HomeMy WebLinkAbout1921-10-21 MinutesJ Petitioners being present and represented by Honorable Allan .Wilson,Mayor of Fayetteville,x and the defendant, St.Louis-San Francisco Railway Company being also present and represented.by G.C.Hardin,Attorney, and J.E.Hutchison, General Managerr; and after hearing the testimoney and statements of the defendant and after considering the improvements proposed and submitted by said Railroad Company to the citizens of Fayetteville and•to the Commission. -the Commission is of the opinion that the plans proposed for repairing and improving the present passenger station at Fayetteville should be rejected, and it is so ordered. And now on this day, the Commssion having made an inspection of the present ' station facilities maintained by the Railroad Company at Fayetteville, and being well and sufficiently advised in the premises; IT IS ON THIS DAY ORDERED, that the St.Louis-San Francisco Railway Company be required to file with this Commission on or before the first day of January 19.22,plans for the erection of a new passenger station at Fayetteville,Arkansas, said station to be constructed of brick and the plans to provide for suitable and adequate waiting rooms for white and colored.passengers, with modern heating plant, said station to be in keeping with the importance of the City of ' Fayetteville and the business transacted by the Railroad Company at said station. The Commission retains further jurisdiction of the subject matter and parties hereto for the purpose of making a final.order,or orders, for the erection of said passenger station after plans have been submitted and approved, and for such further orders as may appear just and necessary. Ald Harding introduced An Ordinance to provide for the inspection of*Concrete Sidewalks,curbing and guttering and to fix the copensation of the Inspector. which was read the first time, whereupon Ald Massie moved that the rules be suspended and the Ordinance be placed upon its second reading, which was duly Sec by Ald•Harding, resulted in the following vote Ayes Ald Ham,Harding,Nlassie, Price,Stephens,Nayes none,Absent and not voting Ald Jackson,Mayor declared the Motion adopted. Ald Massie moved that the rules be further suspended and the Ordinance be placed upon its third reading and final passage, which was duly sec by Ald Ham, resulted in the following vote Ayes Ald Ham,Harding,Massie,Price,Stephens,Nayes none,Absent and not voting Ald Jackson, Mayor declared the motion adopted. AN ORDINANCE TO BE =r -TITLED " AN ORDINANCE TO PROVIDE FOR THE INSPECTION OF CONCRETE SIDEWALKS,CURBING AND GUTTERING AND TO FIX THE COMPENSATION OF THE INSPECTOR. " BE IT ORDAINED BY THE THE COUNCIL OF THE CITY OF FAYETTEVILLE,ARKAITSAS: av� Section One: That all contractors who shall.hereafter lay or construct any �c concrete sidewalk,curbing or guttering,shall pay unto the Collector of the City r of Fayetteville,Arkansas, a sum equal to five (5) per centum of the total cost of the construction and material of any such concrete sidewalk,curbing or guttering aAQQ which sum shall be paid in.full within one (1) week from the date of inspection of such work,as is hereinafter provided. Section Two; The office of Sidewalk inspector of the City of Fayetteville Arkansas,is hereby created,and the Mayor shall,appoint some qualified person to the office of Sidewalk Inspector,which appointment shall be confirmed by the City Council,who shall continue in office at the pleasure of the Council. t shall become the duty of the Sidewalk Inspector to carefully inspect T� �y (Ji'l ll concrete sidewalks,curbing or guttering that shall be hereafter constructed, C/ �� q/t and shall be present when such concrete sidewalks,curbing or guttering � being constructed,and shall require that the contractor constructing the same I strictly comply with the specifications heretofore adopted by the City Council for the construction of concrete sidewalks,curbing or guttering. y Section Three: Upon toe inspection of any such sidewalk,curbing or gutter- ing,the said Sidewalk Inspector shall deliver his written acceptance or rejection both to the property owner and the contractor in charge of the work.)The said Sidewalk Inspector.shall also file with the City Council a copy of his inspection, �together with the receipt of,the �City Collector for the five percentum of the total cost of the work inspected ;as provided in Section One hereof,and the Council shall thereupon direct the City Clerk to draw a warrant in favor of the said Sidewalk Inspector in the sum named in the Collector's receipt,which shall constitute the compensation of the Sidewalk Inspector. Section Four: Provided that nothing contained in this Ordinance shall apply to concrete sidewalks,curbing or guttering constructed and paid for by any improvement district. Section Five: Any person violating Section One of this Ordinance shall Cbedeemed guilty of a misdemeanor, and u on conviction thereof shall be phed by a fine of not less than Ten($10.00) Dollars or more than Fifty 00) Dollars for each offense. Section Six: That this Ordinance be in force from and after its passage, approval and publication and all Ordinances or parts thereof in conflict herewith,be and the same are hereby repealed. The following communication was read to the Council, to-wit:- Fayetteville,Arkansas, October 21st,1921. Honorable Mayor and City Councilman, City of Fayetteville. Gentlemen: - Referring to Resolution passed by the City Council,City of 690 Fayetteville,under date of October 18th,1921. This is to advise that we,The Southwestern Bell Telephone Company, accept this Resolution as passed. Assuring you of our appreciation of same°,I beg to remain Yours very truly, G.A.M.Johnson, Manager. The minutes of the previous meetings was read and approved. Aid Massie moved that.the City Attorney take steps to protect the City's interest in the Boles Will Case when it is probated, which was duly Sec by Aid Ham, resulted in the following vote Ayes Aid Ham,Harding,Massie,Price,Stephens, Nayes none,Absent Aid Jackson,Mayor declared the motion adopted. Aid Price moved that the Mayor appoint a Committee of three to check with the Telephone Co. of the number of poles and the total amount due the City to July 1,1922, and turn the statement and report over to the City Attorney who shall report the same to the City Council in writing, which was duly Sec by Aid Massie, resulted in the following vote Ayes Aid Ham,Harding,Massie,Price,Stephens, Nayes none,Absent and not voting Aid Jackson,Mayor declared the motion adopted. Mayor appointed Aid Price,Massie,and Harding as the Committee. Moved and carried to adjourne to meet subject to call. Approved: Mayor. Attest: Clerk, CALLED MEETING CITY COUNCIL HELD OCTOBER 28th,1921. Present Mayor,Clerk,Ald Ham,Harding,Massie,Stephens, Absent Aid Price,Jackson. The minutes of the previous meetings was read and approved. Mr Aumick was present and asked for a permit to build a residence, whereupon Aid Aussie moved that same be granted when he submits plans and specifications to the City Engineer and is approved by the Engineer, which w4s duly Sec by A Aid Harding, resulted in the following vote Ayes Aid Ham,Harding,Massie, Stepheiis,Nayes none, Absent and not voting Aid Price,Jackson,Mayor declared the motion adopted. The Committee appointed to check up the Telephone Pole License due the City handed in their report, stating the amount due the City msxtkH is the sum of $2219.25, whereupon Ald Harding moved that the reports be received and the.Committee be discharged, which was duly Sec by Ald-Massie, resulted in the following vote Ages Aid Han,Hagding,Alassie,Stephens,Nayes none,Absent and not voting Aid Jackson,Price ,Mayor declared the motion adopted. Aid Massie introduced the following resolution and moved its adoption, leving the tax assessement for the year of 1921, which was duly Sec,by Aid Stephens, resulted in the following vote.Ayes Aid Hem,Harding,Massie,Stephens, Nayes none,Absent and not voting Aid Jackson,Price,Mayor declared the Resolution duly adopted and a copy is as follows, to -wit: - RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS. SECTION 1. That the rate of taxes for Fire Department purposes for the year 1921,be and it is hereby declared to be One and One Half Mills on the Dollar of the assessed valuation of all real and personal property within the corporate limits of the City of Fayetteville,Arkansas,as shown by the Assessement Books for County and State purposes,and the same is hereby levied,and the Mayor and City Clerk of said.City are hereby authorized and directed to Gertify this levy to the County Clerk of Washington County Arkansas; to the end that the said assessment may be placed on the Tax Books and collected with the State and County Taxes, Section 2. That the rate of Taxes for City General purposes for the year 1921, be and it is hereby declared to be Five .Mills on the Dollar of the assessed valuation of all real and personal property within the corporate limits of the City of Fayetteville,Arkansas,as shown.by the Assessement Books for County and State purposes,and the same is hereby levied, and the Mayor and City Clerk of said City are hereby authorized and directed to Certify this levy to the County Clerk of Washington County Arkansas,to the end that the said assessement may be placed s on the Tax Books and collected with the Sgte and County Taxes, Section 3. That the rate of Taxes for City Hospital purposes for the year 1921,be and it is hereby declared to be One Mill of the Dollar of the assessed valuation of all real pxx and personalxpsspxty property within the x corporate limits,of the City of Fayetteville,Arkansas, as shown by the Assessemsnt Books for County and State purposese, and the same are hereby levied, and the Mayor and City Clerk of said City are hereby authorized and directed to Certify this levy to the County Clerk of Washington County Arkansas, to the end that the said assessement may be placed on the Tax Books and collected with the State and County Taxes.
