HomeMy WebLinkAbout1988-08-01 MinutesM]NUTES 1' THE BOARD 1' ADJUSTMENT MEETING A meeting of the Fayetteville Board of Adjustment was held on Monday, August 1, 1988 at 3:45 P.M. in Room 111 of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Robert Waldren, Larry Tompkins, Dennis Becker, Don Mills, Gerald Boyd, Jerry Allred, and Deane Davenport OTHERS PRESENT: Graham Shannon, Jr. & Blaine Cattaneo MINUTES The minutes of June 20, 1988 were approved as mailed except for one correction from Jerry Allred. The minutes show him to be present and he was in fact "absent" at the June 20, 1988 meeting. The only item of consideration was a request for a variance on the setbacks • submitted by Graham Shannon, Jr. Property zoned R-1, Low Density Residential, and the variance request was to allow a 19' setback on the west side instead of the required 25' for the south 50' of the lot. The north 65' of the lot would retain the 25' required setback. Mr. Shannon stated that the house has a slight extension on the south end toward the street and that portion is part of a bedroom and a very small bath. He stated that he hoped to have a gable roof running perpendicular to the main roof line of the house and carry that roof line out an additional 5' (6' including the overhang). This construction would allow them to extend the bathroom and add a closet to the bedroom. He stated that this is the only place that expansion could be accommodated because of the roof structure and the slope of the lot. Mr. Tompkins stated that if the Master Street Plan shows a street right-of-way of 50'. He stated that he is assuming that if the street was ever widened, the extra 10' would be taken from the church property across the street. He asked Mr. Shannon if he knew what the average existing setback line is in that area. Mr. Shannon stated that he thought there were only 2 or 3 houses in the entire circle that actually have a 25' setback. Mr. Tompkins asked Mr. Shannon what the distance was between his house and the one to the South and the one to the North. Mr. Shannon answered that to the South there is about 60' and on the north side there is probably a 25' distance. CI 101 • Board of Adjustment August 1, 1988 Page 2 Mr. Becker asked why they can't get most other applicants to do their submittal like Mr. Shannon's. He stated that he if they grant the variance it would only put Mr. Shannon's house in a closer alignment with the other houses there. Chairman Mills asked if there was anyone in the audience who would like to speak in favor of this. Mr. Shannon stated that he thought the neighbor to the North had called in to speak in favor of this. The public hearing was closed and discussion took place among the members. Gerald Boyd stated that this was a good example of what the Board of Adjustment was here for. He noted that this was a permissible hardship in his opinion. Jerry Allred stated that one of the things that the Planning Commission is looking at this month with the consultants on redoing the zoning ordinance is a Hillside Development which would relax some of the setbacks & densities on Hillside Development. MOTION • Jerry Allred moved to grant the variance, seconded by:Boyd._....The.motion to grant passed 6-0-0. r-I LJ 10a
