Absent : .None. The minutes of the preceeding meeting.were read and approved. The Auditing Committee returned with its approval the Reports of the Police Judge and of ' the City.Collector along with the following bills against the City,and on motion made by A1d.Har- ding,seconded by A1d.Jackson and carried b;, the unanimous vote of the Council,the said Reports 'were filed and the Clerk directed to issue warrants to cover said bills as follows: Lewis Bros. $ I0.05; J.M.Goolsby, $ 2.00; Western Union Tel Co. .65 Fayetteville Dem.IIO.70; Greer Abst.Co. 20..00; W.F.Stirman, 1.60 Heerwagen Bros. 75.40; Goss Elec.Shop, 1.50; J.W.Shelly, I9.00 Adams Flower Shop,I0.00; Fay.Gas&Elec.Cb 347.35; W.L.Crouch, 4.I0 Wages Bros, 2I.99; E.M.Ratliff, 12I.I5; Democrat Pub.Co. 6.75 Greer Abst. Co. 25.00. / A communication from the City Health Officer,in regard to retention of Sanitary Policeman J.W.Shelly.was read to the Council,and on motion made by Aldo Harding,seconded by Aldo Mintun and carried by the unanimous vote of -the Council,the action taken by the Council as shown on page 850 of these records was recinded and the Clerk was directed to continue J.W.Shelly on the month- ly pay roll at a salary of $ 30.00 per month.as of Dec.I,I923. A communication from Mr:H.E.Cravens in reference to lowering of rate of•insurance on build- ing in the City,if•the Council would take certain outlined steps; and upon`•'maie by Aldo Price, seconded by Aldo Mintun and carried by the unanimous vote of the Council,Fire Chief Chas.Winkle- man was placed on the monthly pay roll at a salary of $ 25.00 to be paid from the Fire Fund,the additional duties of said Fire Chief to be set forth in a Resolution to be submitted at the next meeting of the Council. The Street Commissioner submitted his Report for the meek ending,Dec.8,I923, together with bill for labor for sme period;on motion made by Aldo Jackson,seconded by A1d.Phi1- lips and carried by the unanimous vote of the Council,said Report was filed and the Clerk ditect ed to issue warrant as follows to cover labor shown on said Report: Walton Sexton and Team,3 days, I5.00; George Eakor and Team, 3.days, I5.00 Bob Mitchell and Team,22 days, I2.50; Charlie Wilcox, 5?- days, I6.50 Schooler Steward, 3 days, 8.25; Bill Gutherie, 3 days, 7.50 Edgar Williams, 3 days, 7.50; Brownie Phillips,12 days, 3.75. On motion made by Aldo Harding,seconded by Ald.Phillips and carried by the unanimous vote o of the Council permission to drive motor cars was granted to Misses Bonnie Mintun and Ruth Ellis both of whom are under I6 years of age. The Mayor announced that this was the date set to determine whether a majority in assessed valuation of :he property owners of School Avenue Improvement District Number One of the City of Fayetteville,Arkansas had signed the Second Petition for said District;and on motion made by Ald Harding,seconde$,yy;-_A1d.Mintun and carried by the following vote; Ayes, Alderman Price,Harding Jackson,Phillip intun; Nayes, None and so declared by the Mayor,the Mayor appointed the fol- lowing committeento determine whether a majority in assessed valuation of property owners of said District had signed said petition,Aldermen,Phillips,Price and Jackson. The Council then re- cessed,this committee withdrew,and upon the the Council reassembling,the committee submitted its report to the Council in the form of a Resolution which was introduced by A1d.Price,who moved its adoption;this motion was seconded by Ald.Mintun and the vote thereon was as follows: Ayes, Alder- men Price,Harding,Jackson,Phillips,Stephens,Mintun, Nayes; None. The Mayor then declared the Resolution adopted and a copy of same is as follows: y pjj !A-5 'LCI2vj RESOLUTION: ' '/ViZEREAS, on the I7th day of September,I923,a petition,signed by more than ten owners o£ real proper ty,was presented to the City Council of the City of_Fayetteville,Arkansas,requesting that steps be taken to form an Improvement District to,embrac the property therein described and set forth; and WHEREAS,on the I7th day of September,I923,an Ordinance,No.489,was passed,forming the said .District as set forth in the above named petition;and WHEREAS,on the I9th day of November,I923,a petition was presented to the said City Council, signed by persons claiming to constitute a majority in assessed valuation of all real property located within the District as set forth in the Petition and Ordinance aforesaid;and WHEREAS,the said City Council,by a Resolution duly passed oh the I9th day of November,I923, ordered and directed the City Clerk of the City of Fayetteville,Arkansas,to publish a notice, .once a week for two weeks,advising all owners of real property within said School Avenue Improve- ment District Number One of the City of Fayetteville,Arkansas,that on the IOth day of December, 1923,the said City Council would take the last named Petition under consideration,and would,at that time,determine whether or not the same was signed by the majority in. ass �seed valuation o of all real property within said District;and e WHEREAS, said notice was so published,in accordance with the law in such cases made and pro§ vided; NO'+V,THEREFORE.BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF _FAYE'I'T:sVILLE,ARKANSAS , That,after careful consideration,the Council finds that there is::'a- 'otal of assessed.values= tion of 88,850.00 of real property within said District,accord.ing-to the last assessment .on file in the Office of the County Clerk of Washington County,Arkansas;and that persons signing• said Petition own real property within said District of an assessed valuation of^-$ 50,I25eOO,, � 852 according to said assessment. It is,therefo're',the finding of said City Council,that the majority in assessed valuation of owners of real property within School Avenue Improvement District Number One of the City of Fayetteville,Arkansas,have signed said petition;and the said District is hereby duly formed by the City Council of the City of Fayetteville,Arkansas; In the consideration of the said Petition,the Council has been guided by the certificate of the Circuit Clerk of Washington County,Arkansas,as to the ownership of said real property,and. by the certificate of the County Clerk of said County and State,as to the assessed valuation of said real property; Be it further resolved that this Resolution be in force and effect from and aft ter its passage and approval; and that all Resolutions and parts of Resolutions in conflict here- with,be, and the same are hereby repealed. . The Mayor then declared thee0rdinance duly passed and a copy of same is as follows: Ordinance No. 494. , AN ORDINANCE TO BE ENTITLED"AN ORDINANCE TO LEVY THE ASSESSMENT UPON THE. REAL PROPERTY LOCATED WITHIN EAST CENTER STREET IIvIPROVEIVENT DISTRICT NOUMBER ONE OF THE CITY OF FAYETTEVILLE, ARKANSAS". _ WHEREAS,the majority in value of the property holders owning property adjoining the locality to be affected,and situated in East Center Improvement District Number One of the City of Fayetteville,Arkansas,organized for the purpose of improving by grading,rolling,and paving with Asphaltic Pavement,the streets and parts of streets within said East Center Street Improvem ment District Number One of the City of Fayetteville,Arkansas,have petitioned the City Council of the City of Fayetteville.,Arkansas,for the.construction of said improvement;and that the costs thereof shall be assessed -upon the real property of said District,according to the benefits to be received;and WHNREAS,said benefit received by each block,lot and parcel of real property situated in said District,equals or exceeds the local assessment;and WHEREAS,the estimated cost of said improvement,exclusive of interest charges,is the sum of 69628.46; ARKANSAS: NOWtTI=EFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE9 SECTION ONE: That said several blocks,lots,and parcels of real property in said Dis trict be assessed according to the Assessment List for said Improvement District,as the same now in the office of the Recorder or City Clerk;and that IO.per centum on said blocks,lots,and par- cels of real property in said District shall be paid annually on or before the first Monday of October,until the whole of said local assessment shall be paid. SECTION TWO: Thattall Ordinances and parts of Ordinances in conflict herewith be,and the same are hereby repealed,and this Ordinance shall take effect and be in force from and after its passage,approval and publication.
