Alderman Bral_y from the Finance Committee makes a report showing, in his opinio that._ the- City_of_Faygttevill e_,_-has_not _been_ r_eceiying_he.r _e.xact_share_of ffifil _the_ taxes collect ed_ by. -the-County Collecter,. which_ report _is as follows, " To The City Council of the amity of Fayetteville :- The undersigned Special - _ Committee -to whom was referred the report of the City Treasurer for the month of July with __instructions to -examine the books of the County -Collector and ascertain if the_. amounts paid -by him tothe.City_.Treasurer _on- account -of -collections made_ for the City were the correct amounts _ _..that_the_�ity_Has__entitled-to_-receive_, herewith_re_t_urns the_ same and submits_the_following report:- __. - _-The_C.ity_Tr_easurer!s. report -shows -that -on the -13th --day of -July., -1909, -he had,_ ---.,received received -fron J_._C•Reed,_County Collector-, amounts--credit-ed-as-fa-1 lows:-_Geperal Fund, 7167.0 _ _ _Fire Fund,__$_3052,_2.8, Street Fund, -$__2293.42;_ total $ _12512.79. The. Collector- had made_ no statement to the City showing why these particular amounts should be paid to the City Treasur- -1,er., but __upon.an, e.xamination of statements --on file. -in_ the -office of the Coun.ty_Clerk it was .,. - -_-_ found_ahat_payment_had_been_made_in_conformity_ with_his_settlement_made_with the County Court. It appeared -that the City had-r-e_ceired_on_2,ccount_of__5_mill9^l-e.v.ied as. General evenue_and.on- account .of_2_mills.l.eveid_as-Bire_Fund-,. the -sum -with -which the -Collector was Chargeable, less delinquent_ taxes and commission, but in the_matter_of Street Fund or_3 mills j of Road_Tax__levied under amendment No. 5 of the Constitution_ and the Act of May 8_, 1899, the. _City has in the opinion of your Committee received but two-thirds of the _amount that should have been paid to the City 'Treasurer under the law._ _Amendment_No.._ 5, to the Vonstitution which was --declared. adppted_ Jan. 13, 1899. - authorized the Levying Court after the County should have voted therefor,_. to levy not.exceedin •�; 3 mills which in the language of the amendment " Shall be known as the County Road Tax and _,yhen collected shall -be -used in the respective Counties _for._the_purpo_se_of,making and repair- ing Public Roads and Bridges, of the respective Countiesand for no other purpose. --- - - Section 7330 Kirby's Digest taken from the Act of May_8,_1$99, conforming with Amendment No. 5,_ authorized_ the County _Levying Court to-_appropriate_and_l-ev_y riot exceeding 3 _m ills -on --the- ftllar__as_ the -Road -and- Br-idge lax on all the. taxable_proper ty_ in the aCounty "hick tax shall be collected by the Collector of State and County `saxes, in the same manner as the State a,.nd_County Taxes, and provided "_that said Collector shall keep such Road and Bridge 'taxes collected on the property of each of the various Road Districts separate and when the Collector shall pay into- the County 4eaeury the -taxes so collected he shall. take the Tres.
