' Fraser of Dallas; ; Texas -and associates, the right to -construct, maintain; use and operate a street railway or railways, together with power plant for the purpose of operating and maintain_ ing a system of elec,tric.curren.t for the production of motore power and -electric lights, in the - + City of Fayetteville, and State of Arkansas,, and defining the powers, privileges and restriction under which rights shall be execrised. Be it ordained'by_the Council of.the City of Fayetteville, Arkansas - Y Section'il. • That authority and consent is hereby given and granted to and duly vested in W.A. The surface of the street or streets over which the linee..of said railway shall pass lying withinjand fora--distance-of twelve inches outside -its rails -and tracks. ejall be by said - grantees, their successors, heirs or assigns, kept in good order and repair and the rails of said track.shall not -be over three_quarters of -an inch above the surface of the street and where the - tracks are laid on either aide of the street, said track shall be laid on a level. with.the grade off the 'street; said tracks shall he laid in such parts of the streets as-the-Council.of the City _ shall determine and it ie hereby made encumbert upon the Council of said City to determine the ' location,of ouch track within ten days after receiving notice in writing -from the engineer of said granteesP, or any officer thereof, their successors, heirs or assigns so to do, and in case the Council lof said City shall fail or refuse to determine the location of such track.within such per >iod of ten days, then -the -said grantees, their successors, heirs or assigns may-Tocate and lay euch tracks in such location as they may determine or select; provided, that within ten days after thel locationrof said railway line or any extension thereof, for'as much as one block •in -length, or an - change in the location thereof, the said grantees,. their successors, heirs or assigns shall file Or cause], to.be_filed,in_the-office of the. Clerk of said City a correct map.and-profile thereof. - �-Section 4. The Council shall have the right to order said grantees, their successors, heirs or assigns to make such necessary repairs between their tracks and for a distance of twelve inches on the outside thereof ae•it may be necessary and proper and.if said grantees their successors, heirs orljassigne do not make such repairs within thirty days after she notace so,to do, the Council may cause such-re'paire to be made and charge the resonabb expense thereof -to the said grantees, their successors, heirs or assigns and hold said grantees, their successors, heirs or assigns liable therefor, and all such repairs made under order of such Concil shall be made under - its direction and to its satisfaction. WI(H 5 Section 5. ..:Whenever said Council shall order the whole or any --part, including as much as one block off and on the streets over which the tracks of said railway may pass, paved, the said their successors, heirs or assigns shall pave between and for a distance of.twelve „grantees, inches outside the rails and tracks thereof in such manner and within such time as may be orde ed by the Council of the City of Fayetteville,, but said grantees, their successors, heirs or " assigns shall: -not -be required- to pave in a different manner with a different material than the remainder of such block or street is required to be paved, nor in such manner or with such -material as•will—unreasonably interfer of getting free access to or the making of the repairs for cross ties, rails, ground wires or other properties of said grantees, their successors, he rs or.assigns,.which may.lie within them and upon the -streets -of said City. - Section 6. If it shall become necessary to re lay or re place the rails or any other proper y of said grantee, their successors, heirs or assigns within or upon the streets of said City, the same shall be• relaid or replaced}n such manner as shall least interfer with public travel on said street or streets and the grantees, their heirs, successors or assigns shall relay or re— place the same at -their own expense and shall remove all dirt and -filth from such partsof the street or streets as may be occupied by the tracks of said railway as occassion may require. • Section 7. The -said grantee, their successors, heirs or assigns shall have the right to use the trolley system of electricity or storage battery or compressed air or steam or other motive „power and may ele.etrictly heat,, -light and communicate with their own offices, builddngs and ca e and such other buildings and streets as ihhey may from time to time determine so to do and may ' erect and maintain,poles, wires and other appartus necessary and suitable therefor and if deem d 'nece'esary by them, their successors, heirs or assigns lay and maintain electric ducts and con— duits for the carrying of such wires and appartus as may be necessary, all power privileges an poles along said streets and through fares shall comply with the requirements of any ordinance ,now or which hereinafter maybe enacted, not in consistent with the terms of this franchise and ^ordinance, for the necessary regulation of the same on such public through fares. Section 8. The cars or other vehickles operated or controlled by the said grantees, their i.-successors,'.heirs or -assigns shall at all times be entitled to an.un—interrupted right of way over their track of railway and persons and vehickles upon said tracks shall pass over and away from same as as possible and leave the same,-un—obstructed. -quickly Section 9. Said City of Fayetteville expressly reserves the right and power by its Council to make such reasonable rules and regulations governing the operation of cars, upon said railw y " ''track and regulation of passenger and other traffic thereon not in—consistent with the terms o this franchise and ordinance as said Council may deem necessary for the protection of persons - ..and property and -as the conveniences of the publicandthe interest and rights of the grantees and their successors and assigns may demand. .Section 10. The said grantees, their successors, heirs or assigns -shall have the right durin the continuance of this franchise to fia and collect their fares for the transportation of pas engers, but'the City of Fayetteville, expressly reserves the right and power by its Council to fix reasonable.regulations concerning transportation, children under six years of age, when 'accompanyed by a passenger who pays full fare,policemen, firemen and United States Main Carrie in uniform, .shall be carried free; rpovided however, that -such rates of fare may not be by said Council fixed below five cents for full fare for one continous passage within the limits of mi + ;City, not below three cents for a half fare for school children -using same within reasonable ;hours. ' 4Section 11. If -any person shall refuse to -pay his fare.or refuse to obey such regulations as maybe established for the convenience or e�%4,9f safety of passengers it shall be lawful for the person in charge of any car to remove the person so refusing from the car, or .in case it shall become reasonably necessary to protect the passengers on any car from violence, abusive profane or indecent language or other disorderly conduct of any paseenger,.a conductor or other person or persons in charge of such car is hereby authorized and empowered to force by removeable such person from the car and if considered necessary to hold, arrest and deliver such person or persons into the custody of some proper officer for arrest, detention or pro_ secution and for the purposes above mentioned such conductor and persons in charge of any car or cars maybe created special policemen of the City of Fayetteville. Section 12.- Said grantees, their successors or assigns are hereby authorized and may make any reasonable extensions of their lines of railway and electric lines within the limits of Fayetteville as the Council may authorize and'over all streets or parts of streets where the 'tracks of the said grantees, their successors, heirs or assigns may be authorized hereunder or by any extension or modification hereof asked for by said grantees, their successors, heirs c assigns and accented to or authorized by the Council of said City of Fayetteville and the righ of the said grantees, their successors, heirs or assigns to use said streets or parts of streets for railway purposes shall be exclusive against other railway companies only. »Section 13. Thepowersand privileges_ conferred by the provisions -of this -Ordinance and Franchise.shall be limited to fifty years from and after its passage. p,Section 14.' Said rail way shall be substantially completed and built of good and sufficient material to make it a'good and substantial road and to began construction on or before January 1, 1913, after the adoption of this Ordinance; and the said grantees, their successors, heirs or assigns shall -complete the section of line between the East Mouttain, Square, Pepot and ' University property within one year from date of commencing construction. Section 15. This -Ordinance and grant shall take immediate affect from and after its -passage but shall become void and of no effect unless said grantees, their successors, heirs or asnign ishall within thirty .days from the time of its passage, notify.the.Council in writing of their acceptance of the provisions herein catained to comply with the terms and requirements of thea proposed undertaking with the people of Fayetteville, Arkansas. Sec. 1. That the owner or owners of property abutting on College Avenue between Center Stree .and Maple Street be_.ard..they are. hereby -required to construct or reconstruct concrete side walks and curbs do front of their. respective properties along said College Avenue tzithiri thirty (30) days from the passage and publication of this Ordinance, and the service_of notice as herein required. Sec. 2., That said sidewalks shall be constrcuted in the manner and of the material required --by the existing ordinances -of this City, That all sidewalks from Center Street -to Dickson shall be laid from property line to curb. That all walks from Dickson Street to Maple Street shall be -a ix feet wide -extending-from property line out the -required -width. - The curbs on the West side of College Avenue shall be set in line with the curb do ,front of the. -Presbyterian -Church. The curb on theEastside from Center Street -to Dickson Street shall be set the same distance from property line that it now is. And the curb on the East aide from Dickson Street to Maple shall be set in line with curb on East side side from Dickson Street io Center Street, all curbs along said street shall be of concrete, set and batted,as required by existing City Ordinances, curbs attached to walks shall be four inches thick and curt detached from walks shall' -be six inches thick. The said -curbs shall -be not -leas -than twelve inche in depth. The curbs on either side may be increased to such depth as may be approved by the In_ -spector',of aide walks: - --- - - -- - - - Sec. 3. That all trees on street shall be removed and said sidewalks and curbs shall be con- :structed.upon the. grade_her.e.tof.ore-or hereafter to -be established -.on said --street and shall --be wel built and carefully maintained, according to rules and regulations heretofore prescribed or that may be hereafter prescribed by_the City Council and subject to -approval of _the Inspector of Sidewalks, or the person duly authorized fior the time'being to act as such. Sec.4 That any person required by the provisions of this Ordinance to construct or re- construdt any sidewalk-or`aurb--along either side of said Coleege Avenue and who -after due notice of the requirments herein made shall fail or refuse for a period of thirty days to comply wilk -therewii,h- shall- be- guilty -of a misdemeanor -and- upon -conviction thereof-,, shall -be punished as pro vided in' Ordinance No.236, approved Sune 12, 1908, and it is hereby made the duty of the Inspecto of Sidewalks or the person_f.or_the time -being acting as such to serve. -the notice herein required and in case of any failure to comply with the requirements of this Ordinance for a period of thin days after receiving required notice it is hereby made the duty of such Inspector of Sidewalks to iMa:pmk promptly file information against such offender with the Police Judge.
