MINUTES OF THE BOARD OF ADJUSTMENT
Fayetteville Board of Adjustment was held on Monday, January 4,
m in Room 111 of the City Administration Building, 113 West
Fayetteville, Arkansas.

PROTOCOL
Ms. Don Mills called the meeting to order. She explained the format of the
meeting.
APPEAL NO. BA93-1 - REQUEST FOR A VARIANCE OF AREA AND BULK REQUIREMENTS
DALE JOHNSON - 347 REDBUD LANE
The only item to be heard was a request for a setback variance on property
located at 347 Redbud Lane requested by Dale Johnson. The property is zoned R-2,
Medium Density Residential.
Mr. Conklin explained the request had been made in order to allow a fire place
to encroach two feet, four inches into the side yard setback. He advised the
site currently contained a single-family home. He stated there was an existing
fireplace in one of the bedrooms but no closet. He explained the property owner
wanted to remove the fireplace in the bedroom and install it in the family room.
Mr. Conklin explained the subject neighborhood had been developed with minimum
setbacks in order to develop affordable housing. He further explained the
applicant wished to place the fireplace along the east side wall of the living
room and that the east side of the structure was 8 feet from the side property
line. He also noted the applicant could have chosen to build the fireplace along
the front of the house and would have met setback requirements.
Mr. Conklin advised staff was forwarding the above listed facts to the Board of
Adjustment for their decision. He explained the Planning Management Direction
would be refraining from any comments during the presentation as there was a
business relationship between the applicant and Mr. Little.
Mr. Johnson explained the house, listed as a two-bedroom, was a one -bedroom
because there was no closet in the second room. He further explained that was
the master bedroom. He advised that, if he took the fireplace out, he would have
room to install a closet. He stated he could charge $75.00 to $100.00 more per
month rent if he could rent the house as a two-bedroom. He pointed out there
were four houses within 150 yards that had fireplaces on the exterior walls. He
expressed his belief the addition of the fireplace would not be detrimental to
the neighborhood.
In response to a question from Mr. Hanna, Mr. Johnson the exterior wall would be
similar to the existing house and similar to other houses in the area.
Ms. Orton asked if any of the neighbors objected to Mr. Johnson constructing the.
fireplace.
Mr. Johnson stated he had spoken with every neighbor and none of them had
objected.

Mr. Boyd asked why the house to the east of the subject property had been
constructed so far away from the property line.
Mr. Johnson explained the lot lines were very irregular due to being on the cul-
de-sac.
Mr. Boyd pointed out the adjoining lot was a much bigger lot. He also advised
Mr. Johnson had an easement on the west side of the property.
Mr. Perkins expressed his belief the addition of the fireplace would conform to
other houses with fireplaces on the end. He also pointed out the neighbor to the
east did have a wider side yard than the normal 8 feet and a privacy fence. He
stated he did not see a problem in granting the appeal.
Mr. Boyd agreed with Mr. Perkins. He advised they often had problems with cul-
de-sac lots and the Board tended to be more tolerant of setback violations on
cul-de-sac lots.
Ms. Orton stated she did not believe it would change the nature of the
neighborhood to allow the variance.
MOTION
Mr. Boyd moved to grant the requested variance.
Me. Orton seconded the motion.
The motion carried unanimously.
MINUTES
The minutes of the December 7, 1992 meeting were accepted as distributed.
The meeting adjourned at 4:00 p.m.
