Absent : Aldermen Price and Stephens.
The minutes of the two preceeding meetings of the Council were read.and approved..
The Auditing Committee returned to the Council the'Reports of the Police Judge and of the City
Collector and the following bills,against the City approved by said Committee

On motion made.by Aldo Jackson,seconded by Aldo Harding and passed by the unanimous vote of the
Council,the above bills were allowed and the Clerk directed to`isbue warrants for the same.
The Street Commissioner submitted his reports for the two weeks ending Feb. I6,I924.,and on mo-
tion made by Ald. Phillips,seconded by Aldo Jackson and carried by the unanimous vote of the Coun-
cil,said reports were filed and the Clerk directed to issue warrants as follows to cover labor and
material shown by said reports: '

Henry Barton, 47 loads Gravel:, $ II.75.
The following bills were submitted to the Council,and on motion made by Aldo Harding,seconded by
A1d.Jackson and passed by the unanimous vote of the Council,said bills were referred to the Audit-
ing Committee.

A communication from Oliver Lollar in reference to the grade on Rock Street,east of South Col-
lege Avenue was read to the Council and on motion made by Aldo Harding,seconded by Ald.Jackson,
and carried by the unanimous vote of the Council,the City Engineer was directed to furnish the grade
on Rock Street to Mr. Lollar,and the Council authorized Mt. Lollar'to make'the fill -on Rock Street,
without expense to the City,under the directions of the City Engineer.
Frambers and SwoffOrd ,Fort Smith ,Arkansas ,submitted their Report of the recent audit'of the
accounts of the City Coilector,the City Clerk,and the City Treasurer for the yeaze I922 and I923,
together with their account for this audit amounting to $ 380.00; on motion made by Aldo Harding,
seconded -by Aldo Phillips and carried by the unanimous vote of the Council,and so'declared by the.
Mayor,the said Report was received and filed and the Clerk was directed to -issue a warrant to Fram- ,
bdrs and Swofford for $ 380.00 from the General Fund.
Upon the request -of Supt.o£ City Schools,the Chairman of the Light Committee was directed
by the Council to install a light in -front of the High School Building,
The Report of the Board of Public Affairs in reference to letting the contract for the pur-
chase of twelve waterproof suits for the City Fireman,was submitted to the Council,and on motion
made by Aldo Harding,seconded by Aldo Phillips, and carried by the unanimous vote of the Council
the Report was received and filed.
The following Resolution was introduced by Ald.Harding,who moved its adoption;this motion
was seconded b;, Aldo Mintun,and the vote thereon was as follows: Ayes, Aldermen Harding,Jackson,
Phillips,Mintun, Hayes; None.' The Mayor then declared the Resolution adopted and a copy of said
Resolution is as follows:

layin and operating a 6 inch pipe line under the right of way of said Railway Company at Mile
Post f 352.I8,is hereby authorized confirmed and approved by the City Council of the City of

�Aldo Phillips moved that the Rules be suspended and the Ordinance be placed upon its second read
ing,tthis motion was seconded by Aldo Jackson and the vote thereon was as follows; Ayes, Aldermen
Harding,Jackson,Phillips,Mintun,Nayes; None,and so declared by the Mayor. Alderman Jackson then
moved that the Rules be further suspended and the Ordinance be placed upon its_third reading and

IMPROVEM NT OF THE INTERSECTION�r OF CERTAIN STREETS WITHIN THE CITY OF FAYETTEVILLE,ARKANSAS,
AND FOR OTHER PURPOSES."

WHEREAS, THERE HAS BEEN FORMED AND CREATED WITHIN THE. CORPORATE LIMITS of the City of
Fayetteville,Arkansas,a certain improvement District known as Annex Number One to Mont Nord Im- :
provement District Number One of the City of Fayetteville,Arkansas;
F7HEREAS, it is the policy of the City of Fayetteville,10 aid in constructing and main-
taining permanent streets,constructed under the improvement district plan;and
WHEREAS, the City of Fayetteville has assumed part•of the expense of improving streets
in other -Improvement districts;
NOW,TH,R�EFORE;BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:
SECTION ONE: That there is hereby appropriated out of the General Fund of the City of'Faye

etteville,Arkansas,the sum of Three Thousand($ 3000.00) Dollars,to be.used by the Board of Comm
missioners of Annex Number One to Mont Nord Improvement District Number One of the City of Fay-
et'teville,Arkansas,in permanently paving the intersections of all streets within said Improve-
ment District,and otherwise permanently improving the same.
SECTION TWO:: That the City Clerk of the City of Fayetteville,Arkansas,be,and he is hereby,ine
structed to draw five warrants of equal amounts,in favor of whomsoever said Board of Commissione
ers may designate,and at such times.as said Board may request,not to exceed in the aggregate,how-
ever,the sum of Three Thousand ($3000.00) Dollars. Said five warrants shall be drawn serially,
so that one warrant shall become'due and payable each year after date of issue.
SECTION THREE: that this Ordinance shall take effect and be•ih force•from and after its pass-
age,approval,and publication.

Mr. Hosea Williams appear d befoxe the Council in reference to the condition of the cross-
ing at the north end of Gregg,,Street. On motion made by Aldo J•ackson,seconded by Aldo Phillips,
and carried by the unanimous vote of the Council the Street Commissioner was directed to inspect
this street and make a report thereon at the next meeting of the Council.
Mr. W.M.Brown submitted a?application to extend his building on Meadow Street;and on motion
made by Aldo Phillips,seconded by Ald.Harding and carried by the -unanimous vote of the Council
' this application was granted.
Major B.F.Davidson appeared -before the Council.in reference to the
City constructing two culverts on Walnut Street and one culvert on Rebecca Avenue;and also in ref-
erence to the drainage conditions on Davidson Avenue;on motion made by Aldo Phillips,seconded by
Aldo Mintun and carried by the unanimous vote of the Councul,the City Engineer was instructed to
investigate the matters referred to by Major Davidson and to make a report on same at the next
meeting of the Council.
'Mr Bruce'Holcomb appeared before the Council and requested that the Coune
oil order side -walks constructed on all property on Highland Avenue from West Maple. Street to La
Fayette Avenue, On motion made by Aldo Harding,seconded by Aldo Jackson and carried by the fol-
lowing vote; Ayes, Aldermen Harding,Jackson,Phillips,Mintun, Nayes; None;and s'o declared by the
Mayor, the City Engineer was directed to establish the grade on Highland Avenue from West Maple
Strebt to La Fayette Avenue,and_the Clerk was directed to issue the necessary notices to prop-
erty owners affected.
The following Resolution was introduced by Ald.Harding,who moved its adoption;1�
this motion was seconded by Aldo Phillips,and the vote thereon was as follows; Ayes, Aldermen Har-

Washington County,Arkansas;and that persons signing said Petition own real property within said
District of the assessed valuation of I8,400.00,according to said assessment.
SECTION TWO:That it is'the finding of said City Council of said City of Fayetteville,Arkansas,
-that the majority in assessed valuation of owners of real property within Annex Number One to
West LaFayette Avenue Improvement District Number One of the City of. Fayetteville,Arkansas,have
signed said Petition;and that said District isohereby formed b,* said City Council of Fayetteville,
Arkansas.

said City of Fayetteville,Arkansas,has been guided by the certificate of the Circuit Clerk of said

sary material for the repair and construction as herein set forth on said streets,and at said in-
tersections of streets as herein mentioned,said improvements to be according to the plans and spec-
ifications on file in the office of the City Engineer of the City of Fayetteville,Arkansas. The
City of Fayetteville,agrees to pay said. Company for the same as follows:

If the City of Fayetteville makes default in the payment of any one of said sums when the same
becomes'due and payable,the City of Fayetteville agrees and stipulates with the owner of the war-
rant,representing the amount of the sum in which the City has defaulted in the payment of,to pay
said owner of said warrant the sum of eight per cent interest per annum on said amount of said
warrant from the date of such default,until the said sum is fully paid,as an agreed and stipulat
ted penalty and as damages for failure to perform its part of its contract with said Moreno -Burk -
ham Construction Company,a corporation,or the owner of said warrant.
SECTION FIVE: This contract shall be binding upon the City of Fayetteville,Arkansas,from
and after the passage,approval and publication of this Ordinance,and the acceptance of the same
by the said BorenolBurkham Construction Company,a corporation,on its part.
The City of Fayetteville,Arkanssks,hereby pledge itself ,and all of its officers,
to the faithful performance of this contract ^herein set forth in this Ordinance,upon the full

WHEREAS, the majority in value of the property holders owning property adjoining the local-
ity to be effected,and situated in University Improvement District Number One of the City of Fay-
etteville,Arkansas,organized for the purpose of improving by grading,rolling and paving with As-
phaltic Concrete Pavement,the streets and parts of streets within said University Improvement Dis-
trict Number One of the City of Fayetteville,Arkansas,have petitioned the City Council of the City
of Fayetteville,Arkansas,for the construction of said improvement; and that the costs thereof
shall be assessed upon the real property of said District,according to the benefits to be receiv-
ed; and
WHEREAS, said benefits received by each block,lot and parcel of real property situated in

WHEREAS, the majority in value of the owners of real property on West Liaple Street from
the East line of Arkansas Avenue to the East Line of Vandeventer Avenue, North West Avenue
from the North line of West La Fayette Avenue to the South line of `Jest Maple Street,and Van-
deventer Avenue from the North line of West La Fayette Avenue to the South ,line of West Ma-
ple Street,have petitioned the City Council of the City of Fayetteville,Arkansas,to annex the
same to West La Fayette Avenue Improvement District Number One of the City of Fayetteville,
Arkansas,and due notice has been given of the filing of said Petition;and that the.same would
be heard on the 4th day of February,I924;

said Petition,to determine whether those signing the same constituted a majority in value of -the
owners of real property sought to be annexed,it was decided by the City Council of said City of
Fayetteville to continue said hearing until February II,I924;
WHEREAS, on said IIth day of February,I924,it was decided by the City Council of said City
of Fayetteville to further continue said hearing until February I8,I924,at 7:30 P.M.;and
WHEREAS,on said I8th day -o8 February,I924,the time so fixed by said City Council of said
City of Fayetteville for the hearing of said Petition,to determine whether those signing.the
same constituted a majority in value of the owners of real property sought.to be annexed,after
hearing all persons who desired to be heard,as to whether said Petition contained the signatures
of such majority,the said City Council of said City of Fayetteville,Arkansas,did ascertain and X
declare that said Petition did contain the signatures of a majority of the owners of real proper-
ty'within said territory,according to the last preceeding assessment for State and County taxes
in the said territory,and as shown by the records of deeds and by actual ownership; and that
said Petition is in due form, and as required by law.

The minutes of the preceeding meeting were read and approved.
The Report of the Street Commissioner for the week ending Feb. 23,I924 was submitted to
the Council,and on motion made by Aldo Jackson,seconded by Aldo Phillips and,carried by the unan-
imous vote of the Council,said Report was received and filed and the Clerk was directed to issue
warrants to cover labor and materials,as shown by said Report as follows:
Charlie Wilcox, I2.00; Ed. Wilcox, 2.50; Henry Barton II.25; Hooper, 2,.00
The following Bills against the City were returned to the Council by the Auditing Committe with
its approval; and on motion made•by Ald. Jackson,seconded by Aldo Phillips and carried by the.u-
nanimou8 vote of the CDuncil,said bills were approved and the Clerk was.directed to issue warrants
to cover same as follows:

A communication from G.A.'London in reference to installing firyhydrant at�c9r r, to Singy

Willow Spring and also in regard to'sewer connections on East Spring Street, .On motion made by
Aldo Phillips,seconded by Aldo Jackson and carried by the unanimous vote of the Council,the Mayor ,
appointed the following Committee to investigate the matters referred to in Mr. London's communi-
cation: Aldermen Jackson;Harding and Phillips.
The following applications to errect buildings w re submitted to the Council,and on motion
made by Aldo Harding,seconded by Aldo Mintun and carrieKby the unanimous vote of the Council,these
applications were approved,subject to the inspection and approval of the City Engineer:
Litteral Canning Co.,Factory Building; Bryan -Tuck Motor Co.,Store Bld.
On motion made by Aldo Harding,seconded by A1d.Mintun,and carried by the unanimous vote of -the
Council,the City Engineer was instructed to establish the grade for a sidewalk to be constructed '
on the -Bouth side of the Ozark Theater Bld. by Mr.J.M.Williams.
Mr. J.M.Williams and Mr.H.E.Cravens appeared before the Council in reference to the payment by
the City of a part of the cost of the intersection of East Center and College Avenue;and:on motion
made by Aldo Mintun,seconded by Aldo Harding and carried b the unanimous vote 'of the Ca ncil,and
so declared by the Mayor,the City appropriated the sum of 299.25,said sum being one-half of the
estimated cost of paving the intersection of College Avenue and East Center Street,to be paid the
Commissioners of East Center Street Improvement'Distriet Number One of the City of Fayetteville,
Arkansas upon the completion of said intersection;and the Clerk was instructed to issue a warrant
drawn on the Street Fund of the City of Fayetteville for said sum of 0299.25 to the order of said
Commissioners upon the completion of the construction work of said intersection.
On motion made by Aldo Harding,seconded by Aldo Mintun and carried by the unanimous vote of
the Council,permission was granted the property owners on East Center Street to install eight
"White Way" -Street lights on East Center Street and the City Council obligated the City to bear.
the expense of lighting six of said lights -said lights to be of the same candle power as those
now maintained by the City on Dickson Street.
On motion made by A1d..Harding,seconded by A1d.Jackson,and carried by the unanimous vote of
the Council,the Clerk was directed to issue warrant to J.,S.Bates for the sum of $ 234.38,same be-
ing the second warrant of a series of two warrants to be issued to Mr.Bates as shown by these rec-
