A meeting of the Fayetteville Board of Adjustment was held on
Monday, June 15, 1987 at 3:45 p.m. in Room 111 of the City
Administration Building, 113 West Mountain Street, Fayetteville,
Arkansas.
MEMBERS PRESENT: Don Mills, Larry Tompkins, Jerry Allred,
Gerald Boyd, Robert Waldren, Dennis Moore,
Dennis Becker and Gerald Seiff
MEMBERS ABSENT: None
The meeting was called to order and the minutes of the June 1,
1987 meeting were considered.
MINUTES
The minutes of the June 1, 1987 meeting were approved as
distributed.
APPEAL 87-10 - SETBACK VARIANCE
• PACKAGING SPECIALTIES - 1663 ARMSTRONG
The only item of consideration was a request --submitted by
Packaging Specialties and respresented by Tim Richardson for a
variance from the setback requirements. Requesting 45' from the
street ROW.
Mr. Spanoto with Architectural Construction of Springdale
Arkansas presented a large plan of the proposed addition. He
said Packaging Specialties would like to move their machine shop
to the 1 acre parcel. Mr. Spanoto said there was a 50' sewer
easement along the south side of the property and a 20' utility
easement along the ROW of Industrial Place and Armstrong. He
said with all the easements and the required 50' building setback
it cut the 1 acre parcel down to 9180 sq, ft. of buildable area.
He said they were hoping to get a machine shop of approximately
10,000 sq.ft. in that parcel. Mr. Spanoto added this was the
reason for the requested variance in the required setback.
Boyd asked if Industrial Place was a dedicated street, and
Carlisle replied it was not a dedicated street.
Mills asked if there would be driveways coming off Industrial
Place or Armstrong, and Mr. Spanoto replied there would be no

driveways off either of the roads.
Tompkins stated Armstrong was to the master street plan standards
and that it would never be any larger.
Waldren said he did not believe the 20' setbacks were being used
and that they were platted in the original plat of the Industrial
Park.
Tompkins asked what would happen if the undedicated Industrial
Place was flipped over to the north. Carlisle noted that
Industrial Place was a private drive.
Tompkins said everyone so far on Armstrong has been conforming
with the required 50' setback.
Waldren said the Board of Adjustment had granted Bargo
Engineering a variance on their side yard.
Waldren said he felt like Packaging Specialties had a problem and
• it was not of their own chosing. He felt because of the large
sewer easement it made the addition difficult for what they
needed to do. He said they would not asking for a.large variance
which only amounted to approximately 10%. Waldren also felt
Packaging Specialties had been a good asset to the community.
Waldren felt granting a variance of this type in that basic
location would not be of any detrement whatsoever to the
community or surrounding plants. He said he would be in favor of
granting the request as submitted.
Tompkins asked which direction would the back of the building
face. Mr.Spanato said the back of the building would be facing
Armstrong with no driveways off of Armstrong.
MOTION
Allred moved to grant the variance as requested, seconded by
Waldren. The motion to approve passed 5-1-0, Waldren, Allred,
Becker, Boyd and Moore voting "yes" and Tompkins voting "nay".
Tompkins requested copies to all members of the new Supreme Court
ruling on land.
There being no further business the meeting adjourned at 4:45
