HomeMy WebLinkAbout1923-09-03 Minutest 823 labor,and furnishthe necessary material for the repair and construction as herein set forth on said streets,and at said intersections of streets as herein mentioned, said improvements to be according to the plans and specifications on file in the office of the City Engineer of the City of Fayetteville,Arkansas.. The City of Fayetteville agrees to pay to said Company for the same as follows: For all work,labor and material £urnished,the City of Fayetteville, Arkansas agrees to pay as follows:' I350 square yards of asphaltic pavement@ $ 2.50 per yard, $ 3450•.00 350 square yards concrete pavement @ $ 3.00'per square yard,$IO50.00 Total amount to be paid by the City of Fayetteville in this contract is the slim of Forty -Five Hundred ($4500.00 Dollars,which amount the Council finds to be a fair and just compensation for said material•£urnished and work and labor to be performed in such improvement. S%CTION FOUR:- Upon the completion of repairs and improvements upon said streets,at the places hereinbefore described, by said bloreno-Burkham Construction Company,a corporation, and the accep tance of said materials used and work and labor done in said repairs and improvements by the City Council of the City of Fayetteville,Arkansas--said City of Fayetteville agrees to pay said Moreno Burkham Construction Company,a corporation, Forty -Five Hundred( $4500.00) Dollars to be paid out of the General Revenue Fund of said City by warrants drawn in favor of said Moreno-Burkham Con- struction Company,a corporation, or bearer,payable in the folloaiing amounts and on the following dates, to -wit; First year,July I.1923, $ 450.00 Second year,July I, I924, 450.00 Third year,July ,I, I925, 450.00 Fourth year,July I,I926 450.00 Fifth year,July,I,I927, 450.00 Sixth year,July I, 19281 450.00 Seventh year,JulyI,I829, 450.00 Eighth year,July,I,I980, 450.00 Ninth year, July I,I93I, 450.00 Tenth year, fjuly I.1932, 450.00 If the City of Fayetteville makes default in the payment of any one of said sums,when the same becomes due and payable,the City of Fayetteville agrees and stipulates with the owner of the war rant,representing the amount of the sum in which the City has defaulted in the payment of, to pay said owner of said warrant the sum of eight per cent interest per annum on said warrant from the date of such default,until the said sum of is fully paid,as an agreed and stipulated amount on the part -of the City of Fayetteville for its failure to perform its contract with said Moreno- Burkham Construction Company,a corpobation, or the owner of said warrant. SECTION FIVE:- This contract shall be binding upon the City of Fayetteville,Arkansas,from and after the passage,approval and publication of.this Ordinance,and the -acceptance of the same by the said Moreno-Burkham Construction Company,a corporation,in writing filed in the office of the City Clerk of Fayetteville,Arkansas,and compliance with its terms by said Moreno-Burkham Construe tion Company,a corporation,on its part. The City of Fayetteville,Arkansas,hereby pledges itself and all of its officers to the /X faithful performance of this contractias herein set forth in this Ordinance,upon the full per- formation of the contract1herein set forth on the part of said Moreno-Burkham Construction Com- pany, a corporation. Lum.Co. $22.75 -r, The Chief of The Fire Dept..,Chas Winkleman appeafed before the Council,and upon motion made by Aldo Phillips ,seconded by Aldo Price,the salary of the Night Driver of the Fire Dept, was plac- ed at Fifty Dollars per month,beginning Sept. I.,I923. This motion was carried by the unanimous v vtte of the Council and so ordered by the Mayor. Mr. Coffey appeared before the Council with reference to building a portable building and was referred to the City Engineer. The following applications to construct buildings were submitted to the Council,and on motion made by Aldo Price,seconded by Aldo Hintun and carried by the Unanimous vote of the Coun- cil,the same were granted subject to the inspection and approval of the City Engineer; E.V. BIrd, residence; C. C. Phillips, residence. The Special Committe on Locating New Lights, Aldo Ielintun, Chairman,submitted a report,recom- mending thatlj{&# two lights be placed on Gregg Street and One Light on the corner of Dickson ' and Viest Street. On motion made by Aldo Mintun,seconded by A1d.Phillips and carried by the unani mous vote of the Council the above report was approved and the Clerk was directed to inform the Light Company of this action pf the Council.
