HomeMy WebLinkAbout1996-12-16 Minutes• • • MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENTS AND SIGN APPEALS A meeting of the Board of Adjustments and Board of Sign Appeals was held Monday, December 16, 1996 at 3:45 p.m., Room 111 of the City Administration Building, 113 W. Mountain St., Fayetteville, Arkansas. MEMBERS PRESENT: Thad Hanna, Michael Andrews, Paul Wilhelms, Marion Orton, Larry Perkins, and Bob Nickle. STAFF PRESENT: Rich Lane and Heather Woodruff APPROVAL OF MINUTES The minutes were approved as distributed. NEW BUSINESS BA96-30.00: VARIANCE REQUEST FOR RICHARD WOMMACK NORTH OF ARCHIBALD YELL BLVD & EAST OF BLOCK STREET. The first item on the agenda was submitted by Richard Wommack for property located north of Archibald Yell Blvd and east of Block Ave. The property is zoned R -O and contains approximately 0.23 acres. The request is for two variances of approximately 10' from the required 25' setback on both the south and east property lines. This item was tabled at the previous meeting. Mr. Lane stated the applicant had reconfigured the building. He would need a 10' variance on the east side and a 10' variance on the south side. The previous request had been for 18' on the south side. The building size had been reduced by 30 square feet. He added the staff recommended approval. Mr. Wommack stated they had tried to bnng the building into conformity. MOTION Mr. Hanna moved to approve the item as requested. Mr. Boyd seconded the motion. The item was passed by a unanimous vote of 5-0-1. Mr. Andrew abstaining. Mr. Boyd reminded the variance was from the eaves and not the walls. iyS • Board of Adjustments and Sign Appeals December 16, 1996 Page 2 BA96-31.00: VARIANCE FROM SETBACK FOR GREG HOUSE SOUTHEAST ORNER OF CAMPBELL STREET AND WATSON STREET. The next item on the agenda was submitted by Greg House for property located at the southeast corner of Campbell Street and Watson Street. The property is zoned C-3 (Central commercial) and contains approximately 0.28 acres. The request is for a variance of approximately 3' ( for balconies only) from the required 5' setback from the east property line. Mr. Lane stated the structure was currently under construction at the comer of Campbell and Watson. The variance request was to allow two 4' balconies on the second story of the building. The balconies would obstruct the front setback (Rollston Street) by 3'. The estimated height of the balconies was approximately 16'. The staff recommended approval of the variance as requested. Mr. Richard Alexander, representative, stated they would like to install the balconies to add Architectural integrity. They wanted to continue the theme of the neighboring building. He added they were doing a lot of ornate work on the building and they were trying to make the • building more appealing on that side of the street. Mr. Nickle commented it would be similar to buildings in the French Quarter of New Orleans. Mr. Alexander stated the balconies would be similar and would not be in the way of anything. Mr. Perkins asked if the balconies would extend over the sidewalk. • Mr. Alexander stated they would not go over the sidewalk and there would be no post supporting them. Mr. Perkins asked if there was space for parking. Mr. Alexander stated they had 19 parking spaces. Mr. Boyd stated the Board had allowed the Brew Pub to place a balcony over the street right-of- way in the same neighborhood. Mr. Wilhelm stated the Brew Pub had been an existing structure. MOTION Mr. Nickle moved to approve the item as requested. /VG • Board of Adjustments and Sign Appeals December 16, 1996 Page 3 • • Ms. Orton seconded the motion. The item was approved unanimously by a vote of 7-0-0. NEW BUSINESS Mr. Nickle pointed out there were numerous small signs placed illegally around town. He suggested sending a letter to Local Board of Realtors to have them remove their signs. Mr. Lane stated he would refer the matter to Mr. Mike McKimmey, sign inspector, and have him write a letter through Bert Rakes.
