Present: The Mayor,Clerk, Alebe"en Price ,Jackson, Harding, Phillips,Stephe.ns;Mimton, Absent : None. The minutes of the preceeding meeting were read by the Clerk abd approved by the Council The Reports of the City Police Judge and of the City Collector were submitted to the Counci 1 along with the following bills against the City for the month of Junes Hill City Lumb, Co. Jackson and carried by the unanimous vote of the Council the above named Reports and the above listed bills were referred to the Auditing Committee of the Council. Mr. E.B.Wall appeared before the Council and read a petition signed by certain citizens, protesting against the formation of Arkansas Avenue Improvement District No. One of the City of Fayetteville. On motion of .Aldo Price,seconded by, Ald Minton and carried by the unanimous vote of the Council this petition was directed to be filed by the City Clerk. Dr. Thomas appeared before the Council in reference to the improvement of West Dickson Buchanan Streets. On motion made by Ald. Jackson,see6nded by Ald. Harding and carried by the unanimous vote of the Council,the improvement of these streets was referred to the Street Commi ssioner. Mr. Nettleship appeared before the Council in regard to the funds said to be due by the City to LaFayette Avenue Mmprovement District No. One to the City of Fayetteville,Arkansas. On motion made by Ald. Price,seconded by Ald. Harding and carried by the following vote: Ayes Aldermen Price,Harding,Jackson,Stephens,Philllps,Minton,and so declared by the Mayor,the Clerk was instructed to investigate the records and report at the next meeting of the Council what 10 funds are due to the said Improvement District . A communication from Mr. A.L.Trent in regard to the establishing of curb lines 6n certain streets in City Park Addition was read to the Council,and on motion made by Ald. Price,seconded by Ald. Harding and carried by the unanimous vote of the Council ,the City Engineer was directed to investigate the matter referred to by Mr. Trent,and make a report thereon to the Council. On motion made bjr Ald. Harding ,seconded by Ald. Jackson and carried by the following vote, Ayes; Aldermen Price,Harding,Jackson,Phillips,Stephens,Minton, Nayes; None ,and so de- clared by the Mayor ,the Report of the Street Commissioner was received and directed.to be filed and the Clerk was -directed to issue warrants to cover labor and materials as shown in said Repor t as follows:, Charley Wilcox, I8.00; Ed. Wilcox 7.00; 'John Zillah 3.00 Earl Walker I0.00 John Zillah 68.00 On motion made by Ald. Phillips,seconded by Ald. Jackson and carried by tie unanimous vote of the Council -,the City Collector4 was directed to bill licenses for hearses ands ambulances as com- mercial trucks. A communication from G.W.Sheppard in regard to the condition of the side -walks on LaFayette Avenue was read to the•Council. On motion ma/,de by Ald. Harding,seconded by Ald. Jackson ando carried by the unanimous vote of the Council, the City En ineer was directed to make an investi gation and report to the Council at its next meeting �,�yi¢ as to such side -walks as should be renewed or repaired. The following applications for building permits were submitted to the Council; Irene D.Galloway, John•P.Buchholz,Campbell and Bell Dry Goods Co., Cravens and Co. On motion made by A1d.Phillips,seconded by Ald. Price and passed by the unanimous vote of the Council,these applications were granted,subject"to the approval of the City Engineer,. A Report from the City Engineer relative to repair work on Olive and Sutton Streets was sub- mitted to the Council. On motion -made by Ald. Harding,seconded by Ald Ald. Phillips,and passed by the unanimous vote of the Council,this report was received and directed to be filed. An application for license to drive a taxi -cab was submitted to the Council by Ray Paul. On motion made by Ald. Harding,seconded by Ald. Jackson and carried by the unanimous vote of the Council this application was granted. A communication from the City Health Officer was read to the Council,and p* motion made by yl A1d.Harding,seconded by Ald. Phillips and carried by the unanimous vote of the Council,the mat- ter referred to by the City Health Officer was referred to the Street Commissioner. On motion made by Ald. Price,seconded by Ald. Jackson and carried by the unanimous vote of th e Council, Augusta Lollar was granted permission to errect a filling station at the corner of Olive and Maple Streets. / A motion was made by Ald. Minton and seconded by Ald. Price that the City bear -half of XX the expense of the firsfuniforms of the present police force of the City. This motion was de- feated by the following vote; Ayes; Aldermen Price ,Minton, Nayes; Aldermen Harding,Jackson, Phillips,Stephens and so declared by the Mayor. The following Ordinance was introduced and read for the first time,whereupon Alderman Jackson moved that the Rules be suspended and the Ordinance be placed upon its second reading; this motion was seconded by Ald. Harding and carried by the following vote: Ayes Aldermen Price, Harding,Jackstn,Phillips,Stephens,Minton, Nayes; Nong,and so declared by the IJtayor. Alderman Phillips then moved that the Rules be further suspended and the Ordinate be placed upon its thir X reading and final passage;this motion was seconded by Ald. Minton and carried by the following vote; Ayes:; Aldermen Price,Harding,Jackson,Phillips,Stephens,Minton, Nayes; None,and so decl aced by the Mayor,who then called for the vote on the passage of the Ordinance ,which was: Ayes, Aldermen Price,Harding,Jackson,Phi111ps,Stephens,Minton, Nayes; None. The;d•Mayor then declared the Ordinance passed and a copy is as follows: ORDINANCE N0. 485. AN ORDINANCE TO- BE ENTITLED" AN ORDINANCE TO LEVY AN -ADDITIONAL ASSESSMENT UPON THE REAL PROPERTY LOCATED WITHIN THE WILLOW AVENUE IMPROVEMENT DISTRICT NUMBER ONE OF THE CITY OF FAYETTEVILIaf/,A.RKANSAS". WHEREAS, The Board of AssessmentX of Willow Avenue Improvement District Number One of the City of I!ayetteville,Arkansas,did,on the 41h, of June,I923,in accordance with the terms and pro- visions of Act No.488 of the General Assembly of Arkansas,duly approved on the 20th.day of March I923 deposit with the City Clerk of the City of Fayetteville,Arkansas,the additional assessment of Willow Avenue Improvement District Number One of the City of Fayetteville,Arkaneas,duly sub- scribed by each of them; •• El 84 WHEREAS, The City Council of•the City of Fayetteville ,Arkansas ,diad.on*the 4th, day of Jun % 3923 duly pass a Resolution,requiring the City Clerk of the City of Fayetteville,Arkansas,to cause to be published in the "Fayetteville Democrat",a daily paper published -in the City of Faye tteville,Arkansas,a notice,stating that said additional assessment had been so filed.by said Board of Assessors, and that the same was subject to inspection; WHEREAS, Said City Clerk of said City of Fayetteville,Arkansaa,did so cause said notice to be so published on the 5th. day of June,I923; and WHEREAS; The time for filing a protest against said additional assessment has long since passed, and all parties,who cared to do so,have been given an opportunity to be heard by the Cit Council of the said City of Fayetteville,Arkansas: NOW,THEREF@RE ,BE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That the said several blocks ,lots ,and parcels of land•and railroads,and tram roads and rights of way in said District - be assessed according to the additional assessment list for said Improvement District as the same now remains in the office of the Recorder or City Clerk,and that/#J IO per oentum on each of,said blocks,lots and parcels of land and rail roads and tram roads and rights of way in said Improvement District shall be paid annually,on or before the ISth.day of October,until the whole of the said local assessment•s}iall be paid,or un- til the obligations of said District have been fully satisfied and paid in full,including the bonds issued by said District. SECTION TWO: That said additional asessment shall be a charge and a lien against all the pro erty in said District as provided by law,and shall be entitled to a preference ,as provided by7y law. SECTION THREE: That the City Clerk of the City of Fayetteville,Arkarnsas,be authorized and dir acted to publish this Ordinance as fequired by la w and that said City Clerk deliver to the Col- lector a copy of said additional Assessment of benefits,containing a description of the real pro perty,and the amount if assessed on each,and he d eliver,at the same time the warrant of the Clerk for the collection of said sum. SECTION FOUR: That this Ordinance shall take effect and be in full force from and after its passage,approval and publication. Price seconded this motion and the vote thereon was as follows: Ayes,Aldermen Price,Jackson,Harding, Stephens,Phillips,Minton, Nayes; None. The Mayor then announced that The Resolution was a- dopted and a copy is as follows: RESOLUTION. WHEREAS, A Petition claiming to represent a majority in value of the owners of real.propert y on East Maple Street,from the West Line of Nort College Avenue to the West Line of Mission Ave nue,and/#i /�`/ Olive Avenue from the North Line of Maple Street to the South Line of Gunter Str- eet ,was duly filed with the City Council of the City of Fayetteville,Arkansas on the 4th, day of June,I923 ,asking that siid property be created into an Improvement District,to be known as Annex Number One to Mont Nord Improvement District Number One of the City of Fayetteville,Arkan- sas; WHEREAS, said City Council of said City of Payetteville,Arkaneas,did,on the said 4tho day of June ,I923,order and direct the City Clerk of Naid City of Fayetteville,Arkansas,to give a notice by publication for two weeks in some newspaper,issued and having a general circulation in the City of Fayetteeville,Washington County,Arkansas,that such Petition had been filed and that it would be considered/ at a meeting of the City Council of said City of Fayettevill,Arkansas, to be held at the Mayor's Office on June 26th.,1923 ,at 7:30 p.m.,and that all property owners of said Improvement District might appear before said City Council on said date and show cause for or against such annexation; WHEREBS,said notice was so published by said Clerk,in accordance with law; WHEREAS, on said 25th.day of June,I923, the said City Council iluly.eontinued said -hearing until July 2d.,I923; and WHEREAS, said time for said hearing has arrived,and said hearing has been duly and proper ly had; ,�(( / NOW,,TF REFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLEJARKANSAS ; SECTION ONE:That ,after careful consideration,the City Council of the City of Fayetteville,Ark ansas,finds that there is a total assessed valuation of $ 6I.840.00 of real property within said District,according to the last assessment on file in the office of the County Clerk of Wash ington. County,Arkansas; and that persons signing said Petition own real property within said Dix trict of the assessed valuation of $ 36,590.00,according to said assessment. SECTION TWO: That it is the finding of said'City Council of said City of Fayetteville,Arkansas that the majority in assessed valuation of owners of real property within Annex Number One to Mont Nord Improvement.District Number One of the City of Fayetteville,Arkansas,have signed said Petition; and the said District is hereby formed by said City Council of the said City of Fayett eville,Arkansas. SECTION THREE: In condideration of the said above mentioned Petition,the said City Council of said City of Fayetteville,Arkaneas,has been guided by the certificate of the Circuit Clerk of said County,as to the ownership of said real property, and by the certificate of the County Cler�� of said County,as to the assessed valuation of said real property. AN ORDINANCE TO BE ENTITLED "AN ORDINANCE ANNEXING CERTAIN TERRITORY TO MONT NORD ' IMPROVEMENT DISTRICT NUMBER ONE OF THE CITY OF FAYETTEVILLE ARKANSAS,AND TO BE KNOWN AS ANNEX NUMBER ONE TO KONT.NORD IMPROVZMENT DISTRICT NUMBER ONE OF THE CITY OF FAYETTEVILLE ARKANSSA". WHEREASX1, the majority in value of the owners of rael property on East Maple Street,from the West Line of.North College.Avenue to the Viest Line of Mission Avenue, and Oluve Avenue from the North Line of Maple Street to the South Line of Gunter Street ,have petitioned the City Council of the City of Fayette'ffZlle„Arkansas to annex the same to Mont Nord Improvement District Number One of the City of Fayetteville,Arkaneas, and due notice has been given of the filing of auch Petition; and that the same would be heard on the 25th. day of June,I923; WHEREAS, on said 25the day of June,I923,the time fixed in said notice for the hearing of Baia Petition, to determine whether those signing the.same constituted a majority in value of the own ere of real property sought to be annexed.4t was decided by the City Council of the said City of H'ayetteville,Arkansas,to continue said hearing until July 2nd. I923; and r WHEREAS., on said July 2nd.,I923, after hearing all persona who desired to be heard,as to wheth er said Petition contained the signatures of such majority,the City Council of the City of Faye- tteville,Arkansas,did ascertain and declare that said Petition didacontain the, signatures of a majority of the owners of said real property within said territory ,according to the last precee ding assessment for State and County taxes in said territory,and as shown by the records of deeds and by actual ownership; and that said Petition is in due form,and as required by law; NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE ARKANSAS: SECTION ONE: That the hereinbefore described real property,East.Maple Street,from the West Line of North College Avenue to the West Line of Mission Avenue, and Olive Avenue,from the North Line of Maple Street to the South Line of Gunter Street,be.,and the same is hereby annexed to said Mont Nord Improvement District Number Orbe of the City of Fayetteville,Arkansas to be Known as Annex Number Onq to Mont Nord Improvement District Number- One of the City of Fayetteville, Arkansas.
