HomeMy WebLinkAbout1995-08-21 Minutes• • MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENTS AND SIGN APPEALS A meeting of the Board of Adjustments and Sign Appeals was held on August 21, 1995 at 3:45 p.m. in the City Administration Building, 113 West Mountain, Room 111, Fayetteville, Arkansas. MEMBERS PRESENT: Michael Andrews, Gerald Boyd, Thad Hanna, Bob Nickle, Marion Orton, Larry Perkins, and Craig Rivaldo STAFF PRESENT: Alett Little, Janet Johns, and Rich Lane. APPROVAL OE MINUTES Corrections to the minutes of August 7, 1995 were as follows: Page 1 under Members Absent..."includes Larry Perkins." NEW BUSINESS VARIANCE BA95-23 - MIKE THOMAS/JULIE GABLE KURT KULISH - 106 N OLIVE AVENUE The only item on the agenda was a request for a variance from building set backs submitted by Kurt Kulish on behalf of Mike Thomas and Julie Gable for property located at 106 N. Olive Avenue and zoned R-2, Medium Density Residential. The request is for a 17' setback (an 8' variance) on the west side of the property. The applicant proposed to remove an existing non -conforming brick and block porch on the west side of the house and replace it with a wood deck. Staff recommended for approval of some variance due to the lot being elevated above the street and required the two existing maple trees to be preserved. Ms. Little stated she had received a phone call from Ms. Elizabeth Ellis property owner of the house to the north which serves as rental property. Ms. Ellis expressed concern regarding the probability of street expansion and Ms. Little stated she had told Ms. Ellis the probability was low due to grade. Mr. Kulish stated the proposed deck would not extend further than one feet beyond the deck on adjoining property and he stated the request was to replace the structure which was removed He stated the reasons for reconstructing the deck were due to safety issues with ingress and egress and water leakage problems. Mr. Thomas presented pictures of the subject structure and surrounding properties. Discussion ensued regarding street widening and deck construction options. MOTION Mr. Rivaldo made a motion to approve the variance as requested subject to staff comments. Mr. Nickle seconded the motion. Upon roll call, the motion passed with a unanimous vote of 7-0-0. s&7 • • • Minutes of the Board of Adjustements and Sign Appeals August 21, 1995 Page 2 OTHER BUSINESS Mr. Perkins stated there would not be a Board of Adjustment and Sign Appeals meeting on September 4, 1995.
