Present;- Layor Wilson, Aldermen Harding, Jackson, Price, Stephens; Absent Ald. Ham. .Ifter Roll -call, the Liinutes of the preceding meeting were read and approved. x I.;r. G.A.Hurst of the Board of Election Commissioners was present and tendered t� report of the Special Election for two Aldermen for the First ',"lard in the City of Fayetteville, Arkansas, on Oct. 25th 1922. '.thereupon Alderman Harding, seconded by Alderman Price, moved that the report be received, filed ,and spread of record. The vote on this motion vias;- Ayes;- Aldermen Hadding, Jackson, Price, Stephens. Absent and not voting, Alderman Ham, The :layor declared the motion carried. Following the receipt of the above and foregoing report, A.R.I.intun was duly sworn in as Alderman fo the First,lard of the City of Fayetteville, Arkansas, and entered at once upon the discharge of his duties as such. A.:.:.Byrnes vias present and offered to deed to the City, certain lands on East Center Street, whereirconAlderman Harding ,seconded by Alderman Price, moved that the matter be referred to -.the City Engineer, with instructions to run the necessary lines for a description of the property. The resulting vote vias; -Ayes Alderman Harding, Jackson Trice, Stephens, Lantun, Absent and not voting, Alderman -Ham, The Uayor declared the motion carried. The Board of lection Commissioners, by Geo.A.Hurst, filed the expense account of the Special lection for two Aldermen for the F irst '.lard, amounting to N103.00, ':!hereupon Alderman Price, seconded by Alderman Harding, moved that the account be allowed and ordered paid, and that the Clerk be instructed to draw a warrant for the same, payable to Geo. A.Hurst, The vote on this motion vias; - Ayes Aldermen Harding, Jackson, Ldntun, Price ,Stephens. Absent and not voting, Ald. Ham. The ..ayor declared the motion Carried. Alderman Jackson introduced a resolution, levying certain taxes on the Cit>� of 7ayetteville for the year 1922, of which the following is a copy;- �^ RLSOLUTION. KX� (•tel I'T R_.SOLV:D BY THE CITY COUNCIL OF THh CITY OF FAY<TT VILL'I:,nRKdIISAS:- ection One; That the rate of taxes for Fire Department purposes for the year 1922, be, and it is hereby declare dto be One and One-half I.Iills on the Dollar of the assessed valuation of all the real and personal property within the corporate limits of the Uity of Fayetteville, Arkansas, as shown by yhe assessment books for State and County purposes, and the same is hereby levied, and the IJayor and Clerk of said ' City are hereby authorized and directed to certify this levy to the County Clerk of .,.shint;ton County, Arkansas, to the end that the said assessment may be placed on the tax -books, and collected with the State and County Taxes, Section Two;- That the rate of taxes for City General purposes for the year 1922, be,and it is hereby declared to be Five I.2ills on the Dollar of the assesed valuation of all real and persomal property within the corporate limits of the City of Fayette- ville, Arkans s, as shown by the assessment books for State and County purposes, and the same is hereby levied, and the Ilayor and Clerk of said City are hereby authorized and directed to certify this levy to the County Clerk of ':Iashington County, Arkansas, to the end that the said assessment may be placed on the tax books and collected with the State and Coun" taxes. The i.;ayor declared the motion carried. •.Ln accbunt of The J.H.Phipps Lumber Co. against the City, for 5-4.16; and an account of The Fred/ S.Cramer Lifg. Co. against the City for 66.47, were presented, and on motion by Alderman Price, seconded by Alderman Stephens, were ordered paid, and.the Clerk wav instructed to draw warrants for the same. The vote on the motion was;- Ayes, Aldermen Harding, Jackson, Liintun,"Price, Stephens; Absent and not voting, Alderman Ham; the I:.Tayor declaring the motion carried+ On motion by Alderman Jackson, seconded by Alderman Harding, the report of the Special + )is,bursing Agent was referred to The Finance Committee. -The I.Iayor made a report for the Committee appointed to present the matter of the paving of College Avenue adjacent to the County Property, to the effect that the Quorum Court had agreed to aid substantially in the proposed improvement. On motion by Alderman trice ,eseconded by Alderman Stephens, the report was recieved and the Committee discharged. ..t the request of the Board of Commissioners of East StreetImprovement District No, One, Alderman Harding seconded by Alderman Lintiuy, moved th•at the time for •the payment of the Assessments on Eats Street Improvement District Number One, and on Annex NumbBr One .to East Street Improvement Number One be extended from October 1922, to January lst 1923. The vote on this motion was; -Ayes Aldermen Harding, Jackson, 11intun, Price Stephens Absent and not voting, Alderman Ham. The i.iayor declared the motion carried. �( The Board of Improvement for i.iont idord Improvement District Number One, who had purposed to file a report of the plans and specifications for their improvement, asked that more time be granted them , as they had not been able to complete their work. Onzmotionzby Alderman Harding introduced an Ordinance to rrohibit the burning of leaves or other matter in gutters and on paved streets of the City, which was duly read . +."hereuion Ald. harding, seconded by Alderman Price, moved thatthe rules be suspended and the Ordinance placd on its second reading. The vote oat on this motion was;- dyes Aldermen Harding, Jackson, fiiintun, Price, Stephens, Absent and not voting, Alderman Ham. The idayor declared the motion carried. Alderman Stephens then moved that the rules be further suspended and the Ordinance placed on its third reading and final psss passage. This motion was dulSr seeondeOby Alderman Jackson, and the vote was as follows;- Ayes Alderman Harding, Ja ckson Stephens; Absent and not voting, Alderman Ham. The i.ayor declared the motion carried. The I:iayor then announced that the question is now , Shall the Ordinance pass? and called for a vote on the same, which was as follows;- Ayes, Aldermen Harding, Jackson, :..intum, !rice, Stephens; Absent and not voting, Alderman Ham, The i.iayor declared the Oeidina Ordinance passed. Acopy is as follows'. ORDINANCE NUI.M,_:R 464. A1' ORDITdAidC TO PROHIBIT TH2 BURNING OF' L P_VES,TRASH_,OR OSHER SUBSTANCES IN a3lz GUTT::RS OR UPON PAVED STRzj:TS. BE IT ORDAINED, By the City Uouncil of the City of Fayetteville, Arkansas; - Section One. It shall hereafter be unlawful for any person or persons to burn, or cause to be burned, any leaves, trash, or other substances in any gutter along any street within the City of Fayetteville, Arkansas. Section Two. It shall hereafter be:unlawful for any person or'persons to burn, or cause to be burned, any leaves, trash, or other substances in any gutter along any paved street, or upon the surface of any such paved street, within the City of Fayetteville, irkansas. Section Three.'Any person or persons violating Section One of this Ordinance shall be deamed guilty of a misdemeanor, and upon conviction thereof, shall be fined in any sure not less than One Dollar nor more than Five Dollars for each offense. Any person or persons violating Section Two of this Ordinance shall likewise be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in any sum not less than Ten Dollars nor more than Fifty Dollars for each offense; and shall, in addition, be liable to the City of layetteville for any damage resulting to the pavement as a result of the burning trash, leaves or other substances upon such pavement, or in the gutters along the same. Section Four. That this Ordinance be in force and effect from and after its passage, approval, and publication, and all ordinances, or parts thereof in conflict, be and the same are hereby repealed. Trice. The ;.:ayor declar:d tha resolution:. Adopted. Dr. i.F.Drake was present and informally presented the matter of City aid to the ont ::ord Iml.rovement District. The ;.;ayor explained the position the City had uniformly taken as to Improvenent Districts, and expressed the opinion that the City would in all probability assist to the extent of saving the actual street intersections, ' The :.sayer then announced that in view of the changed personel of the Council, it had become necessary to rearrange the Standing Committees, and announced the following to serve untill Ar,ril 1923, J...:.ihillips, Chaorman, L.L.Price, Chairman.
