HomeMy WebLinkAbout1995-03-20 Minutes• • • MINUTES OF THE BOARD OF ADJUSTMENT AND THE BOARD OF SIGN APPEALS A meeting of the Fayetteville Board of Adjustment/Sign Appeals was held on Monday, March 20, 1995 at 3:45 p.m., in the City Administration Building, Room 111, 113 W. Mountain St., Fayetteville, Arkansas. MEMBERS PRESENT: Larry Perkins, Thad Hanna, Marion Orton, Gerald Boyd, Lonnie Meadows, Craig Rivaldo, Bob Nickle OTHERS PRESENT: Tim Conklin, Mike McKimmy, Sharon Langley, and others VARIANCE BA95-5 - REQUEST FOR VARIANCE SETBACK GARY LITTLE - 443 S WASHINGTON The first item was a request for a variance from the required building setbacks in R-2, Medium -Density Residential district for property located at 433 S. Washington submitted by Gary Little. Staff recommended denial of the requested variance on the basis there was adequate room to build the addition without encroaching into the setback. Tim Conklin stated that, if the Board approved the request, the staff would recommend a survey or deed be provided. Discussion ensued regarding the dimensions of the lot and the design of the proposed structure addition. Mr. Boyd inquired as to the small existing structure. In response to a question from Mr. Nickle, Mr. Conklin stated the lot was nonconforming. He further noted the existing structure was also nonconforming and, to approve the variance request, would enlarge upon a nonconforming structure. Mr. Nickle stated that, if the request was denied, the applicant could still build the addition but in a different location. Ms. Orton pointed out the addition just needed to be moved 4 feet to the south and it would conform to the setback. MOTION Ms. Orton made a motion to deny the request. Mr. Boyd seconded the motion. SKYLINE This item was pulled from the agenda due to insufficient information to complete the report. • • Board of Adjustment/ Board of Sign Appeals March 20, 1995 Page 3 VARIANCE BA95-6 - REQUEST FOR VARIANCE SETBACK ALAN M. OSTNER - 2234 SWEETBRIAR The next item was a request for a variance from the required building setbacks in R-1, Low -Density Residential district, for property located at 2234 Sweetbriar submitted by Alan M. Ostner. Staff recommended approval of the variance on grounds that the granting of said variance would not have a significant adverse impact on adjacent property owners or future development to the east. Mr. Conklin stated the current structure was 26 feet from the back of the property line and the applicant had requested a 5 feet variance for construction of a covered porch off the existing family room. Mr. Ostner explained the construction design and his reason for requesting said variance. Mr. Nickle inquired as to whether or not the adjoining property owner to the north had been notified regarding construction of the porch. Mr. Ostner stated that a petition had been circulated throughout the neighborhood and there had been no objections. MOTION Mr. Rivaldo made a motion to approve the variance. Mr. Hanna seconded the motion. Motion was approved with a unanimous vote. • • • Board of Adjustment/ Board of Sign Appeals March 20, 1995 Page 4 VARIANCE BA95-7 - REQUEST FOR VARIANCE SETBACK ANN TWINES - 2701 CENTERWOOD The next item on the agenda was a requested for a variance from the required building setbacks in R-1, Low -Density Residential district, submitted by Ann Ternes for property located at 2701 Centerwood. Staff recommended approval of the request as shown on the site plan. Mr. Conklin pointed out the subject lot 25 feet setbacks. Ms. Orton seconded the motion. Motion passed with a unanimous vote. • • • Board of Adjustment/ Board of Sign Appeals March 20, 1995 Page 5 VARIANCE BA95-8 - REQUEST FOR VARIANCE SETBACK DAVID JORGENSEN - 3180 VALERIE DRIVE The next item was a request for a variance from the required building setbacks in A-1, Agricultural district for property located at 3180 Valerie Drive submitted by David Jorgensen Staff recommended approval of the requested variance as shown on the site plan. Mr. Conklin stated the applicant had requested a 10 foot setback for construction of a garage. He explained the applicant had considered rezoning the property to R-1 which would require only an 8 feet setback instead of the 20 feet required under A-1 zoning, but had been informed the City Council had imposed a curtailing of A-1 rezoning until the Land Use Plan was completed. Further, he stated the area had been developed as a residential neighborhood and the adjacent property owner had been notified and had not objected to the construction of the structure. MOTION Ms. Orton made a motion to approve the variance. Mr. Hanna seconded the motion. Motion passed with a unanimous vote. • • Board of Adjustment/ Board of Sign Appeals March 20, 1995 Page 6 VARIANCE BA95-9 - REQUEST FOR VARIANCE SETBACK CENTRAL UNITED METHODIST CHURCH - DICKSON & HIGHLAND The final item on the agenda was a request for a variance from the required parking setbacks in R-0, Residential Office district submitted by Donna Pettus on behalf of Central United Methodist Church for property located at Dickson and Highland streets. Staff recommended approval of the request as shown on the site plan for the 20 spaces. Mr. Conklin stated the Church had requested a 10 foot variance for the parking along Highland Avenue. He reminded the Board they had approved a similar request for First Baptist Church. Additionally, he stated extensive landscaping had been planned. Mr. Bob Kelly presented various drawings of the parking area. Discussion ensued regarding meeting the requirements for the parking lot ordinance and various options were considered. MOTION Mr. Boyd made a motion to approve the variance request. Ms. Orton seconded the motion. Motion passed with a unanimous vote. Minutes of the Board of Adjustment/Sign Appeals meeting of March 6, 1995 were approved as presented. The meeting adjourned at 4:15.
