MINUTES OF THE BOARD OF ADJUSTMENT
AND THE BOARD OF SIGN APPEALS
A meeting of the Fayetteville Board of Adjustment/Sign Appeals was held on Monday, June 19, 1995, at 3:45
p.m. in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Michael Andrews, Gerald Boyd, Thad Hanna, Bob Nickle, and Craig Rivaldo
MEMBERS ABSENT: Marion Orton
OTHERS PRESENT: Alett Little, Janet Johns, and others.
VARIANCE 95-17 - REQUEST FOR SETBACK VARIANCE
GEORGANNE MOURNEY - 2009 ORA DRIVE
The first item on the agenda was variance 95-17 submitted by Georganne Mourney for property located at 2009 Ora
Drive The request was for a variance from the required building setback from 25 feet to 17.5 feet to permit
construction of a two car garage at the front of the existing structure.
Staff recommended that consideration be given to constructing the garage to the rear of the structure but in the event
it was not feasible, staff would support a variance of 5.5 fee which would permit the construction of a garage
including overhang with a 20 feet depth. Additionally, staff recommended the variance be conditional to become
invalid if construction has not begun within one year of the date of approval.
Ms. Little introduced garage sketches and presented the request for a 5.5 feet variance: She noted the variance
would leave 19.5 feet of drive between the garage and the right of way line which would be desirable due to
hazardous on -street parking.
Mr. Boyd inquired if the original garage had been enclosed and why they had enclosed same. Ms. Moumey stated
she had required more room but wished to stay in that neighborhood. Discussion ensued. Mr. Boyd noted
construction of a garage to the front of the house would throw the house line out of alignment.
Ms. Moumey stated she had contacted several contractors who measured from the center of street and had
erroneously told her she would not required a variance.
Mr. Boyd inquired if she had considered building the garage to the rear of the structure and Ms. Moumey stated
there were trees which would have to be removed and she did not want to do that.
Ms. Little stated the variance was for 4.5 feet not 7.5 feet. Discussion ensued regarding various options. Mr.
Perkins stated the variance would only need to be for 2.5 feet with a 1 foot side variance.
Mr. Rivaldo inquired if the neighbors had been notified and Ms. Little responded they had been notified several
times as was provided by the Code.
Mr. Andrews stated he lived in the area and through discussion with the neighbors he stated there was no objection.
Further discussion ensued regarding the amount of variance required and Mr. Perkins stated the front variance to be
2.5 feet and the side variance of 2.0 feet.

MOTION
Mr. Boyd made a motion to approve a 2.5 feet front variance and a 2 feet side variance.
Mr. Hanna seconded the motion.
Upon roll call, the motion passed with unanimous vote of 5-0-0.

Mr. Perkins stated the Minutes were approved as distributed.
ELECTION OF OFFICERS
Mr. Boyd nominated Mr. Perkins for chairman.
Mr. Hanna seconded the nomination.
Upon roll call, the nomination was passed with a unanimous vote of 5-0-0.
OTHER BUSINESS
Mr. Rivaldo inquired as to requirements for board members and whether or not they had to live within the city
limits. Ms. Little stated board members were required to live within the city limits.
Meeting adjourned at 4:07.

A regular meeting of the Board of Adjustments and Sign Appeals was held on July 3,1995 at 3:45 p.m. in the City
Administration Building, Room 111, 113 W. Mountain St., Fayetteville, Arkansas.
MEMBERS PRESENT: Michael Andrews, Gerald Boyd, Bob Nickle, Marion Orton, Thad Hanna,
and Craig Rivaldo.

No minutes were distributed for approval.
VARIANCE 95-18 - BILL MANNKE
121 S. SCHOOL
The first item on the agenda was a request for a variance of front setbacks including a variance of 18 feet along Rock
Street to permit construction of a carriage house and garage and a variance of 12.5 feet along Rock Street for the current
structure and a 4.4 feet variance along School Street.
Staff recommended approval of the School Street variance to bring the current structure into conformance so renovations
may continue.
Staff recommended approval of the Rock Street variances subject to construction of the structures as shown and initiated
within one year of the date of approval.
• Discussion ensued regarding construction plans and parking requirements.

Mr. Boyd expressed concern regarding the size of the carriage house. Discussion ensued regarding whether or not the
lot size was sufficient for both structures and Ms. Little stated the total building footprint was 3150 square feet and the
lot contained 8100 square feet.
Mr. Nickle commented the project was an in -fill development which City Council had recommended and discussion
ensued.
MOTION
Mr. Boyd made a motion to grant the School Street variance. Ms. Orton seconded the motion.
Upon roll call, the motion passed with a unanimous vote of 7-0-0.
MOTION
Mr. Boyd made a motion to approve the variances on Rock Street. Mr. Andrews seconded the motion.
Upon roll call, the motion passed with a unanimous vote of 7-0-0.
MOTION
Mr. Andrews made a motion to limit the construction to the submitted drawings and initiation of construction with one
year.
Upon roll call, the motion passed with a unanimous vote of 7-0-0.
