HomeMy WebLinkAbout1921-10-07 Minutes'r7 REGULAR MEETING CITY COUNCIL HELD OCTOBER 7th,1921. Present Mayor,Clerk,Ald Harding,Massie,Price,Stephens,Absent Ald Ham,Jackson. The minutes of the previous meetings was read and approved. A petition from a number of Citizens on South Duncan Street was read asking the Council to order in two Street lights on South Duncan Street,Ald Price moved to refer the same to the Light Committee with power to act and report at the next meeting, which was duly Sec by Ald Stephens, resulted in the following vote Ayes Ald Harding,Massie,Price,Stephens, Nayes none,Absent and not voting Ald Ham,Jackson,Mayor declared the motion adopted. Ald Harding moved that the Council hold a special" meeting October 14th to , settle the Telephone pole license question, which was duly Sec by, "Ald Price, resulted in the following vote Ayes Ald Harding;Massie,Price,Stephens,Nayes none,Absent and not voting Ald Ham,Jackson,Mayor declared the motion adopted. The reports of the various City Officals for the month of September was read, whereupon Ald Harding moved to refer same to the Finance Committee which was duly Sec by Ald Massie, resulted in the•following vote Ayes Ald Harding,Massie, Price,Stephens,Nayes none,x Absent and not voting Ald Ham,Hackson,Mayor declared the motion adopted. Ald Massie introduced an Resolutio# ordering concrete curbing and guttering in East Street Improvement District No 1: and Annex No 1. and moved its adoption which was duly Sec by Ald Price , resulted in the following vote Ayea-J'' ce, resulted in the following vote Ayes Ald karding,l(iiassie,Price,Stephens,Nayes none, AbseAt and not voting Ald Ham,Jackson,Mayor declared the Resolution adopted and a copy is as follows: RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF. THE CITY OF FAYETTEVILLE,ARSANSAS: SECTION ONE: That all owners of real property facilig or abutting on the following streets and parts of streets in the City of Fayetteville,Arkansas,to-wit: ' East Street,from the North line of Center Street to the South line of Dickson Street;Block Street,from the North. line of Center Street to the South line of Dickson Street;Meadowr Street,frop the. West line of College Avenue to the East line of Block Street; Spring Street,from the Vest line of College Aveneue to the East line of Block Street; and Center Street, from the West line of Block Street to the East line of School Street,be,and they are hereby ordered to lay and construct concrete curbing aux and gutters along and in front of their respective properties,within ten (10) days from the date that notice is served upon them. Said curbing and gutters shall be laid and constructed'in accordance with the specifications heretofore prepared by the City Engineer of said City of Fayetteville,Arkansas,and filed with and approved by the City Council of the said City of Fayetteville,Arkansas,and shall be laid and constructed upon the grade as the same is now established by the said City of Fayetteville,Arkansas. SECTION TWO: If any owner of real property as set forth in Section One of this Resolution shall fail or refuse to so lay and construct such curbing and gutters along and in front of their respective properties within the time as stated herein,or shall fail and refuse to lay and construct the same in accordance with the specifications,as set forth in Section One hereof,then and in that event,the said City of Fayetteville,Arkansas,shall advertise for sealed bids for One (1) week for the construction of such curbing and gutters, and shall award the.contract for the same to the lowest bidder,after having given notice of one,week of intention to so advertise for bids to the owner or agent of any of the above described real property whose shall so fail or refuse to comply with this resolution,as set forth in Act 136,Acts of Arkansas,1909. SECTION THREE: That the City Clerk,be, and he is hereby ordered and directed to issue notice to the respective property owners on the streets and parts of streets mention and set forth in Section One, and cause the same to be served 1 upon said property owners. SECTION FOUR: That all orders and Resolution s in conflict herewith,be,ancd the same are hereby repealed,and this resolution shall take effedt:t acid be in force from and after its passage and approval. KAld Harding introduced An Ordinance to levy an Assessement upon real property located in Annex No 2 to East Street Improvement District No.lo which was read the first time, whereupon Ald Massie moved that the rules be suspended and the Ordinance be placed upon its second reading, which was duly Sec by Ald Stephens, resulted in the following vote Ayes Ald Harding,Nassie,Price,Stephens,Nayes none, Absent and not voting Ald Ham,Jackson,blayor declared the motion adopted. Ald Massie moved that the rules be further suspended and the Ordinance be placed upon its third reading and final passage, which was duly -Sec by Ald Harding resulted in the following vote Ayes Ald Harding,Massie,Price,Stephens,Nayes none, Absent and not voting Ald Ham,Jackson.Yayor declared the motion adopted. ' AN ORDINANCE TO BE 'ENTITLED, " AN ORDINANCE TO 1EVY THE ASSESS PENT b?ON THE REAL PROP :;RTY LOCATED WITHIN ANNE% NUiVIBER TWO TO EAST STREET'i INIPROVENPENT DISTRICT NUMBER ONE OF THE CITY OF FAYETTEVILLE,ARKANSAS. " WHEREAS,the majority in value of the property holders owning property adjoining the locality to be affected,and situated in Annex Number Two to East Street Improvement District Number One of the City of Fayetteville, Arkansas,organized for the purpose of paving with Asphaltic or Concrete pavement,the streets and parts of streets within said Annex Number Two to East Street'Improvement District Number One of the City of Fayetteville, Arkansas,have petitioned the City Council of the City of Fayetteville,Arkansas, for the construction of•said improvement,and that the costs thereof,shall be assessed upon the real property of said district,according to the benifits to be received;and WHEREAS, said benifit received by each block,lot and parcell,of real property situated in said district,equals or exceeds the local assessement;and WHEREAS. the estimated cost of said improvement is $32,000.00. NOW,THFEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That said several blocks,lots and parcels of `real property in said district, be assessed according to the assessement list for said Improv- ment District, as the same remains in the Office of the'Recorder or City Clerk; �p and that 10 per centum on said blocks,lots and parcels shall be paid annually on or before the first Monday. of Idiarch,until the w1rakk whole of the said local assessbment shall be paid. SECTION TFIO: That all Ordinances and parts of Ordinances iniconflict herewith, be, and the same are hereby,repealed, and this Ordinance shall take effect and be in force, from and after its passage,approval and publication. Mayor. ii Ald Maasie introduced an Ordinance to provide for the permanent improvement of t the intersection of certain streets which was read the first time, whereupon Ald Price moved that the rules be suspended and the Ordinance be placed upon its second reading, wh1ch was duly Sec by Ald Harding, resulted in the following vote,Ayes Ald Harding,Idassie,Price,Stephens,Nayes none,Absent and11 not voting Ald Ham,Jackson,Mayor declared the motion adopted. Ald Price moved that the rules be further suspended and the Ordinance be placed upon its third reading and final passage, which was duly Sec by Ald Harding, resulted in the following vote Ayes Ald Harding,Massie,Price,Stephens,Nayes . none,Absent and not voting Ald Ham,Jackson,Mayor declared the motion adopted. AN ORDIN_4NCE TO BE ENTITLED ," AN ORDINANCE TO PROVIDE FOR THE PERMANENT IMPROVEMENT OF THE INTERESECTION OF CERTAIN STREETS WITHIN THE CITY OF FAYETTEVILLE,ARKANSAS, AND FOR OTHER PURPOSES. " WFEREAS,there has been formed and created within the corporate limits of the City of Fayetteville,Arkansas,a certain improvement district,known as Willow Avenue Improvement Number One of the City of Fayetteville,Arkansas;and WHEREAS, it is the policy of the City of Fayetteville to.ai& in constructing and maintaining permanent streets, constructed under the Improvement District plan;0- and WHEREAS, the City of Fayetteville has assumed part of the expense of improv,eing streets in other Improvement Districts. NOW,TIEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE ARKANSAS: G�oS 686 '=7 SECTION ONE: That there is hereby appropriated out of the General Street Fund of the City of Fayetteville,Arkansas, the sum of $7500.00 or so much thereof as may be necessary,to be used by the Board of Commissioners of Willow Avenue Improvement District Number One of the City of Fayettevilie,Arkansas,in permanently paving the intersections of all streets, and otherwise permanently improving all streets within said Improvement District. SECTION TWO: That the City Clerk of the City of Fayetteville,Arkansas, be, and he is hereby instructed to draw ten warrants of equal amounts,in favor of whomsoever said Board of Commissioners may designate,and at such time as said Board may request,not to exceed in the aggreate,however,the sum of $7500.00. Said ten warrants shall be drawn serially,so that one warrant shall become due and payable each year after date of issue. ' SECTION THREE: That all Ordinances and parts of Ordinances in conflict herewith,be, and the same are hereby, repealed, and this Ordinance shall take effect and be in force, from and after its passage, approsml and publication. Mayor. , Ald Harding moved that the mat ter of inspection of curb and gutter be referred to the Street Committee and report at the next meeting, which was duly Sec by Ald Massie, resulted in the following vote,Ayes Ald Harding,Massie,Price, Stephens,Nayes none,Absent and not voting Ald Ham,Jackson,Mayor declared the motion adopted. eft Ald Harding moved that a permit be granted to Earl Bates to build a residence subject to the approaval of the City Engineer, which was duly Sec by Ald Price, resulted in the following vote Ayes Ald Harding,Massie,Price,Stephens, Nayes none,Absent and not voting Ald Ham,Jackson,Mayor declared the motion adopted. Ald Price moved that the Mayor be instructed to see the Commissioners of Public Square Improvement District No -1. in regard to paying a fee to Mr Hurst,which was duly Sec by Ald Massie, motion put and carried. Ald Massie moved that Ald Harding act as President Protem, which was duly Sec by Ald Stephens,resulted in the following vote Ayes Ald Ham,Ffassie,Price,Stephens, Nayes Ald Harding,Absent and not voting Ald Jackson,Clerk declared the motion adopted. Ald Harding takes the chair. Mr.O.Lollar was present and asked for permission to cut sidewalk to put in a sewar line and replace the sidewalk, whereupon Ald Price moved that the City grant the permit subject to approval of the City Engineer, which was duly Sec by Ald Massie, resulted in the following vote Ayes Ald Ham,Harding,Massie, Price,Stephens,Nayes none,Absent and not voting Ald Jackson, Acting Mayor declared the motion adopted. The qquestion of the pole license of the Telephone Co came up and same was discussed by all present, whereupon Ald Massie moved that the Chairman and a Committee be appointed to confer with the Telephone Co and they be authorized to propose•to the Telephone Co a.compromise as follows; The Telephone Co to pay faxxEmmhfrom January 1919to July 1,1919 at the rate.of 30V per pole per year, from July 1919 to July 1920 at the rate. of 50V.per pole per year, from July 1920 to July 1921 at the rate of ij3� 01.00 per pole.per year, and from July ' lst,1921 to July 1st 1922 at the rate of $1.00 per pole per year, and the Committee be authorized to offer a rebate, not reducing the total below $2000.00 if paid within 30 days, which was duly Sec by Ald Price, resulted in the following vote Ayes Ald Ham,Harding,Massie,Price,Stephens,Nayes none,Absent and not voting Ald Jackson,Acting Mayor declared the motion adopted.
