HomeMy WebLinkAbout1995-07-17 Minutes• • MINUTES OF THE BOARD OF ADJUSTMENTS AND SIGN APPEALS A regular meeting of the Board of Adjustments and Sign Appeals was held on July 17, 1995 at 3:34 p.m. in the City Administration Building, Room 111, 113 W. Mountain St., Fayetteville, Arkansas. MEMBERS PRESENT: Michael Andrews, Gerald Boyd, Bob Nickle, and Marion Orton MEMBERS ABSENT: Thad Hanna and Craig Rivaldo OTHERS PRESENT: Alett Little, Janet Johns, and others. VARIANCE BA95-20 - A. EUGENE KING 1824 E. 4TH STREET The first item on the agenda was a request for variance submitted by A. Eugene King for property located at 1824 E. 4th Street. The request is for a variance from the required building setbacks in R-1, Low Density Residential. Staff recommended approval subject to the following conditions: 1. That construction be initiated within one year of the variance approval date, That the variance be specific to the storage building (not intended to allow for expansion of the primary residence,) and 3. That the storage building be constructed on a conventional, not slab foundation in order to allow the structure to be moved in the event that such removal should become necessary in the future. Mr. King stated he would comply with all the conditions. Mr. Boyd inquired why the storage shed could not be located east of the swimming pool and Mr. King stated there was a problem with the pool drain pipe location. Discussion ensued. Mr. Orton stated variances were only granted for projects with a true hardship. Mr. King stated the structure would be used as storage and for a woodworking shop and therefore he required the 14 x 20 size. Ms. Orton noted the neighbors had a similar structure adjacent to the location of the proposed structure. Discussion ensued. Discussion ensued regarding the staff recommendation that the building not be put on a slab and Mr. King stated he would comply with the requirement. Mr. King stated he was not comfortable with change the proposed location of the structure for health reasons. Discussion ensued. MOTION Mr. Nickle made a motion to approve the 6 feet side setback variance. Mr. Boyd voted against the motion. • • VARIANCE BA95-21 - WARD PAESCHKE 305 W. LAFAYETTE STREET The next item on the agenda was a variance request submitted by Morgan Hooker on behalf of Ward Paeschke for property located at 305 W. Lafayette Street. The request is for a variance from the required building setbacks in R -O, Residential Office. The request included a 7'4" variance from the front setback, a 16' variance from the west side setback from 50' to 34', and a 20.5' variance from the east side setback from 50' to 29.5'. The staff recommended approval subject to the following conditions: 1. Initiation of construction within one year of the date of the variance approval. 2. Limiting of the variance to reconstruction of the current structure in its present configuration (variances would not apply if the building were demolished), 3. Removal of the porch on the east side of the structure. 4. Installation and preservation of trees as shown on the plot plan presented to the Board of Adjustments as a part of this application package. Ms. Little stated part of the refurbished structure would be offices and the other residences. Ms. Little stated the parking lot ordinance requirements would need to be met and further stated the applicant would be able to meet the requirements. Discussion ensued regarding parking in the street along Lafayette. Further discussion ensued regarding the removal of the existing structure's patio and Mr. Hooker stated they intended to a door and overhang in the old patio area Ms. Little stated they were required to provide 8 parking spaces and discussion ensued. Mr. Nickle stated this type of project seemed to be of the nature the City Council had encouraged. Ms. Orton expressed concem regarding the existing trees and preservation of them. Ms. Little noted those were protected in the staff requirements for approval. MOTION Mr. Nickle made a motion to approve the request including a 7'4" front setback variance, 16' west side setback variance, and 20.5' east side variance. Ms. Orton seconded the motion. The motion passed with a unanimous vote of 4-0-0. Meeting adjourned at 4:30 p.m.
