A meeting of the Fayetteville Board of Adjustment was held on Monday, December 7,
1987 at 3:45 p.m. in Room Ill of the City Administration Building, 113 West
Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Don Mills, Robert Waldren, Jerry Allred, Gerald Boyd, Dennis
Becker, and Larry Tompkins
MEMBERS ABSENT: NONE
The only item of consideration was a request for a variance in the required
setbacks. Application submitted by Delno and Carol Allie for property located at
2071 Austin Drive. Requesting a variance from the required 25' setback on the
east to 17'7". Property zoned R-1, Low Density Residential District.
Mrs. Allie explained her home was built in 1965 and at that time the City
ordinance required a 25' setback from the street easement for the front of the
property, but only a 15' setback from the street easement on the east side of the
property. Mrs. Allie explained she wished to expand the bathroom and add a walk
in closet off of the master bedroom and at the same time add a garage, all under
the same roof.
• Waldren noted the drawing reflected 17'7" and that appeared to be -from- the edge
of an easement rather from the actual property line. Mrs. Allied said it was
from the edge of what she called the easement property line and the actual curb
line was another 11-1/2' beyond that.
Boyd asked if the property had been surveyed recently and Mrs. Allie replied
"no", but she had taken the ROW off of the City plat.
Tompkins asked if the trees would remain in the rear with the proposed extension
and Mrs. Allie replied "yes".
Mills advised that two letters had been received from Mrs. Allie's neighbors and
they were in favor of the variance being granted.
Mills asked if they had thought about moving the garage back another 8' or so.
Mrs. Allie said if she did that she would have to either remove the porch or set
the garage in front of the double windows in the family room.
Mills closed the public hearing and returned discussion to the Board of
Adjustment members.

MOTION
Allred moved to grant the variance as requested, seconded by Waldren. The motion
to grant the variance passed 5-0-0.
There being no further business the meeting adjourned at 4:45 p.m.
