Section 4. It shall be the duty of the'c;ity Council to examine promptly.and carefully the report
of the City Engineer when-made,and if it isound that the building so errected would not ren-
der the property less safe and will not be detrimental to the property of said city it will be
the duty of the City Council to issue a licens to said party to errect said building in accord-
ance with such plans and specifications( A ch rgeof 8,,50 will be made for a permit to er-
ect a building within the fire district and a ch rge of X3:50 will be -made for a permit to er-
ect a building outside of the fire district. Sa id fee shall be paid by the person making
the application for permit to the City Collector the City of Fayetteville,Arkansas,and a �
receipt shall be submitted to the•City sngineer wi the plans and- specifications.
Section $. Any and all persons who violate any of the provisions of this Ordinance or fail to
' comply thqrewith,or who shall violate or fail to comp19, with any order or regulation made there-
under or who shall build in violation of any detailed tatement of specification or plan sub-
mit.ted and approved thereunder or any certificate or pe it issued thereunder,shall severally
for each and every such violation and non-compliance resNctively forfeit and pay a penalty in
the sum of 25.00. The imposition of one penalty for an violation of this Ordinance shall
not excuse the violation or permit it to continue;and all succi persons shall be required to.cor
reet or remedy such violations or defects within a resonable time and when not otherwise specifi
ed each ten days that prohibited conditiond are maintained shall4consttute a separate.offense.
' The application of the above penalty shall not be held to prevent the enforced removal of
prohibited conditions and any structure erected without permit or not in conformity with this or
dinanee shall be removed.
Section 6. All Ordinances and parts of Ordin+Lnces in conflict herewith are hereby repealed.
Section 7. .This Ordinance shall take effect and be in force from and after its passage,.approv
al and publication.

The weekly report of The Street Commissioner was submitted to the Council, with account foe
labor employed for week endin g May 26th.,I923, as follows:

On motion made by A1d..Harding,seconded by Aldo Minton and passed by the unanimous vote of the
Council the report of the Street Commissioner was reeeived,diroted to be filed by the Clerk,and
the Clerk was directed to draw a.warrant in favor of Charley Wilcox for I6.00
At this point Aldo Jackson entered and took his seat .

The Mayor stated that he had had a conference with the County Judge and The Commis-
sioners of Road District No,2,and as a result of this conference the County Judge had agreed to
pay $500.00 or one-half-of•the cost of the improvement of Mission Street from Brown's Store to
entrance to Methodist.Aseembly, and The Commissioners of Road Didtrict No. 2 had agreed to pay
$ 300.00 or one-half the cost of the improvement from entrance of Methodist Assembly -to The City
limits.
On motion made by Ald. Jackson,seconded by A1d,Phillips and passed by the following vote,

A report was submitted to the Council by Allen M.Wilson ExSpecial Disbursing Agent cone
earning the location of tools and equipment belonging to the City. On motion made by Ald. Hard
ing ,seconded by Ald. Phillips and carried by the unanimous vote of the Council ,this Report wa
s reedived and directed to be filed.
Ald, Price stated that he had in his possession I6 checks that had been furnished by cit-
izens as security for completion of certain work in City. On motion made by Ald. Jaekson,sec-
onded by Ald. Harding and carried by the unanimous vote of the Council,the Clerk was directed to
return these checks when the City ::ngineer had approved the completed work. The Clerk delivered
these checks to the City rngineer,the same to be returned to the City Clerk when the City s'ngin-
eer.had inspected the work in question.

The report of The Street Commissioner for the week ending June 2,I923 was submitted to the
Council and on motion made by Ald, $arding,seconded by Ald. Jackson and passed by the unani-
mous vote of the Council,this report was directed to be filed by the Clerk and the Clerk was
directed to issue warrants as follows to cover•work reported in said report:

Alderman Price entered at this point and took his seat on the Council,
'The following persons applied for permission to errect buildings: Walter M.B1ack,Lot I2.
Block I6.to repair porch and put on abbestod roof; Lyle Bryant.Lot 8-B,Block I4,to construct
brick.automobile sales room. On motion made by Ald. Harding,seconded by Ald,Jackson and carr-
ied by the unanimous vote of the Council,these applications were granted ,subject to inspection
by the City Engineer.
A communication from Major B,R,Davidson,addressed to Mr. Marshall Douglase,was read to
the Council, On motion made by Ald, Harding,seconded by Ald, Jackson.and carried by the unan-
imous vote of the Council,the Street Commissioner was directed to cause a ditch to be opened froom
Davidson Street to North College Avenue.
Mr: Scott Hamilton submitted an application to install and operate.an underground tank an�
filling station on curb of Center Street. On motion made by Ald, Harding;seconded by Ald, Ja
ekson and carried by the ]following vote, Ayes; Aldermen Price,Harding ,Jackson.Stephene.blinton,
Nayes; None, and so declared by the Mayor, No person ,corporation or firm shall be allowed to
install or operate a curb filling station on any paved street in the City,and all filling static
ns located on any paved street in the City shall be of the "brive -In" type,
Mr, A,L.Trent appeared before the Council in regard to certain trees on his property in City
Park Addition being injured by telephone wires.
On motion made by Ald, Harding,seconded by Ald, Jackson and carried by the unanimous vote of
the Council the Street Commissioner was directed to .repair bridge on Duncan Street,south of the
University,

on East Maple Street,from the West Line of North College Avenue to the West Line of Mission
Street,and Olive Avenue,from the North Line of Maple Street to the South Line of Gunter Street
,was duly filed with the City Council on June 4,I923,asking that said property be creat—
ed into an Impr.ovement.District Number 0ji,to be known as Annex Number One to Mount Nord Im-
provement District Number One of the City of Fayetteville,Arkansas.
