AN ORDINANCE To fix and establishethe City license fsr theatrical companies giving drama
tic or operatic performancee_within the -City --of Fayetteville,Arkaneas.
BE IT ORDAINED BY THE COUNCIL OB THE CITY OF FAYETTEVILLE$RKANSAS:
Section one:. That the city lioness for all theatrical companies giving operatic or
" dramatic performances within the coporate limits of the said city"ehall be Ten Dollars
($10,00) for each single day during which any such performances shall be given,or Twenty
--- five Dollars ($25.00 for six (6) consecutive daya,regardless of -the number of performances.
Provided that nothing herein contained shall be so construed as to apply to bona fide
amateur performa,nces-,-or--performances given purely for cha.ir.ity,or-for any -performances
given in a duly licensed?opera house or theater.
Section Two. That the license provided for in Section One hereof shall be collected and
der accounted for in the manner prescribed for the collection of all other city licensee,

to the dep6t and investigate and remove the trnafer offices of the trndfer companies from

The Bond of the Treasurer was handed in and read,whereupon Ald Ambrose moved that
the Bond of Mr Hulse be approved which was duly Sec by.A1d Harding.resulted in the.follow

The Application of Mr Paul Mueller for the position of City Engineer was read,whereup

Ald Harding from the eomrittee that was appointed to investigate the Hack Stands at
the depot reported that they had investigated_ the_ matter and thought they make

The Application of Mr E.Aumick was presented to the council aor the position of City
Wagon Yard keeper whereupon Ald Harding moved that the application be referred to

on Ald Phillipe moved that the resignation be accepted,which was duly Sec by Ali Harding

and not voting Ald Cornwell,Ma.sale,Mayor declared the motion adoped. Mayor appointed

-to obtain a permit before excavating any -street or alley within the coporate limits of
the City of Fayettevilb,Arkaneas, which was read the first time,Whereupon Ald Phillips

ing any street or�,alley within the coporate limits of the City of Fayettevilbe Arkansas. ,
BE IT ORDA.WED--BY.-THE COUNCIL_.OF THE CITY OE_FAYETTEVILLE,ARKANSAS: -
cti No person,firm or coporation,or agent,officer or other repiesentive of any
jccvirr�ai improvement district operating any sewar sytem,water sytem or other u###### utility,or any
other person or persons 71iomsoever,except the duly -appointed and a:abtAgg•�Strebt•eamitleedoser
shall excavate or cause to be excavated any -public street or alley within the coporate limit
of -the said City', except as -herein provided. - - —
Section 2. No person,fdrm or coporation,or agent,officer or other repreeentive of any
r improvemnt district -operating any sewar sytem,water sytem or other utility,or any other
WYrr person or prsons except as herein provided,shall excavate or sauce to be excavated any public
street or'alley within the coporate limits of the said -City -without first having obtained
from the Street Commissioner a written permit therefor, which permit shall state the location �.,.
width,depth and number of lineal feet of the proposed excavation and the pd:rpose.for which _
t�i�i�######r proposed excavation, is to be made, All measurments shall be be.sed from the curb
line,excepttwhere the excavation runs parallel with the curb. .
Section'3.-Before any such permit shall be issued;mthe Street Comdssioner shell receive -
from the applicant a. cash forfiet of not less than Seventy Five Cents (.75) or more the One
-Dollar Fifty Cents -($I.-50) for- each' lineal foot to be excavatedwherethe proposed excavation
is to be made into the surface of any macadamized or paved street or alley; and not less
than Twenty Five cents-(*-25)-or more then One Dollar -($1..00) for each lineal foot to -be exca - -
vated into'the surface of any street or alley not macadamized or paved.
v_ The_ amount of all forfeits _shall be fixed by the Street- Comrdse ioner- in' o. sum sufficient
to indemnify the City against loss in the event the stret or alley is damaged by
reason of the excavation,.The Street Commissioner shall also fix the time in which any street _
or alley so excavated shall be•repaired to his satisfaction.- -
Section 4. The Strebt Commissioner shall -inspect all streets and alleys so exca.va.tedIn,
t� and if not -replaced in-as-good-,condit ion as before such --exca.vation- was made within the time
limit as fixed by the said Street Comdesioner in the permit,it shall then become the duty of
l a the said Street -Commissioner -to -repair the -a tre.t or alley_ so. -.excavated in as _good condition.
Ln��► as before such excavation was made ,paying therefor from the cash forfeit received from the
person"or coporation causing -the excavationto be -made and returning the remainder,if any to

Section 5. The Sure< -et Commissioner shall -be authorized toc issue blanket or emergency
permits to-ecavate# -any -etre et or alley which blanket or -emergency ermit shall authorize --thee
�(���,i excavation of not more than Fifty (50�) lineal feet within Ninety (90 days from the date of 'OAN`t!"• issue of such permit#,and shall require a forfeit therefor -as -hereinbefore provided. - - -
.�tt The holder of any such blanket or emergency permit shall report to the Street Commissioner
within 24 hours any excavationsomade.,givirg lacation_-and-amber of-lineal.feet excavated,_
wand in no case Shall any excavation be made in excess of the number of lineal feet allowed
in the permit* Repairs shall be made by the Street Com_ds_si_o_ne_r as_provided in -section-4 of this Ordinance.
p, Section 6. Any person,Persons,firms or coporation violating any of the provisions of
this ordinance shall be deemed guilty of.a rn###### misdemeanor and upon conviction thereof-
