F. Greer, in regard to the rent claimed by the County due from the City, towit :- " Fayetteville, Ark. Sept. 1910 - To The Honorable City Council _15th, ,_--Gentlemen -µ In the matter of the settlement between the City of Fayetteville and Washingtnn County, it seems that the propositions which I have made to the City 6or settlement of this matter "is-not-unde-retood-, therefore I --make this in writing, that there may be --Ho further miaundeista.ridin - - Under a Contract made and entered into by, and between the City of Fayetteville and Judge - --Berry some-yearsa.go the -City -agreed to pay to the County $500.00-p,er-year fora -period of -1x9 s- - '10 years for 2 rooms in the basement of the Court House to have the use of the rooms 20 years, t e _,.City issued.and turned•oue.r_to- the -Treasurer . of the County, ten-warrants-calling.--for-$500..00 each - --- These warrants are due as written or printed on their face on the 1st or 15th of July of each I do- not remember- which;- the_City is„now,.in_ arrears three years_ on these_warran_ts., that_ is_- _,year-,_ there are three warrants past due; the City and Judge Williams it seems made a supplemental con- _ tract reducing the payments to $2.50.00 per year fuom the date of same, but such contract is not df - -- - - -- record. rior did the- City call for -arid take up the old warrants calling for $500.00�each and issue - in their stead new ones for $250.00, unless they did so some months after this so called supple- --- -”mental -contract was- made-.--My-propos it ion -to-the City, is-thi-s,-that 'if --they will pay -the -County --- $750.00 on the three years they are in arrears that I will enter into a new contract reducing th --- »balance--of--the payments -to -$250.00 -per year -during the time -they -were--drawn-for; -in-view-of the-------- he-- -- 'fact 'fact that the City has had the use of the two rooms and the valut in addition thereto I feel tha _ ..„this- is- a- fair._ propos it.ion.._Now_-in-addition -.to_ this there -is -one _st,ipulation_ that _I _have ask ed -the—_. - City to agree to before I could agree to make the contract mentioned above, that is that the Cit authories agree to not claim any part of the_levy made for " Special.Bridge Tax °, it seems that _ the City claims that they are entitled to four-fifths of the Special Bridge tax collected in the City under an Act passed at the last session of the Legislature, the situation is this. " This -s givs-to`the- City four fifths of''the Road- and Bridge -Tax --coltected --in- -the -City, -and since -th give -- - - passa.ge of this act they have received the four fifths as provided by the act referred to, but the - .4.Levying Court -levied a-Specis-1 Bridge Tax -for -the purpose -of-paying- outstanding -debts constructe - in building the Steel Bridges erected during the close of Judge Williams administration, the Cit _,_i5 -claiming -_f our _fifths. o.f- _this__tax,_ which I do not think—they—are en.t_ltled .to -as _this levy is.—nit, fot Road and Bridge purposes but for Special Bridge purposes; I am sure that it was not the inte, 'tion of the_Legislature whomade the law to give the City four fifths of the Special Bridge tax_ collected in the City, and if the Oity contends for it it will mean t.that there will be no more bridges erected in the County while the City authorites take this view of the matter. The Levyin -"Court has said that they will not- make -`a -levy to build -even the -four bridges under contemplation I - unless the City will recede from this stand and agree to bear her part of the burden. I do not , --believe for- a -minute that -the -City has any right to a -cent-of -this fund, and think- they -are -mak -i g - a grave mistake to contend for it. The City will derive more direct benefit from the erection of the.bridges._undex -contemplation than all the -rest of the .axakiaxxxx-.County.._and_I-think should-b.a.r--- .-- 'her part of the burden; I do not think it wise to agitate this matter, and for that reason I wis ;to the whole matter_ adjusted before the. s_ Levying Court meet. _as I have said going to_ _get -they_a.re four steel bridges in the next threeorfour years, if this matter can be settled before ltuild ithe next meeting the let Monday in October, I am sure that a levy will be made and one or two of --the bridges built next -year. If -the City -persists in demanding -four -fifths of the -Special ---- Bridge levy it will create a feeling a*long the people do the County at large against the City. I -I- felt-for-a--monent that -the City was -entitled to any -part -of this money under -the law -I could-- - - not say a word, but I do not feel that you are entitled to it under the law and if the law gave -.-it-to you h --could not but --feel -that-the law -was -unjust,--for-in building- the -Bridges -do'-much need(d-- -- justice would say that the City should bear her share of the burden, Springdale, Paairie Grove , _„Lincoln. and._the other._incorl) rated_ toWns_wauld Yi_ith_as_mush-justice,say-."_give.-us._our_ share --of-the Special Bridge Fund, Etc. " - Gentlemen, I feel a deep interest in the welfare of the City of Fayetteville., and - wining- to-do anything -iii my povier to help build her up, but-I-fear'the effect -of a policy like - -- this, it will surely engener a keeling against the town than can do it no good, therefore in --justice to -the -City as well -as -the -County at- largg-I-ask--you-to-give-this-matter--your earnest -------- attention and Is t us get it settled up before the meeting of the Levying Court in Oct., of if - this- propos-it-ion -does not -appeal- -to- you -as- being-a-j-ust-one-,---if---the._City-will -vacate-the-rooms--------- in the Court House within the next six months, and give the County full possession of same I am _*w ill ing_ to enter_ -into a__contract to deliver the City warrants which„ the. County holds the _to__ _City ,the day they vacate the rooms and give us possession thereof. Sour from-the_Auditing_ Committee reported -the account -of..Hill_City_Lbr..-Co-.__f. $1.65, for material furnished the Street Commissioner, examined and found correct and moved t said account be allowed and Clerk instructed to draw warrant for same_, which motion was -duly seconded by Aid. Hight and allowed by the following vote, "Ayes!' _ Appleby, Jobe, Hight, Sour Suttle, "Nays" - None, absent and not voting, Phillips. 101 On -August _30., 1910., the -City Clerk caused- the -.following notice --to be -published, -in- - the Fayetteville Daily, a regular publication in the City of Fayetteville, Arkansas, "Notice to Side, Walker Builders Notice i-s_.herek�y- given that -.sealed _bids will_ be received-_.. _ by the City Clerk of the City of Fayetteville, Arkansas up to 12 o'clock (noon) on the 10th day of September, 1910 for the constructing of a side walk and curb along and in front of the - 7oll-owing-described property in -said City, tdwiit Ten feet°o£f the South side of Lot 2, bloc' 26 and ten feet off the North side of lot 3 in said Block 26, in said City of Fayetteville. -- - ---- The- said -property -be-ing on --the West side -of the -pubr ic'• s quare and -front ink ori Brock " - - 'Street.
