HomeMy WebLinkAbout1921-10-18 Minutes.f 1 4 ADJOURNED MEETING CITY COUIICIL HELD OCTOBER 18th,1921. Present Mayor,Clerk,Ald Ham,Harding,Massie,Price ,Stephens ,Absent Aid Jackson. This meeting called for the purpose of meeting with represent,ives of the S.W.Bell Telephone Co. in reference of the Pole license. Mr.E.N.McCall and G.A.M.Johnson was present and discussed the matter with the Council. The question was discussed by all present, whereupon Aid Massie introduced the following Resolution and moved its adoption,to-wit- 1 p,o W 149 RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILL ,ARKANSAS: That the City Agrees to accept on the following basis; Provided the S.W.Bell Telephone Co. within 30 days from date pay into the City Treasurery Pole Tax at the rate of 20� per pole for six months from July 1,1919 to December 2;t 3191919, from January 1,1920 to June 30th,1920 at the rate of 50� per pole per annum, from July 1,1921D to July 191922 at the rate of $1.00 per pole per annum and the costs of the suit todate, and it is further resolved tkt tkt that the City Council hereby agrees to pass an Ordinance making the license at the rate of 50� per pole per annum from July 1,1922 and to withdraw the suit now pending in the Federal Court. This resolution was duly Sec by Aid Ham, resulted in the following vote Ayes Aid Ham,Harding,Massie,Price,Stephens,Nayes none,Absent and not voting Aid Jackson Mayor declared the resolution duly adopted. Ald Ham introduced a Resolution xixg and moved its adoption ordering in concrete curb and gutters xtntaset on the East side of South Block Street which was duly Sec by Aid Massie, resulted in the following vote Ayes Ald Ham,Harding,Massie,Price,Stephens,Nayes none,Absent and not voting Aid Jackson,Mayor declared the reolution adopted and a copy is as follows: RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION ONE: That all owners of real property facing or abbutting on the East side of South Block Street between Rock Street and South Street in the City of Fayetteville,Arkansas, be,and they are hereby ordered to lay and construct concrete curbing and gutters along and in front.of their respective properties within twenty (20) days from the date that notice is served upon them. Said curbing and gutters shall be laid and constructed in accordance with the specifications heretofore prepared by the City Engineer of said City of Fayetteville,Arkansas, and filed with and approved by the City Council of the said City of Fayetteville,Arkansas, and shall be laid and constructed upon.the grade as the same is now established by the said City of Fayetteville,Arkanses. SECTION TWO: If any owner of real property as set forth in Section One of this Resolution shall fail or refuse to so lay and construct such curbing and gutters along and in front of their respetive properties within the time as stated herein, or shall fail or refuse to and construct the same in accordance with the specifications, as set forth in Section One hereof, then and in that event the said City of Fayetteville,Arkansas, shall advertise for sealed bids for One ll) week for the construction of such curbing and gutters, and shall award the contract for the same to the lowest bidder, after having given notice of one week of Intention to so advertise for bids to the owner or agent of any of the above described real property whose shall so fail or refuse to comply with this resolution,as set forth in Act 136, Acts of Arkansas,1909. SECTION THREE: That the City Clerk,be, and he is hereby ordered and directed to issue notice to the respective proeprty owners on the streets and parts of streets mentioned and set forth in Section One, and cause the same to be served upon said property owners. SECTION FOUR: That all Orders and Resolutions in confilict herewith, be, and the same are hereby repealed, and this Resolution shal take,effect and be in force from and after its passage and approval. Aid Massie moved that the Order of the Arkansas Railroad Commssion in regard to the building of the new Depot be spread of record, which wasiduly Sec by Aid Harding, resulted in the following vote Ayes Aid Ham,Harding,Massie,Price,Stephens, Nayes none,Absent and not voting Aid Jackson,Mayor declared the''motioneadopted. LOUIS SAN FRANCISCO RAILVIAY CO PETITION FOR A NEW DEPOT. At a regular session of the Arkansas Railroad Commission held at its office in the City of Little Rock, Monday, October 10,1921, CASE N0. 18. ORDE:3 . On this day comes the petition of the Citizens of Fayetteville,Arkansas, asking the Commission to require the St.Louis - San Francisco Railway Company to build and maintain more adequate depot and station house facilities for passengers and freight at Fayetteville,Arkansas, coming on for further hearing, the X187 i j Petitioners being present and represented by Honorable Allan Wilson,Mayor of Fayetteville,Irkmamm and the defendant, St.Louis-San Francisco Railway Company being also present and represented.by G.C.Hardin,Attorney, and J.E.Hutchison, General Managerrp and after hearing the testimoney and statements of the defendant and after considering the improvements proposed and submitted by said Railroad Company to the citizens of 'Fayetteville and -to the Commission. -the Commission is of the opinion that the plans proposed for repairing and improving the present passenger station at Fayetteville should be rejected, and it is so ordered. And now on this day, the Commssion having made an inspection of the present ' station facilities maintained by the Railroad Company at Fayetteville, and being well and sufficiently advised in the premises; IT IS ON THIS DAY ORDERED, that the St.Louis-San Francisco Railway Company be required to file with this Commission on or before the first day of January 19.22,plans for the erection of a new passenger station at Fayetteville,Arkansas, said station to be constructed of brick and the plans to provide for suitable and adequate waiting rooms for white and colored.passengers, with modern heating plant, said station to be in keeping with the importance of the City of ' Fayetteville and the business transacted by the Railroad Company at said station. The Commission retains further jurisdiction of the subject matter and parties hereto for the purpose of making a final.order,or orders, for the erection of said passenger .station after plans have been submitted and approved, and for such further orders as may appear just and necessary. Present Mayor,Clerk,Ald Ham,Harding,Massie,Price,Stephens, Absent Ald Jackson, Ald Price moved that the reports of the Special Disbursing Agent be received and filed, which was duly Sec by Ald Harding, resulted in the following vote Ayes Ald Ham,Harding,Massie,Price,Stephens,Nayes none,Absent and not voting Ald Jackson,Mayor declared the motion adopted. Ald Price moved that the Acct of the Dem Pub Co. be allowed and Clerk draw warrant for same which was duly Sec by Ald Harding, Resulted in the following vote Ayes ' Ald Ham,Harding,Massie,Price,Stephens,Nayes none.,Absent andnot voting Ald Jackson.1dayor declared the motion adopted. Ald Price moved to allow the Accts against the City for the month of September that have been O.K. by the Auditing Committee and Clerk draw warrants for same, which was duly Sec by Ald Harding, resulted in the following vote Ayes Ald Ham, Harding,lJassie,Price,Stephens,Nayes none,Absent and not voting Ald Jackson,Mayor declared the motion adopted.
