The Chief of the Fire Dept.,Chas. Winkelman,submitted a Report of his trip to the State
Fire Assn.'s Meeting at Fort Smith,together with a statement of his expenses ;on motion made by
Aldo Jackson,seconded by A1d.Phillips1
this Report was directed to be filed and the Clerk was au-
thorized to issue warrant for 28.40 to cover said expenses. This motion was carried by the un-
animous vote of the Council.
The following applications to errect buildings were submitted to the Council,and on mo-
tion made by Aldo Price,seconded by Aldo Phillips and carried by the unanimous vote of the Coun-
cil these applications were approved subject to the inapection and approval of the City Engineer;.-_-

The Report of the Street Commissioner for the week ending Sept.,29,I923 was submitted to the
Council,and on motion made by Aldo Jackson, seconded by Aldo Stephens and carried by the unanim
mous vote of the Council,said report was directed to be filed and the Clerk authorized to issue
the following warrants to cover labor as shown by Report:
Charlie Wilcox, $ I4.33.
The City Engineer submitted a Report to the Council in reference A o the condition of certain
side walks on Arkansas Avenue and other Streets of the City. On motion made by Aldo Jackson,sec-
onded by Aldo Phillips,and carried by the unanimous vote of the Council,the City Attorney was
directed to draft the necessary Resolutions to require the owners of the property effected by said
Report to install or repair side -walks.
The Annual Reportsof The Commissioners of East Street Imp. Dist. No.I and Annex No.I and of the
Commissioners of Annex No.2 to East Street Imp.Dist. No.I were submitted to the Council,and on mo-
tion made by Aldo Price,seconded by Aldo Jackson and Carried by the unanimous vote of the Council,
these Reports were received and directed to be filed.
An account was submitted to the Council by Moreno-Burkham Const. Co. for $ I755.93
for certain construction work on Annex No. 2 to East Street Imp. Dist. No. I. On Motion made
by Aldo irice,seconded by Ald. Phillips and carried by the following vote; Ayes, Aldermen Price,
Jackson,Phillips,Stephens,idiintun, Nayes; None ,and so declared by the Mayor,this bill was disallowed.
A bill for i� 34.25 for certain repairs and construction of sewer in the Willow Street
Imp. Dist. No. I was submitted to the Council by Moreno-Burkham Const. Co.,and on motion made by
Aldo Price,seconded by Aldo Jackson and carried by the unanimous vote of the Council,this bill was
referred to the Sewer and Water Commission.
.A bill for $ 225.09 for repairs and construction of certain street intersection was
submitted to the Council by Moreno-Burkham Const. Co. On motion made by Aldo Phillips,seconded. by
Aldo Price and carried by the unanimous vote of the Council,Twenty-Five (025.00) Dollars of this
account was allowed and the Clerk was directed to issue warrant to cover this amount of above ac-
cgunt;and the matter of the remaining $ 200.09 was deferred until the next meeting of the Councll.
Dr. Drake appeared before the Council and submitted a proposition for paving intersection
of certain streets adjoining Mont Nord Imp. Dist.No. I.
The City Engineer submitted to the Council a bib from Geo.W.Moore for constructing and
repairing intersection of La Fayette' and Forrest Aves. On motion made by Aldo Phillips,seconded
by Aldo Price and carried by the unanimous vote of the Council ,this bid was referred to the Com-
missioners of La Fayette Avenue Imp. Dist.'No. I.
AIr Ed Malone appeared before the Council in reference to the improvement and opening of
West Third Street. On motion made by Aldo Price,seconded by Aldo Mintun and carried by the U-
nanimous vote of the Council,the Chief of Police was instructed to serve the necessary notices
on the property owners of 'West Third to remove all existing obstructions to said West Street ac-
cording to the line established by the City Engineer.
,At the request of the Council the City Clerk submitted the following statement of balan-
ces in.the various funds of the City as shown by books of the Me Ilroy Banking Co.,as of Sept.,
29,1923: •
Fire Sinking Fund, 2,804.3I; Fire Pe4pion Fund, 837.38; Fire Fund $ I9943.42;
Hospital Fund, 8 36.49; Streey Fund, 696I7.73.

Council,and on motion made by Aldo Harding,seconded by Ald.Jackson and carried by the unanimous
vote of the Council,the Report was directed to be filed and the Clerk was authorized to issue
warrants to cover labor shown by said Report as follows:

The Chairman of the Auditing Committee returned to the Council the Reports of the Police

of the Council these Reports were d'irect'ed to be filed and the Clerk was authorized to issue

A.petition6from certain citizens in reference to the paving and improving of certain
streets of the City was submitted and read to the Council. On motion made by Ald. Price,second-
ed by Ald. Harding and passed by.the following vote: Ayes, Aldermen Price,Harding,Jackson,Stephens,
Mintun, Nayes, None, and so declared by the L•9ayor.the Petition was received,filed and spread of
record and a copy of said Petition is as follows:
TO THE CITY COUNCIL OF THE CITY OF FAY:sTTEVILLE, ARKANSAS:
The undersigned,your Petition-
ers.,would respectfully represent and show that a Petition signed by more than ten property owners
in the City of Fayetteville,Arkansas,and within the territory described within said Petition,was
presented to your Honorable Body on the 3d, day of September,I923,praying that Body take all nec-
essary steps for the creation of an Improvement District,embraced in the territory described in
said Petition,for the purpose of improving by grading,rolling,and paving with Asphaltic Pavement,
the following Streets and parts of Streets,as may be more fully determined hereafter by the Board
of Improvement of said District,to-wit:
East Center Street,from the West Line of College Avenue to the East
Line of East Avenue.
That your Honorable Body passed an Ordinance, numbered 488,1aying off the terri-
tory described in said.Petition,and herein sej forth,which Ordinance was duly passed on the I7th.
day of September,I923.
That the said Ordinance was duly published in the"Fayetteville Democrat"with-
in twenty days after its passage,under the hand of the Clerk of said City.
WHEREFORE,the undersigned owners of real property situated within the District
described within the said Petition and Ordinance herein set forth,pray that such improvement be
undertaken,and that the cost thereof be assessed and charged upon the real.property situated with-
in such District,and that the said District be. for the purpose of carrying out the improvement
herein set forth. And,said Petitioners ask that said improvement shall not exceed in cost forty
per cent of the value, of the real property in said Distr.ict,as shown by the last County Assessment= -

WHEREAS, on the 8the day of October,I923, there was duly filed with the City Council of the
City of Fayetteville,Arkansas,a petition purporting to contain the signatures og a majority in
value of the owners of real property situated in East Center Street Improvement District Number
One of the City of Fayetteville,Arkansas;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF -TEE CITY OF FAYETTEVILLE,ARKANSAS:
SECTION ONE: That a hearing of said petition to determine whether those persons who have sign-
ed said petition constitutea majority in value of the owners of real property situated in said
Improvement District will be held by said City Council at the Mayor's Office in said City of
Fayetteville,Arkansas,on the 29th, day of October,I923,beginning at 7:30 P.M.of said day.
SECTION TWO: That the City Clerk of the City of Fayetteville,Arkansas,be,and he is hereby in-
structed and directed,to cause to be published a notice in accordance with Section One,Act I25,
Acts of Arkansas ,I9I3,advising all owners of real propbrty within East Street Improvement Dis-

trict Number One of the City of Fayetteville,Arkansas,that a petition was presented to the said
City Council,#ly Sept. 3,I923,requesting that the contemplated improvement be undertaken,and
that the cost thereof be charged and assessed against the real property within said district,and
that on the 281h. day of October I923,the said City Council will determine whether or not said
petition is signed by such majoriSW in assessed valuation.

The matter of a bill submitted by Moreno-Burkham Const. Co. for np 200.09 for construct-
ion work at the intersection of vast Dickson and Willow Street,was called up by Aldo Harding.
' On motion made by Ald.. Harding,seconded by A1d.Price and passed by the following vote:
Ayes.,'Aldermen Price,Harding,Jackson,Stephens,Mintun, Nayes, None, and so declared by the Ivfayor,
this bill was disallowed.
The Mayor submitted a proposition from Mr W.L.Elam for collecting the waste paper,boxes,
etc.,in the alleys of the business portions of the City,and in the residence portion of the City.
On motion made by Aldo Mintun,seconded by Aldo Stephens and.carried by the unanimous vote
of the Council,Five Dollars($5.00) was appropriated from the General Fund and the Clerk was direct-
ed to draw a warrant for this amount in favor of W.L.Elam in payment for his services in collect-
ing waste paper,boxes atc.,from the alleys of the City,for the period of one year.
' On motion made by Aldo Harding,seconded by Aldo Price, and carried by the unanimous vote
of the Council,Miss Erma Deatherage was granted permission to construct a sceptic tank on Cemetery
Street under the supervision of the City Engineer,and.subject to his inspection.
On motion made by Aldo Mintun9seconded by Aldo Stephens and carried by the unanimous vote
of the Council,the Chief of Police was authorized to employ an additional policeman at a salary of
not to exceed Three (3.00) Dollars per day,for a period of not to exceed one week,to assist in the
inforcement of traffic Ordinances.
The following Ordinance was introduced and read for the first time ,whereupon Aldo Hard-
ing moved that he Rules be suspended and the Ordinance be placed upon its second reading;this
motion was seconded by A1d.Price and carried by the following vote, Ayes: Aldermen Price,Harding,
Jackson,Stephens,Mintun, Nayes: None,and so declared by the Mayor. Alderman Price then moved
that the Rules be further suspended and the Ordinance be placed upon its third reading and final
passage;thus motion was seconded by Aldo Harding and carried by the following vote; Ayes: Alder-
men Price,Harding,Jackson,Stephens,Mintun, Nayes: None,and so declared by the Mayor,who then call-
ed for the vote on the passage of the Ordinance,which r7as: Ayes; Aldermen Price, Harding,Jackson,
Phillips,iviintun, Nayes: None, The Mayor then declared the Ordinance passed and a copy is as
follows:
ORDINANCE NUMBER 49I.
WHEREAS, It has been called to the attention of the City Council of the City of Fayette-
' ville,Arkansas,thatthere are some graves in what is"Zipwn as Block Two,of the City of Fayetteville,
Arkansas,and tlxat this property) was used as a burial ground some sixty years ago,and;
WHEREAS,this burial ground is no longer kept up or used as snch,and has been abandoned
as a burial ground for many years;
NOW THEREFORE, Be it ordained by.the City Council of the City of Fayetteville,Arkansas;
SECTION ONE. All persons having dead buried in the said abandoned burial ground in Block -
Two of the City Park Addition to the City of Fayetteville,Arkansas,are required to remove the same
within thirty days from the date of the passage,approval.,and publication of this Ordinance,and
bury the same in some duly established cemetery,and in the event such bodies are not removed with-
in the time herein specified,after this Ordinance has been published in the mode and manner now
prescribed by law.then said City of Fayetteville,Arkansas,may cause the remains of all such per-
sons as can be found to be removed and buried as hereinbefore provided,said removal to be without
cost to the City.of Fayetteville,.Arkansas.
SECTION TWO. That all Ordinances and parts of ordinances in conflict herewith be,and
the same are hereby repealed and this Ordinance shall take effect and be in force from and after
its passage,approval and publication.

of the Council,Ald. Phillips was elected President Pro teippore of the Council.

Council and on motion made by Ald. Herding,seconded. by Aldo Jackson and carried by the unanimous
vote of the Council,the Report was received,filed, and the Clerk was authorized to issue the fol-
