After a report made verbally by the Chief of Police in regard to data collected
by him on the subject of the"Boulevard System of Traffic Control",action thereon was deferred un
til the Mayor was present. '
On motion made by Aldo Price,seconded by Ald Minton andepassed by the unanimous
vote of the Council,the City Engineer was directed to investigate a proposition made by Mr'. Will
Stone to donate certain streets to the City.
On motion made by Aldo Jackson ,seconded by Aldo Stephens and passed by the un
nanimous vote of the Council ,the Mayor was authorized to appoint a committee to confer with the
officials of the Fair Association and with the County Judge relative to the improvement of the
streets leading to the Fair Grounds. The Mayor announced this committee as ; Aldo Minton,
On motion madejby Aldo Jackson, seconded by Aldo Price and carried by the unanimous vote o f
the Couneil,the City, as directed to to make a survey of the City for the purpose of fixing num-
bers for all houses in the City which now have not numbers,and the City Clerk was directed to
issue a warrant for the sum of Fifty ($50.00) Dollars to the City Engineer when this work had
been completed to the satisfaction of the Council.
No further business appearing the Council( adjourned at 9:05 p. m.

REGULAR MEETING OF THE CITY COUNCIL HELD AUGUST 27, I923,
Present: the Clerk, Aldermen Price,.Jackson,Phillips,Stephens,Minton.

On motion made by Aldo Mihtun,seconded by Aldo Stephens and carried by the un'anf
mous vote of the Council ,Aldo Phillips was •declared the unanimous choice of the Council for Pres-
ident Pro -Tempore of the Councilland Aldo Phillips thereafter presided at the meeting.
The minutes of the preceeding meeting were read by the Clerk and approved by the Council.
The Street Commissioner submitted his Report to the Council for the week ending Augo 25,I923,
On motion made by Aldo Jackson,seconded by Aldo Stephens and carried by the unanimous vote of the
Council the Report was received,filed and the Clerk was directed to issue warrants to the follow-
ing persons for labor and for materials as shown by said Report:

A petition signed by certain citizens,praying the Council to reconsider its actions in refer-
ence to refusing permission to Mrs E.A*Wade to repair her building on Borth Side Square was read
to the Council; on motion made by Aldo Mintun,seoonded by Aldo Jackson and carried by the unani-
mous vote of the Council permission to repair building on South Side of Square was denied Mrs.
E.A.Wade and the City Collecto%was'directed to refund to Mrs Wade the amount of money paid by Mrs
Wade,( N5.50), for said permit.
Attorney Baxter appeared before the Council in reference to a proposed dance hall In or near
North College Avenue.
69m. Hudson submitted ar application for a license to drive a taxi=eab,upon which no action
was taken by the Council.
Applications for permit to errect buildings were submitted by the following named citizens,
and on motion made by Aldo Price,seconded by Aldo Ivlintun and carried bar the unanimous vote of the
Council these applications were granted,subject to the inspection and approval of the City Engin-
eer: viz-,
D.J. Collins,residence; K.C.Paulk, residence.
The following Ordinance was introduced' and read for the first time,whereupon Aldo Price moved
that the Rules be suspended and the Ordinance be placed upon its second reading;this motion was
seconded by A1d.Jackson and carried by the following vote; Ayes, Aldremen Price, Jackson, Stephe
ens, Mintun, Phillips, Nayes; None , and so declared by the Mayor, Aldo Price then moved that
the Rules be further suspended and the Ordinance be placed on its third reading and final passage
this motion was seconded by Aldo Jackson and carried by the following vote: Ayes, Alderman Price
Jackson, Stephens, Mintun, Phillips, Nayes ; None ,and so declared by the Ivlayor,who then called
for the vote on the passage of the Ordinance, which was; Ayes; Alderman Price, Jackson,Stephens
Idintun, Phillips; Nayes, None. The Mayor then declared the Ordinance passed and a copy is as

AN ORDINANCE TO BE ENTITLED"'AN ORDINANCE CONTRACTING WITH MORENO BURKHAM CONSTRUCTION
COLTANY,A CORPORATION, TO REPAIR AND MAKE IIiPROVEhENTS ON CERTAIN STREETS WITHIN THE CITY OF FAY*
ETTEVILLE,ARKANSAS,AND TO FURNISH THE NECESSARY MATERRL,WORK AND LABOR FOR THS SAME ,AND TO PRO-
VIDE FOR THE PAYMENT OF SAID MATERIAL WORK AND LABOR"
BE IT ORDAINED BY TH2 CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:
SECTION ONE:- That repairs and improv;ments be made upon the following streets in the City of
F'ayett�ville,Arkansas,at the places herein named,to-wit:
The intersection of Highland Avenue and Maple Street; Highland Avenue and Davidson Street;
Forrest Avenue and Maple Street; Forest Avenue and Mont Nord Street; $orrest Avenue and Davidson
Street; Mock Avenue and Lont Nord Street; Mock Avenue and Maple Street.
SECTION TWO:- That said improvement shall consist of having of the intersections of -said streets
and the construction of necessary culverts and drains to take care of the drainage which must pass
under the paving from the adjacent territory next to said intersection of said streets.
` SECTION THREb:- The City of Fayetteville,Arkansas,by the City Council of said City hereby con
tracts with the Moreno-Burkham Construction Company,a cprporation,to do and perform the work and

labor,and furnishthe necessary material for the repair and construction as herein set forth on
said streets,and at said intersections of streets as herein mentioned, said improvements to be
according to .the plans and specifications on file in the office of the City Engineer of the City
of Fayetteville,Arkansas.. The City of Fayetteville agrees to pay to said Company for the same
as follows:
For all work,labor and material furnished,the City of Fayetteville, Arkansas agrees
to pay as follows:
I350 square yards of asphaltic pavement@ 7 2.50 per yard, $.3450..00
350 square yards concrete pavement @ $ 3.00'per square yard,jIO50.00
Total amount to be paid by the City of Fayetteville in this contract is the s= of Forty -Five
Hundred ($4500.00 Dollars,which amount the Council finds to be a fair and just compensation for
said material furnished and work and labor to be performed in such improvement.
(SECTION FOUR:- Upon the completion of repairs and improvements upon said streets,at the places
hereinbefore described, by said IrIoreno-Burkham Construction Company,a corporation, and the accep
tante of said materials used and work and labor done in said repairs and improvements by the City
Council of the City of Fayetteville,Arkansas--said City of Fayetteville agrees to pay said Moreno
Burkham Construction Company,a corporation, Forty -Five Hundred( $4500.00) Dollars to be paid out
of the General Revenue Fund of said City by warrants draam in favor of said Moreno-Burkham Con-
struction Company,a corporation, or bearer,payable in the folio -ring amounts and on the following
dates, to -wit;

I£ the City of Fayetteville makes default in the payment of any one of said sums,when the same
becomes due and payable,the City of Fayetteville agrees and stipulates with the owner of the war
rant,representing the amount of the sum in which the City has defaulted in the payment of, to pay
said owner of said warrant the sum of eight per cent interest per annum on said warrant from the
date of such default,until the said sum of is fully paid,as an agreed and stipulated amount on
the part -of the City of Fayetteville for its failure to perform its contract with said Moreno-
Burkham Construction Company,a corpobation, or the owner of said warrant.
SECTION FIVE:- This contract shall be binding upon the City of Fayetteville,Arkansas,from and
after the passage,approval and publication of.this Ordinance,and the -acceptance of the same by
the said Moreno-Burkham Construction Company,a corporation,in writing filed in the office of the
City Clerk of Fayetteville,Arkansas,and compliance with its terms by said Moreno-Burkham Construe
tion Company,a corporation,on its part.
The City of Fayetteville,Arkansas,hereby pledges itself and all of its officers to the//X
faithful performance of this contractias herein set forth in this Ordinance,upon the full per-
formation of the contract1herein set forth on the part of said Moreno-Burkham Construction Com-
pany, a eprporation.
SECTION SIX:- This Ordinance shall take effect and be in force from and after its passage,ap-
proval and publication.
