HomeMy WebLinkAbout1996-03-18 Minutes• MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENTS AND SIGN APPEALS A meeting of the Board of Adjustments and Sign Appeals was held on March 18, 1996 at 3:45 p.m. in Room 111, of the Fayetteville City Administration Building, 113 W. Mountain, Fayetteville, Arkansas. MEMBERS PRESENT: Larry Perkins, Michael Andrews, Marion Orton, and Bob Nickle. STAFF PRESENT: Rich Lane and Janet Johns APPROVAL OF THE MINUTES OF MARCH 4. 1996 The minutes were approved as distributed. NEW BUSINESS BA96-9 - ERIC & ELIZABETH BRYAN 79 N. OLIVE The first item on the agenda was the request submitted by Eric & Elizabeth Bryan for property located at 79 N. Olive. The property is zoned R-2, Medium Density Residential and the request is for a variance from the required building setbacks. The request was for a variance from the required 25' front setback of 25' allowing a 7'2" variance. Staff recommended approval of the variance subject to the following conditions Approval of a property line adjustment for adding 8' on the north side and 19' on the south side. 2. Construction of the house in accordance with submitted plans. 3. Initiation of construction within 12 months. 4. No portion of the proposed structure shall obstruct any utility easement. Mr. Perkins noted that the existing structure was nonconforming and the code would not allow the board to allow a more nonconforming structure. Mr. Lane noted the variance was contingent upon a property line adjustment. Mr. Bryan stated the adjoining properties were "family" owned and therefore a property line adjustment would be easily obtained. (Mr. Nickle arrived at 4:00) Mr. Nickle proposed that the request be amended to a variance, "...up to 8'." MOTION Ms. Orton made a motion to grant the variance as amended "up to 8'." Mr. Nickle seconded the motion. Upon roll call, the motion passed with a unanimous vote of 4-0-0. 77
