A meeting of the Fayetteville Board of Adjustment was held on Monday, March
21,1988 at 3:45 p.m. in Room Ill of the City Administration Building, 113 West
Mountain Street, Fayetteville, Arkansas,
MEMBERS PRESENT: Don Mills, Jerry Allred, Dennis Becker, Robert Waldren
?EMBERS ABSENT: Larry Tompkins
Gerald Boyd
Deane Davenport
OTHERS PRESENT: Gilford Heckathorn and Don Bunn
The minutes of the February 15, 1988 meeting were approved as distributed.

The only item of consideration was a request for a variance in the required
setbacks, application submitted by Gilford Heckathorn. Request was to vary the
north side from the required 10' to 0' and the west side from the required 10' to
0'. Property located on Lot 11, Parkers Plat of Valley View Acres, North of Ash
Street, property zoned I-1, Light Industrial and Heavy Commercial District.
Mr. Heckathorn stated that his property is next to Mayflower Moving Services on
the West side. There is 80 some feet between the building and his property line,
a lot of open space. He stated that he had discussed the setback variances with
Charley Scott and he thought it was a wonderful idea. He said it would save
vandalism on him.
Allred asked what is one the East side. Heckathorn answered , a big ditch and he
wants to change setbacks to allow them to have a ramp and fix up that side. He
said vandals had been cutting his chain link fence and if his building was there
it would cut down on vandalism. Also, he said the trucks can't see a 6' fence
very well when they back up and if a building was there trucks wouldn't be as
likely to run into it.

Waldren asked how many feet between buildings he wants to build. Heckathorn
answered , the drawing shows 24'. Chairman Mills asked if there would be room
for a fire truck to get between his proposed buildings.
Waldren stated that the problem wasn't so much whether a fire truck could get
through, assuming somebody did build to setbacks there's not enough room to get
through.
Chairman
Mills asked
if he was
just planning
to build
one building on the West
side now.
Heckathorn
answered,
yes, but they do
plan to
build more.
Chairman Mills stated that changing setbacks
was not
going
of
eliminate breaking
in and vandalism. Heckathorn answered, no,
but there
would
be
less of it.
Don Bunn stated that there was a utility easement along east side of property.
Allred asked if there was an easement on west side. Heckathorn answered, No. •
Heckathorn stated that there was a private power line that runs through at edge
of ditch. He stated that his building going all the way to the North property
line would help hide the junkyard on Birch.
Allred asked what the distance was between his proposed buildings. Heckathorn
stated 24' and 30'.
Chairman Mills stated that city ordinances require 10' and he is requesting 0'
right on the property line.
Allred
stated that the concern he had with
the
0' requested setback
was should
someone
else extend there building over to the
10'
it would be awfully
narrow.
Heckathorn
said he had discussed this with Charley
Scott and he didn't
have any
plans to
do add on to that side of building.
Allred
answered that's now
but you
have to
look at longevity of 15 to 20 years.
He
further stated that
he wasn't
opposed
to trying to work with him on it.
Chairman Mills stated that if an adjustment was made for one business, other
businesses would be wanting the same.
Becker stated that when you look at this you have to look for " special
conditions" that go with the land, building or structure and to hide trash
or the trucks in this case is not a "condition". He further stated that treating
everybody the same, you have to look at conditions that would warrant reducing •
setbacks, hardship conditions.

Allred stated that if some changes were made in the proposed buildings he would
be able to meet setback requirements. There are other ways to maximize more
storage units.
Heckathorn stated that it would mean the difference between 2 o 3 buildings
there.
Becker moved to deny the appeal as requested, seconded by Waldren. The motion to
deny passed 4-0-01

Chairman
Mills announced that there would be a
Call
Meeting
on Monday,
March 28,
1988 at
3:45 with the Mayor and at least one of
the
Board of
Directors.
Chairman Mills stated that the Planning Cormaission had discussed the mobile home
issue last week. Comments about bringing mobile home into the City for
Conditional Use as a way to take care of older family members. The question is
when it's no longer needed, what do you do in the way of extra housing. If lot
is large enough for 2 primary buildings and each building meets all setbacks
there is not a problem.
Bunn stated
they
could
get a
legal lot
split and still
build a second principal
structure on
the
lots if
they
could meet
the setbacks and
frontages.
Chairman Mills stated if they had any comments, get in touch with Ernie Jacks
with your concern about it.
Chairman Mills stated there could
be a problem when
they no
longer need the
second structure. Allred said there
would be a lot of
rentals
created by it.
Bunn said it could be illegal to use
as rental houses.
