The minutes of the previous meetings were read and approved. A communication from the Fayetteville Gas & Electric Co. in regard to the Pole license due the City was read whereupon Ald Harding moved that'a settlement be made as set forth in their letter subject to the Company making a sworn statement as to the count of poles and the Mayor imform the Company the City accepts their offer of $521.26 due the City, which was duly Sec by Ald Ham, resulted in the" following vote Ayes Afd Ham,Harding,I&ssie,Stephens,Nayes none,Absent and not ' voting Ald Jackson,Price,Mayor declared the motion adopted. An application from W.L.Hall asking for permission to make a sewer connection at the corner of Mock and Lafayette Streets.was read, whereupon Ald Harding moved that same be referred to the City Engineer, which was duly -Sec by Ald Ham, resulted in the following vote Ayes Ald Ham,Harding,Massie,Stephens,Nayes none, Absent and not voting Ald Jackson,Price,R4ayor declared the motion adopted. The light Committee recomended that lights be ordered in ,one on Mission Street, one on corner of Storer and Douglas streets, and two on North Leverette Street, Ald Harding moved that the Lights be so ordered, which was duly Sec by Ald Massie, ' resulted in the following vote Ayes Ald Ham,Harding,iclassie,Stephens,Nayes none, Absent and not voting Ald Jackson,Price,14ayor declared the motion adopt:d. Ald Harding introduced a Resolution ordering in Concrete curb and gutters in Annex No 2 which was read, and moved its adoption,which was duly Sec by Ald P.7assie, resulted in the following trate AyeH Ald Ham,Harding,Massie,Stephens, Nayes none,Absent and not voting Ald Jackson,Price,idayor declared the resolution adopted and a copy is as follows:to-wit: RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION ONE. That all owners of real property facing or abutting on the following streets and parts of streets within the City of Fayettevill,Arkansas,to-wit:. Dickson Street,from the west line of St.Charles Street to the East line of Aransas Avenue; West Street,from the North line of Dickson Street to the South line of Lafayette Avenue; and Gregg Street,from the North line of Dickson Street to the South line of Ida Avenue,be, and they are hereby ordered to lay and construct concrete curbing and gutters along and in front of their respective properties, within ten days from date that notice is served upon them. Said curbing and gutters shall be laid and constructed in accordance with the specifications heretofore prepared by the City Engineer of said City of Fayetteville,Arkansas, and filed with and'approved by the City Council of the said City of Fayetteville,Arkansas, ' andxszk shall be laid and constructed upon the grade as the same is now xkx established by the said City of fayetteville,Arkansas, SECTION TVIO. If any owner of real property as set forth in Section -One hereof shall fail or refuse to so lay and construct said curbing and gutter along and front of their respective properties within the time as stated herein, or shall fail xx and refuse to lay and construct the same in accordance with the specifications,as set forth in Section One hereof,then and in that event the said City of Fayetteville,Arkansas,shall advertise for sealed bids for One (1) week for the construction of such curbing and gutters,and saw shall award the contract for the six same to the lowest and best bidder,after having given notice of one week of intention to so advertise for bids to the owner of agent of tjmx any of the above described peal property who shall so fail or refuse to comply with the provisions of this xHxjtxx Resolution as set forth in Act 136,Acts of Arkansas 19099and in the event the said City of Fayetteville shall so build or construct any of said curbing or gutters,a lein shall be foreclosed upon the real estate along and in front of which such curbing or gutter was so constructed,as is provided in said Act 136,4cts of Arkansas,1909. SECTION THR.2. That the City Clerk be,and he is ordered and directed to issue notice to the respective property owners on the streets and parts of streets set forth in Section One of thus 3esolution, and cause the same to served upon said property owners. SECTION FOUR. That all Orders or Resolutions in conflict herewith,be, and I the same are hereby repealed, and this Resolution be in force and effect,from and after its passage and approval. Approved: Attest: Allam M.Wilson, D.E.Bridenthal, Mayor, Clerk, Ald Massie introduced An Ordinance appropriating.the sum of $10,000.00 for paving the intersecting streets in Annex No 2 to East Street Improvement District No. 1. which was read, whereupon Ald Massie moved that the rules be suspended and " the Ordinance be placed upon its second reading which was duly Sec by Ald Stephens, resulted in the following vote Ayes Ald Ham,Harding,Nlassie,Stephens,Nayes none, Absent and not voting Ald Jackson,Price,Mayor declared the motion adopted. Ald Harding moved that the rules be further suspended and the Ordinance be placed upon its third reading and final passage, which was duly Sec by Ald Massie, resulted in the following vote Ayes Ald Ham,Hardigg Hassie,Btephens,Nayes none,Absent and not voting Ald Jackson,Price,Mayor declared the motion adopted. Question is now shall the Ordinance be passed as read, vote was taken t with the following result,Ayes Ald Ham,Harding,ltfassie,Stephens,Nayes none Absent and not voting Ald Jackson,Price, Mayor declared the Ordinance duly passed and a copy is as follows, to -wit: 618 `6 qq"fo ORDINANCE NUMBER 441. AN ORDINANCE TO BE'INTITLED, "AN ORDINANCE TO PROVIDE TIM PERMANENT IMPROVEMENT OF THE INTERSECTION OF 9XVINTN'CERTAIN STREETS WITHIN THE CITY OF FAYETTEVILLE,ARKANSAS, AND FOR OTHER PURPOSES. if WHEREAS, there has been formed and created within the copporate limits of the City of Fayetteville,Arkansas,a certain Improvement District,known as Annex Number Two to East Street Improvement District Number One'of the City of Fayetteville, Arkansas; and WHEREAS, it is the policy of the City of Fayetteville, to aid in constructing and maintaining permanent streets constructed under the improvement plan; and WHEREAS, the City of Fayetteville has assumed part of the expense -of improving streets in other improvement districts; NOW,THER TORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That there is hereby appropriated out of the General ' Street Fund of the City of Fayetteville,Arkansas,the sum of $10,000.00,to be used by the Board of Commissioners of Annex Number Two to East Street Improvement District Number One of the City of Fayetteville,Arkansas, in permanently paving the intersections of all streets within said Improvement Diatrict,and otherwise permanently improving the same. SECTION TWO: That the City Clerk of the City of Fayetteville,Arkansas, be,and he is hereby,instructed ±ax to draw ten warrants of equal amounts,in favor of whomsoever said Board of Commissioners may designate,and at such time as said Board may request,not to exceed in the aggregate,however,the sum of $10,000.00 Said ten warrants shall be drawn serially,so that oxxx one warrant shall become due and payable each year after date of issue. SECTION THREE: That this Ordinance shall take effect and be in force from and after its passage,approval and publication. Passed and approved this 16th day of December,1921. Mayor, Ald Introduced nroduced a Resolution appointing Commissioners for Willow Avenue Improvement x District No.L. and moved its adoption, which was duly Sec by Ald Massie, resulted in the following vote Ayes Ald Ham,Harding,Ma.ssie,Stephens,Nayes none,Absent and not voting Ald Jackson,Price,PQa.yor declared the Resolution adopted and a copy is as follows.to-wit: RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF TIM CITY OF FAYETTEVILLE,ARKANSAS: SECTION 1. That Mardhall Douglas,Geo.Parker and Clem•PearsonM:three owners of real property within the limits of Willow Avenue Improvement District Number One of the City of Fayetteville,Arkansas,be,and they are herebg,appointed as the Board of Improvement for said District. Section 2. That this Resolution be in force and effect from and after its passage and approval. Passed and approved this 16th day of December,1921.
