MINUTES OF A MEETING OF THE
BOARD OF ADJUSTMENT AND SIGN APPEALS
A meeting of the Board of Adjustment and Board of Sign Appeals was held Monday, April 6, 1998, at 3:45
p.m., Room 111 of the City Administration Building, 113 W. Mountain Street Fayetteville, Arkansas.

BA 98-6.00: VARIANCE (THE PARNELL GROUP. INC.1
2301 WEST 6TH STREET AT LOT 2. BLOCK 1 FAYETTEVILLE CENTER SUBDIVISION
The applicant, Don Watson on behalf of the Parnell Group, Inc., submitted this request for property located
immediately east of 2301 West 6th Street at Lot 2, Block 1, Fayetteville Center Subdivision. The property is
zoned C-2, Thoroughfare Commercial and contains approximately 800 sq. Ft. The request is for 87.5% lot
coverage and for a reduction of the required rear setback from 20 feet to 5 feet. Building area is the percentage
of lot that may be covered by structures. This is a unique lot in that it contains 800 sf. and is 20 feet wide and 40
feet long. The lot frontage requirement was waived by the Planning Commission in 1980 when the concurrent
plat was approved for the Fayetteville Center Addition.
Staff Recommendation:
Staff recommends approval of the proposed encroachment into the rear setback and 87.5% building area subject to
the following conditions:
1. The structure shall be built as shown on the site plan.
2. The applicant provides 120 square feet (15% of 800 sf) of landscaped area, 75 sf. On this site and the
remainder in the drive-through island. All landscaped areas shall be in raised, concrete curbed islands.
3. Construction of a raised landscaped island that is 5 feet wide and approximately 93 feet long that
separates the parking spaces from the drive through lane. Three trees shall be planted in this island.
4. The existing parking lot and aisles shall be striped to comply with parking lot design standards and as
shown on the site plan.
5. Four trees shall be planted in front of the parking lot along 6th street.
This item was moved to the last agenda item due to the applicant not present.

DA 98-11.00: VARIANCE (WALKER/WILSON PROPERTIES)
823 STORER AVENUE
The applicant submitted this request for property located at 823 Storer Avenue. The property is zoned R-3, High
Density Residential and contains approximately 0.21 acres. The request is to reduce the rear setback from 20 feet
to 10 feet (a 10 foot variance) and to reduce the required side setback from 14 feet to 10 feet (a 4 foot variance).
Staff Recommendation:
Staff recommends approval of the requested encroachments into the rear and side setbacks subject to the following
conditions:
1. The parking lot be redesigned to provide for 19 foot stall depths, 24 foot of aisle width, and a 15 foot
landscaped area along the front property line with required screening.
2. Construction shall begin on the four-plex within one year or the variances shall be void.
Discussion:
The committee reviewed the plans and the pictures and noted there would be a separate entrance location.
Motion
Mr. Hanna moved that this variance be approved per staff recommendations.
Mr. Nickle seconded the motion as stated.
The roll call was given and said motion carried with a vote of 4-0-0. Mr. Wilhelms and Ms. Orton were not
present for the vote.

DA 98-12.00: VARIANCE (STEPHEN L DAVIS)
756 NORTH WASHINGTON STREET
The applicant submitted this request for property located at 756 North Washington Street. The property is zoned
R-1, Low -Density Residential and contains approximately 0.21 acres. The request is for a variance of 1.2 feet
from the required 8 foot side setback (south side) and for a variance of 3.7 feet from the required 21.3 foot front
setback.
The Board of Adjustment granted a variance to the side setback on March 2, 1987 for a 1,841 sf. addition.
Staff Recommendation
Staff recommends approval of the proposed encroachments into the setbacks as shown on the site plan subject to
the following conditions:
1. Work must be started on the project within one year or the setback variance shall be void.
Discussion:
There was some discussion concerning the variance to the north and the south.
❑ The applicant stated the addition would not encroach any further than the existing house.
❑ The neighbors were notified and staff stated they had received no feedback.
Motion
Mr. Nickle moved that said variance be granted per staff recommendations.
Ms. Orton seconded said motion.
The roll call was given and said motion carried with a vote of 5-0-0. Mr. Withelms was not present for the
vote.
There being no further business, the Board of Adjustment closed and the Board of Sign Appeals opened at 3:00

SA 98-2.00 SIGN VARIANCE (HARVEY SMITH. JR.)
2680 JOYCE BOULEVARD
The applicant submitted this request for property located at 2680 East Joyce. The property is zoned R -O. There
are three multi -tenant structures at this location. The sign requested would serve as the only free-standing sign on
the lots. The applicant is requesting a variance from two provisions of the sign ordinance.
1. The first point of variation is from Chapter 158.47 (B) (1) which permits a maximum of four square feet
of display surface. The applicant is requesting ten square feet of display surface area.
2. The second point of variation is from Chapter 158.47 (B)(3) which permits a sign to be no higher than six
feet above the street. The applicant requested a height of 10'6" above the roadway. The height
requirement would limit the sign to 14" above grade.
Staff Recommendation:
Inspections supports the request. However, the applicant should amend the application and request an area sign.
This would resolve both points of variation and would allow one sign to serve the development. There are four
buildings on two lots totaling 3.2 acres with at least 6 tenants. The applicant stated he agrees with this suggestion.
This would require a variance from the 5 acres that an Area Sign requires (Chapter 158.03 Definitions)
Discussion:
The committee discussed various issues regarding location, individual signs at the offices, and if placement on the
island would meet the requirements. It was noted the setback requirements would have to meet the commercial
design standards.
❑ Mr. Hanna recommended the motion specify the sign would meet the specifications as noted per Page 4.5
of SA 98-2.00.
MOTION
Mr. Hanna moved that the sign variance be granted per staff's recommendations and conditions of approval
and per the drawing on Page 4.5 of SA 98-2.00.
Mr. Wilhelms seconded said motion.
The roll call was given and said motion carried with a vote of 6-0-0.
There being no further business, the Board of Adjustments reconvened at 3:15.

Discussion:
❑ Staff stated the project would need to meet the Commercial Design Ordinance and staff had
recommended 87.5% of lot coverage which would allow for placement of trash pickup.
The committee reviewed the plans and drawings and the applicant noted there would be no windows or penetration
on the NotQr'side of the building. Applicant also stated there would only be one door in the rear.
❑ Beth Sandeen would work with the applicant to obtain the proper height of trees and location.
MOTION
Mr. Nickle moved that said variance be granted as requested subject to staff's recommendations.
Mr. Wilhelms seconded said motion.
The roll call was given and said motion carried with a vote of 6-0-0.
There being no further business the meeting was adjourned at 3:25 p.m.
