HomeMy WebLinkAbout1996-05-20 Minutes• • • • MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENTS AND SIGN APPEALS A regular meeting of the Board of Adjustments and Sign Appeals was held on May 20, 1996, at 3:45 p.m. in room 111 of the City Administration Building, 113 W. Mountain, Fayetteville, Arkansas. MEMBERS PRESENT: Larry Perkins, Marion Orton, Gerald Boyd, Michael Andrews, Bob Nickle, and Paul Wilhelms MEMBER ABSENT: Thad Hanna STAFF PRESENT: Rich Lane and Janet Johns APPROVAL OF MINUTES OF MAY 6, 1996 The minutes were approved as distributed. BA96-11 - CLAY BASS ROB SHARP - 21 N. LOCUST AVE BA96-1 I was submitted by Rob Sharp on behalf of Clay Bass for property located at 21 N. Locust Avenue. The three fold request was for a 10' variance (from 30' to 20') from the front setback on Meadow, 8' variance (from 30' to 22') from the front setback on Locust, and 4' variance (from 10' to 6') from side setback on the west. Staff recommended approval of the request with the condition that the proposed new dwelling would not exceed 20' at the side setback lines. Mr. Lane noted that the applicant had received conditional use approval to allow an additional multi family dwelling but that approval was subject to approval of the variances. (Mr. Wilhelms and Mr. Nickle arrived at 3:50 p. m. ) Mr. Wilhelms inquired as to the effect the height condition would have on the structure in comparison to the existing structure and Mr. Sharp responded that the second floor would have a pitched indoor ceiling. Mr. Boyd inquired if the size of the existing house would change and Mr. Sharp stated that it would not change. Mr. Andrews inquired regarding the side setback encroachment and Mr. Sharp stated the problem was with the porch which was an existing nonconformity. Mr. Boyd inquired under what code section two houses on one lot were permitted. Mr. Lane explained that the subject property was not a "granny house" because one of the structures was not owner occupied, therefore, the conditional use was requested and approved to allow multi family. Further, he stated that it was generally accepted that multi family would be one large structure, however, staff felt this was a better design and more in character with the neighborhood. Mrs. Bass stated they were considering connecting the structures with a trellis or bay creating a common area between the two structures. Mr. Sharp added that approval of this proposal would allow the mature tree on the property to remain. Discussion ensued regarding similar requests which the Board had granted. Ms. Johns stated that the request was in line with the 2020 General Plan's in fill development policy. • • • Minutes of a meeting of the Board of Adjustments/ Sign Appeals May 20, 1996 Page 2 MOTION Mr. Boyd made a motion to approve the variance request. Mr. Andrews seconded the motion. Upon roll call, the motion passed with a vote of 6-0-0. OTHER BUSINESS Ms. Johns distributed material on sign regulations for small and midsize communities. The meeting adjourned at 4:00 p.m.
