street from the East line of Duncan Street to the East line of Garland Avenue as designted and in accordance with the plans and specifications as adopt- ed by the Board of Improvement of the said Annex Number One to University Improvememt District Number One of the•City.of Fayetteville,Arkansas "SECTION TWO: That the said obligation as set forth in Section One shall not exceed the sum of 59500.00: And; WEEHREAS, The City Engineer's estimate of the cost of one-half of the said improvement e- euals or exceeds the sum to be paid by the City of Fayetteville; THEREFORE,BE IT ORDAINED BY TIE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION ONE: That pursuant to said Resolution and agreement contained therein,the Mayor and the City Clark of the City of Fayetteville,Arkansas,are directed to issue warrants drawn on the General Fund of the City of Fayetteville,Arkansas,payable to the contractor or bearer,and delive ered to the contractor on the order -of the Commissioners for the purpose aforesaid,of improving the North one-half of West Dickson Street in Annex Number One to University Improvement District Number One of the City of Fayetteville,Arkansas, warrants sufficient to pay one-half of -the cost of the proposed improvememt,not to exceed the sum of 5,500.00 upon the terms and conditions as follows: One warrant for I,IOO.00,due and payable July Ist. 1924, and one-fourth of the bal- ance to be paid in annual installments on the Ist day of each July thereafter for four years. In case of default in payment of any annual installment of the contract at maturity, then ,in that event such defaulted installment// shall draw interest at the rate of eight(8) per cent per annum from maturity until paid, as a penalty for failure to pay said installment when due. SECTION TWO: That all Ordinances in conflict herewith are-herell repealed,and this Ordinance shall be in force and effect from and after its passage,approval and publication. Present: The Mayor,Clerk,Aldermen Price,Harding,Jackson,Phillips,Stephens.Yiiintun. Absent : None. The minutes of the two preceeding meetings were read and approved. The Clerk submitted to the Council trial balance and reconciliation of bank accounts of the City's accounts for the month of March. The Street Commissioner submitted to the Council,his Report for.the week ending,April 5,. I924,and on motion made by Ald. Price,seconded by A1d.Jackson and carried by the unanimous vote of the Council,said Report was received and filed and the Clerk was directed to issue warrants to cover labor and materials.as shown by said Report as follows: Charlie Wilcox, I5,00; Doc Taylor, N II.25; Floyd Meadows, 8.75; Dillard Quarles, .5.00; Kenneth Hooper,,29.50; Eck Malone J9.5-6 The Police Judge and the City Collector submitted their Reports for the Month of March and on motion made by Ald. Price,seconded by Ald. Mintun and carried by the unanikous vote of the Council, said Reports were referred to the Auditing Committee. The following bills against the City for the month of March were submitted to the Council and on motion made by Ald. Price,seconded by Ald.
