D.Locke, its President,- _ - - - « - - - -- - --- - - - --- ---- — --- ---- - - -- - — - -- -- --- ---- -- submitted and presented to the Council the following communication and proposition - - A • " To the -City -Council of -the` City -of Fayetteville, rk:61 - - -------- If Fayetteville, Ark., Aug. 16th, 1913., In the event that the City Council shall pass ordinance now pending, granting -to the Fayetteville Gas& -Electric -Company a twenty-five year :franchise, as set forth in said ordinance, and in the event said ordinance is accepted and - - "becomes effective, the Company hereby agrees -as one. -o£ the considerations -for- said--franchi-se-- to furnish free of charge to the City Hospital of the City of Fayetteville, so long as it is --_ «-owned and operated by -the- City,- electric -current --sufficient -to-supply the -needs -of--said----- --- IHospital, except'ifor heating -and cooking purposes with electric, stoves, during the life of said franchise, and -agrees- if -said _-franchise_is-accepted,-and. becomes effective.,. to -embody Iain its acceptance of said franchise, a covenant to furnish said free current -as aforesaid T which shall be binding upon its successors --and assigns_. - ' II, Fayetteville Gas &Electric Company, By Geo.D.Locke, President. Sour moved that the rules be f rthe suspended and the ordinance granting the franchise to said Fayetteville Gas & Electric Company as above mentioned, be *read the third time and placed upon its passage, which motion was duly seconded -by Aid. „Phillips and.adopted by_the_following vote,_ "Ayes",_ Cornwell,_ Eason, Price, Phillips, Sour and Wright, "Nays",_ none, absent__ and not voting, none -and -said _ordinance _was _read -the third time - the question now being shall the ordinance pass_? The roll was called and the followin members voted "Aye" - Cornwell, Eason, Price, Phillips, Sour and Wright, "Nays", none, absent and not voting, none. The same having received the unanimous vote and concurrence of all the -- members elected to the Council _was.therefore_declared to be passed and adopted and a copy is as follows:- " Ordinance No. 317.,. ,An ordinance granting certain rights, privileges and-granchise"s to the Fayetteville Gas & Electric Company -for lighting the streets, alleys, parks and other public places in the City 200, SECTION 5. The Fayetteville Gas & Electric Company, its successors or assigns shall maintain an office in the City of Fayetteville, Arkansas, and shall at all -times during the existence of th@ franchise furnish to the City free of cost current for not exceeding ter, electric lights of 16 candle power each for lighting the City Hall and building occupied by the Fire Department. SECTION 6. The said Fayetteville Gas & Electric Company shall at all times maintain its poles erected pursuant to the authority hereby,given in good,condition.and repair, and in etttnging and maintaining its wires upon said poles it will at all times keep the same insulated in accordance with approved practices under similiar conditions, and shall at all times afford good and efficient service unless prevented -by unavoidable casualtyot - RECTION 7. The Fayetteville Gas & Electric Company, shall, on or before January 1, 1914, at its own expense, furnish, erect and thereafter maintain, 12 modern metal electric light poles on the public square of the City of Fayetteville, at such points on said square as may be designate by the City Council of the City of Fayetteville, and also 3 modern metal electric light poles on Dickson Street in said City, at such points as may be designated by the City Council of the City of Fayetteville. p ' SECTION 8. This ordinance shall begin force and effect after its- acceptance and publication by the Fayetteville Gas & Electrid Company, its successors or assigns, which acceptance shall be filed in writing with the City Clerk of the City of Fayetteville within 10 days from its passage SECTION 9.
