Absent Alderman Price. The minutes of the preceeding meeting were read and approved. The Street Commissioner submitted his Report for the week ending December 15,I923,and on motion made by Ald. Jackson,seconded by Ald.Harding the said report was received and filed and the Clerk was directed to issue warrants to cover labor shown on said Report as follow: Edgar Williams, a 2.50; Schooler Steward, , 5.50; Walton Sexton, 8.00 Charlie Wilcox, I0.50 'Total 25.50. This motion was carried by the unanimous vote of the Council. The following bills against the City were submitted to the Council,and on motion made by Ald. Harding ,seconded by Ald. Jackson and carried by the unanimous vote of.the Council, said bills were referred to the Auditing Committee: Security Idotor Co., .50; Electric Service Co.; 5.I5; Ozark Gro. Co. 3.50; I7.F.Stirman, 28.I9; Fayetteville Coal Co. 22.00 'The protests to the reassessment of benefits in Willow Avenue Improvement District Number One of the City of Fayetteville,Arkansas of Georgia Norman,F.C.Harding,Augusta Lollar,and Geo.E.Bryant were read to the Council,and on motion made by Ald. Phillips,seconded by A1d.Mintun and carried by the following vote;Ayes, Aldermen Harding,Jackson,Phillips,Simpson,IvIintun, Nayes None,and so declared by the Mayor,the Council went into executive session to consider these protest. The'protest of Augusta Lollar was first considered and on motion made by A1d.Phillips,sec6nded Ll� by Ald. Jackson and carried by the fibllowing vote,. Ayes, Aldermen, Harding,Jackson,Phillips,Steph- ens, Mintun and .so declared by the Idayor,the assessments of benefits on the property of Augusta Lollar was reduced from 450.00 to .,p 350.00. The protest of Geo.E.Brgant was next considered and on motion made by A1d.Jackson,seconded by Ald. Mintun and carried by the following vote, Ayes; Aldermen Harding,Jackson,Phillips,Stephens, Mintun, Nayes, None ,and so declared by the Mayor this protest of Geo. E.Bryant was considered unfavorably. The protest of Georgia Norman was next considered by the Council,and on motion made by Ald. Har-�L� ding,seconded by Ald. Mintun and passed by the following vote, Ayes;Aldermen Hardirig,Jackson,Phil- lips,Stephens,rAiintun , Nayes; None,and so declared by the Mayor, the assessment of benefits on the property of Georgia Norman was reduced from $ 688.50 to $ 588.50. The protest of F.E.Harding was next considered by the Council,and on motion made by A1d..Phillips,i/ seconded by Ald. Jackson and carried by the following Vute of the Council, Ayes; Aldermen Harding, ' Jackson,Phillips,Stephens.14intun, Nayes, None,and so declared by the Mayor, the assessment of benefits on the property of F.M.Harding was redmced from 7I8.50 to 5? 580.00 On motion made by Ald. Harding,seconded by Ald. Mintun and carried by the following vote of the Council,the Clerk was directed to inform the Board of Assessors of Willow Avenue Improvement Dis- trict Number One of the City of Fayetteville,Arkansas of the Above action of the Council in ref- erence to'the above named protests. A communication from the:Chief of Fire Department relative to placing Fire Hydrants was }� read to the Council,and.on motion made by Ald. Phillips seconded by Ald. Jackson and carried by the unanimous vote of the Council,this communication was referred to the Fire Committee with J power to act. Ivtr.J.H.Mc.Ilroy,by the City Clerk,submitted to the Council.the Original Petition of Annex Number One of University Improvement District Number One of the City of Fayetteville,Arkansas, and on motion made.by A1d.Phillips,seconded by Ald. Jackgg4 and carried by the following vote of the Council:tAyes,i Aldermen Harding,Jackson,Phillips ,lvvIintun, Nayes, None,and so declared by the Mayor,the said Petition was received and filed. The Superintendent of the City Hospital submitted Report of Hospital for the month of December,I923,and on motion made by Ald-.Jackson,seconded by Ald.Harding and passed by the unan- imous vote of the Council,the said Report was received and filed'. The City Health Officer submitted his annual Report to the Council,and on.motion made by Ald. Harding,seconded by A1d.Mintun and passed by the unanimous vote of the Council,the said Report was received and filed and a vote of thanks was tendered Dr. Gregg by the City Council for his most excellent report of his efficient services for the City, and the Clerk was direct- ed to have said Report published in the Daily Democrat. Whereas,at a meeting of the City Council of the City of Fayetteville,Arkansas,held on the I7th day of December,I923,there was presented to said Council,by H:C.Evins,A.M.Harding,and J.S. The following Ordinance was introduced and read for the first time; on motion made by Aldo Jackson,seconded by A1d.Mintun and carried by the following vote: Ayes,Aldermen Harding, Jackson,Fhillips,Stephens,Mintun, Nayes; None and so declared by the Mayor,the Rules were susge pended and the Ordinance placed upon its second reading. Aldo Jackson then moved that the Ruffies be further suspended and the Ordinance be placed upon its third reading and final passage;this motion was seconded by Ald.Mintun and the vote thereon was: Ayes, Aldermen Harding,Jackson,Phil- lips,Stephens,Mintun, Nayes; None,and so declared by the Mayor. The Mayor then called for the vote on the passage of the Ordinance which was: Ayes, Aldermen Harding,Jackson,Phillips,Steph- ens,Ilintun, Nayes; None; the Mayor then declared the Ordinance passed and a copy of same is as follows: ORDINANCE N0.495. AN ORDINANCE TO BE ENTITLED; AN ORDINANCE FOR THE PERMANENT IMPROVE9. MENT OF THE INTERSECTION OF CERTAIN STREETS WITHIN THE CITY OF FAYETTEVILLE,ARKANSAS,AND FOR OTHER PURPOSES." WHEREAS, there has been formed and created within the corporate limits of the City ' of Fayetteville,Arkansas,a certain Improvement District,known as North College Avenue Improvement District Number One of the City of Fayetteville,Arkansas;and WHEREAS, it is the policy of the City of Fayetteville,to aid in constructing and maintaining permanent streets constructed under the improvement district plan;and WHEREAS,the City of Fayetteville has assumed part of the expense of improving streets in other improvement districts; NOWT THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION ONE: That there is hereby appropriated out of the General Fund of the City Of Fay- etteville,Arkansas,the sum 'of 7,500.00,to be used by the Board of Commissioners of North College Avenue Improvement District Number One of the City of Fayetteville,Arkansas,in permantly paving the intersections of all streets within said Improvement District,and otherwise permanently improv- ing the same. SECTION TWO: That the City Clerk of the City of Fayetteville,Arkansas,be,and he is hereby „i instructed to draw ten warrants of equal amounts ,in favor.of whomsoever said Board of Cgmmission- ers may designate ,and at such, time as said Board may request,not to exceed in the aggregate,how- ever,the sum of $ 7,500.00. Said ten warrants shall be drawn serially,so that one warrant shall become due and payable each year after datemofoissue. Mr. W.N.Hudson of Rosehill Addition presented a Petition to the Council with reference to the condition of the water,sewer,and streets in said Addition;and on motion made by Aldo Harding seconded by A1d.Stephens and carried by the unanimous vote of the Council,so much of this peti tion as referred to the sewer and water conditions was referred to the Water and Sewer Commiss ioners,and so much as referred to the streets was referred to the Committee on Streets. The Street Commissioner submitted his Report for the two weeks ending December 29th.,I923, and on motion made by Aldo Harding,seconded by Aldo Price and passed by the unanimous vote of the Council the Report was received and the Clerk was directed to issue warrants to cover la- bor shown by said Report as follows: Walton Sexton,with team 72 days, qP 42.50; S.S.Stephens, 3�2- days, II.42 Charlie Wilcox,IO da, 3 hr. 3I.00; Schooler Steward,I da. 2.75 Edgar Williams, I da. 2.50. The following bills against the City were submitted to the Council and on motion made by Aldo Price,seconded by Aldo Phillips and carried by the unanimous vote of the Council,the same were allowed and the Clerk directed to issue warrants to cover same as follows: I Wages Bros, 25.4I; Red Ball Transfer Co. 2.48; S.H.Guinn, I8.00s C.F.Armistead, I.95; Chas Winkleman, I.68. Tropical Paint and Oil Co. 46.95 A betition from property owners ,requesting that a light be installed at Whitham and Taylor Streets ,was submitted to the Council and on motion made by Aldo Phillips,seconded by Aldo Jacks6n and carried by the unanimous vote of the Council said petition was referred to the Light Committee with power to act. A communication from the Fa$etteville Coal Company,relative to the use of chains on truck delivering coal over paved streets,was read to the Council,and the Mayor directed the Clerk to look up the Ordinance on this subject and reply to this communica5ion in the name of the Council. The following applications to errect buildings were submitted to the Council and on motion made by Aldo Price,seconded by Aldo Harding and carried by the unanimous vote of the Council,permission was granted to errect these building subject to the inspection and approval of the City Engineer: F.M.Bilyeu, III SouthDuncan,Residence;R.L.Fulton.South Block ,Residence; Marcus Hulse,Lot 4,Block 5, Residence; C.T.Harding,Lot 2,B1k.7,Residence. On motion made by A1d.Jackson,seconded by Ald.Phillips and carried by the unanimous vote of the Council,the Clerk was directed to call to the attention of the Commissioners of West La Fa yette Avenue Improvement Dist rict Number One ,the condition of the approach to the bridge over R.R.cut on La Fayetteil Street,and to request said Commissioners to repair said approach. On motion made by Aldo Harding,seconded by Ald.Jackson and cs.rried by the unanimous vote of the Council,the Clerk was directed to call the attention of the Commissioners of West La Fayette Improvement District Number One and of Mont Nord Improvement District Number One to the ' Condition of the intersection of Forrest Avenue and La Fa$ette Avenue, and to inform said Com- missioners that the City would pay one-third the cost of the construction at said street inter- section,if the Commissioners of said two districts would pay for the remaining two-thirds of the cost of said construction. The Reports of the Police Judge and of the City Collector and the bills against the C City were submitted to the Council,and on motion made by Aldo Harding,seconded by Aldo Stephens and carried by the unanimous vote of the Council,said Reports and bills were referred to the Auditing Committee,as follows: Hill City Lumber Co. $ 4.00; Greer Abstract Co., $ 20.00; Goss El,ec.Shop, y I.25;
