REGULAR MEETING OF THE CITY COUNCIL:, HELD APRIL 30, I923.
Present: The. Mayor, Clerk., Aldermen Price, Harding,Phillips•, Jackson, Stephens,*Minton..
Absent: None.
By direction of the Mayor the reading of the minutes of the preceeding meeting was dis
penned with. Protests as'to assessments of benefits in Improvement District Number One
of North College Avenue made by the following residents of said district were read as follows;
A.I.Moore, Mr . Beulah H.Lawson, Moses Baum, T.M.Logan; Ist. Baptist Chiirch.
-These Appellants were heard in the following order; A.I..ioore,by his attorney,9„B.Wa$1,
and by himself, who stated that he represented ,in the main,Moses Baum and Te*,Logan. These app-
eallants were answered by=A.Hurst,Attorney for North College Avenue Improvement District Numbe
ber One. Thereupon on motion made by Aldo Pride and seconded by Aldo Harding and carried by the
following vote; Ayes, Aldermen Price, Harding, Phillips,Jackson,•Stephens,Minton; Nayes, None
and so declared by the Mayor, "the protests of A.I.Moore, TQH Logan, and Moses Baum to their assess
menta of benefits in North College Avenue Improvement District Number One 'be refused by the
Council on account of lack of jurisdiction”
Other appellants to assessments in this same Improvement District were heard as follows;
Beulah H.Lawson by Hugh M.Lawson, Ist. Baptist Church, by the Clerk reading the filed protest.
A motion was made by Alderman Price and seconded by Aldo Minton that the protests of Mrs Law-
son and bf the Ist. Baptist Church be,taken.under advisement by the Council until next meet-
ing. This motion was carried by the following vote; Ayes; Afttrmen Price, Harding,Phillips,
' Jackson, Stephene.Minton, Nayes; None, and was so declared by the Mayor.
The Chairman of the Water Commission presented to the Council an exhaustive report which was
read by the Clerk. A motion was made by Aldo Jackson ,seconded by- Aldo Price and carried by the
unanimous vote of the Council, that the report of the Water Commission be received and filed and
the Water Commission be tendered the thanks of the Council for the report made.
The St.Louis-San Francisco Railway Co.,through its attorney Atkinson appeared before the
Council.
Hon. J.Wythe Walker appeared before the Council in behalf of the Hill City Lumber Co.
Dr. Me Allister appeared before the Council,as a representative of The Chaber of Commerce of
Fayetteville,Arkansas,in regard to securing property to be used as a City Park,
Dr. Me Allister presented a petition to the Council ,which was read by the Clerk. On
motion made by Aldo Price,seconded by Aldo Harding and carried by the following vote; Ayes;
Aldermen Price, Harding,Phillips, Jackson, Stephens,Minton;Nayes, None ,and so declared by
the Mayor, the petion was received,filed and spread of record. The petition is as follows;

We,the undersigned owners of real' property in the City of Fayetteville.Washington
County,Arkansas.and of the district herein described and set forth,respectfully petition your He
norable Body to take all necessary steps and pass all necessary OrdinanSes,Resolutions,or Ord-
ers to lay off the whole of the said City of Fayetteville/into an Improvement District the boun
daries of which shall be the corporate limits of said City of Fayetteville and to form an Impro-
vement District for the purpose of purchasing real estate to be used as a public City Park --
said real estate to be handled and managed in the manner and form to be determined from time i
' to time by the City Council of the City of Fayetteville,Arkansas--said Improvement District to
be known as City Park Improvement District Number One of the City of Fayetteville,Arkansas--said

Alderman Harding introduced, the following Ordinance,which was read the first time,whereup
' on Alderman Price moved that the Rules be suspended and the Ordinance be placed upon its second
reading; this motion was seconded by Alderman Jackson and carried by the following vote,Ayes;
Aldermen Price,Harding,Phillips,Jackson,Stephens,Minton,Nayes; None,and so declared by the Mayor
Alderman Harding then moved that the Rules be further suspended and the Ordinance be placed on
its third reading and final passage,this motion was seconded by Aldo Price and carried by the H
'following vote,Ayes; Aldermen Price ,Harding,Phillips.Jackson.Stephens.Minton.Nayes; None ,and
so declared by the Mayor,who then called for the vote on the passage of the Ordinance,which was

AN ORDINANCE TO BE ENTITLED "AN ORDINANCE LAYING OFF AND CREATING AN IMPRO
VEMENT DISTRICT FOR THE PURPOSE OF PURCHASING AND MAINTAINING AND OPERATING A CITY PARK FOR THE
USE OF THE CITY OF FAYETTEVILLE,ARKANSAS",
BE IT ORDAINED BY THE CITY COUNCI'L:OE-.THE-.:CITY OF FAYETTEVILLE?ARKANSAS:
SECTION ONE: That the whole of the territory lying within the corporate limits of the City of

Fayetteville,Washington County,Arkansas,be,and the same is hereby laid off into an Improvement
District for the purpose of purchasing real estate to be used as a.City Park and for the pur-
pose of maintaining and operating•a City Park for the use and benefit of 'the general public of.
the City of Fayetteville,Arkansas.
SECTION TWO: That the corporate limits of the City of Fayetteville,Arkaneas,be,and they are
hereby designated as the boundaries of said Improvement District and the territory embraced the
itein,known as City Park Improvement District Number One of the City of Fayetteville,Arkansas--
said district being bounded as follows,to-wit:

same are hereby repealed,and this ordinance shall take effect and be in force from and after its

On motion made by Alderman Price ,seconded by Alderman Harding and unanimously carried by the
vote of the Couneil,the Mayor was authorized to confer with Mr. A.L.Trent regarding the removal
of an old cemetery on lands owned by Mr. Trent,and to report the result of his investigations
to the City Council.
A petition from certain citizens in reference to the erection of a store build-
ing at Locust and Spring Streets was read to the Council and on motion made by Alderman Stephens
seconded by Aldo Price and carried by the unaniIous vote of the CouncilX,the City Engineer was
directed to see that no such building be erected at Locust and Spring Street and no building ptr
mit be issued therefor.
Bids were received and read for repair work on culvert an Prairie Avenue
as follows;'
H.M.Powers, 70.00; G.Smook, 38.60.
On, motion made by Aldo Phillips and seconded by A1d.Stephens,and carried by the unanimous vote,
of the Council,the City Engineer was directed to prepare.plans for the necessary repairs to the
culvert on Prairie,advertize for bids,receive these bids and award contract for above named re-
pairs4l after consulting with Chairman of Street Committee. 5
No further business appearing,the Council adjourned at 9:45 p.m.

Applications for taxi -cab license from J.C.Flannigan and Ely Osborn were read;and on
c�
motion made by Aldo Phillips and seconded by Aldo Stephens,and unanimously adopted by the CouncA
these applications were granted'and the City Collector directed to issue said licenses.
On motion made by A1d.Harding,seconded by Aldo Phillips and unanimously adopted by the
Council,the matter of telephone boxes for taxi -cab drivers at the station was referred to the
Chief of Police for such action as he"deemed best.
Ald.Phillips made a report in regard to the rental of the rooms now occupied by the
City Council,the City Collector and the Water Commission. On motion made by 91d.Price,seconded
by Ald. Phillips and adopted by the following vote; Ayes Aldermen Price,Harding,Phillip0,JaeksoA
Stephens and Minton,Nayes; None,and so declared by the Mayor, The Mayor was directed to enter
into a contract with the County Judge to pay a rental of Forty Dollars per month for the rooms
now occupied by the city offieials,and the Mayor was empowered by the Council to sign said cont-
ract for and in the name of the City Council.
A petition from II* certain citizens concerning repairs to the bridge over Big Springs
Branch was read,and on motion made by Aldo Harding ,seconded by Aldo Minton and unaniipously adop-
ted by the Council,the Clerk was directed to return petition to citizens concerned and ask that
