The minutes of the previous meetings was read and approved. is J.W.Grabiel was present and presented a Petition to the Council asking that the Council take steps to repeal the Ordinance recently passed narrowing Walnut Street which was signed by J.W.Kemp and others, upon motion of Ald i.Tassie the petition was received and filed and a committee be appointed to investigate the matter, this motion was duly sec by Ald Ambrose, resulted in the following vote Ayes Ald Ambrose,Ham, Harding,Irlassie,Stephens,Vlages, Mayes none,Absent and not voting none, Mayor declared the motion adopted. ±hEx=i repmrt sxof .dzhuxyaxi=sxC±tXK2±f±mKtxx Ald Harding moved that the reports of the various City Officals for the month of December that have been O.K. by the Finance Committees be received and filed, which was duly sec by Ald Ham, resulted in the following vote Ayes Ald Ambrose,Ham,Harding, i.iassie,Stephens,''Vages,ITayes nons,Absenf and not voting none,i.ayor declared the motion adopted. City ';later was analyzed every two months ,the last being made December 20th,by Dr Bleeker of the State University who pronounced the water to be in a,state of purity. 33 cases notified to clean up and complied except James McCormick he being away from the City and unable to reach after. a month learned that he had been very ill. 7 daries inspected and reinspected and found in as good condition as could be expected, 2 violaters of City Ordinance fined,l for slaughtering cattle,ana the other for keening a hog. 3 of City water pipe reported wasting,same was reported to i.Ir Duggan + who after investigating made proper repairs, the toilet rooms in the Public Schools are in fairly good order. Ald 'cages introduced the following resolution and moved its adoption, towit: ;THL] XS, on the 5th day of Iiovember,1920, a petition signed by more than ten owners of real property was presented to the Council,reouesting,that steps be —� taken to form an improvement district to embrac: the property described therein_ set forth; and '.'IIT✓Rr_,S, cn the 3fd day of December 1920,an Ordinance i?u;:bered 410 was passed, forming the said district as set forth in the above named petition; and :TtiiR _S; on the 7th day of January 1921, a petition was presented to the said Council,signed by persons claiming to constitute a majority in assessed valuation of all real property located within the district as set forth in said petition and ordinance aforesaid; and WIT,R31S, the Council ordered and directed the Clerk of the said City to publish a notice once a creek for two weeks, advising all persons that on the 21st day of January,1921, the Council would take that last named petition under consideration, and would at that time determine whether or not same was signed by the majority in assessed valuation of all real property within said district, and as same was so published in accordance with lase; 1:107i ,TH:sR:FOR-: Bl: IT RlSOLV�3D BY TIE CITY COUITCIL OF `1'F: CITTY OF FAYBT.F.VILI. n3K iITS:,S ; That,after careful consideration,the Council finds that there is a total assesed valuation of ti?148,445.00 of real property within said district, ac.;ording to the last assessement on file in the Office of_the.Clerk of 'Jashington County, Arkansas; and that persons signing said petition owned real property riithin said district, of an assessed valuation of 5p'81,585.00, according to said assessement. NW I L I It is,therfore,the finding of the Council that the majority in assessed valua tion of owners of real property within Willow Avenue Improvement District Number One,have signed said petition; and the said district is hereby duly formed by the said Council., - In the consideration of the said petitions the Council has bean guided by the certificate of the Circuit Clerk of said County as to ownership of said real property i and by the certificate of the County Clerk of said County as to the assessed valuation of said real .property. - That this resolution be in force and effect from and after its passage,and all resolutions in conflict herewith be and the same are hereby repealed. The following was read to the Couneil,to-wit: Declaration of Surrender of Franchise, by the Fayetteville Gas and Electric Co. of the City of Fayetteville,Arkansas, State of Arkansas; County of Plashington; To the City Council of the City of Fayetteville,Arkansas and to the Arkansas Corporation Commission E.C.Smith and V..idcDaniel,as President and Secretary respectively of the Fayetteville Gas and Electric Co. do hereby declare and certify that the said Fayetteville Gas and Electric Co. is a corporation,furnishing light,heat and power by electric current to the inhabitants of the City of Fayetteville,Arkansas, and to other communities, under a license,permit or franchise heretofore,'granted by said municipality of Fayetteville, which said franchise is unexpired. + That the said Fayetteville Gas and Electric Co. doth hereby surrender its said license,permit and franchise contained in the Ox&*u-nn Ordinance of the City Council of the City of Fayetteville,arkansas,approved on the 16th day of _ugust,1913 and Ordinances supplimentary thereto. That this surrender of franchise is made pursuant to the terms of the Act of the General Assembly of the State of Arkansas,approved April, lst,1919, b:.ing Act Dumber 571 and this certificate made by due and lawful authority obtained from a resolution adopted by the Board of Dirrectors of said Fayetteville Gas and Electric Co.,which action of the Board has been duly ratified by the Stockholders of said Corporation. In testimony thereof,said Fayetteville Gas and Electric Co.,has caused this testiment to be executed by its President and attested by its Secretary in the City of Fayetteville,Arkansas,and the Beal of the said Corporation to hereto affixed on this 5th day of January 1920. ',7hereu_oon Ald Harding introduced the following resolution and moved its adoption, to -Tait: Resolved, That in as much as the Fayetteville Gas and 'electric Company, (a corporation doing business in FayettevillI.Arka.nsas,) did on the 5th day of January 1920 in writing by its President and Ha.nager tender its franchise to the City Council of the City of Fayetteville and did ask the Ta7±Xft±sgE privilege of surrendering the said -franchise and releaseing the. City of Fayetteville from any of its obligations under the said fr_.nchise.. I . The City,Council does noir accept the surrender of the said franchise and re•leaaes the said Fayetteville Gas and Electric Company from any and.all of its _rrovisions.
