HomeMy WebLinkAbout1987-04-06 MinutesOF THE BOARD OF ADJUSTMENT M 0 MINUTES A meeting of the Fayetteville Board of Adjustment was held on Monday, April 6, 1987 at 3:45 P.M. in Room III of the City Administration Building, 113 West Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Don Mills, Larry Tompkins, Gerald Boyd, Dennis Becker, Jerry Allred and Dennis Moore MEMBERS ABSENT: Robert Waldren OTHERS PRESENT: Mike Walker, George Faucette Jr., Mike Price, Sandra Carlisle and Tessi Franzmeier. The meeting was called to order and the minutes of the March 2, 1987 meeting were approved with the following correction. MINUTES Delete Tompkins from the yes vote in the motion. APPEAL 87-5 - SETBACK VARIANCE MIKE WALKER - 3186 KATHERINE The only item of consideration was a request submitted by Mike Walker 10 to vary the side setback on the northeast corner from the required 8" to 5'. The property is zoned R-1, Low Density Residential District. Mills advised she would not be able to vote on this even in case of a tie vote. Mike price representing Mr. Walker stated the house was built approx- imately 3 years ago. He said a survey had been done on the house when it was first built by Don Kemp. Mr. Price explained the Walkers wanted to sell their home and the financial institution required a survey which showed the home to be into the required setback. He said the problem was they could not get title insurance without a waiver from the Board of Adjustment. Tompkins asked what the square footage of the lot was, and Mr. Price said the square footage of the home was approximately 1,800 sq. ft. Mr. Price said he was sure the buildable area was under 40%, and George Faucette added that subdivision had some green belt areas that helped the intensity some. The public hearing was closed and discussion returned to Board members. 0 IDBoard of Adjustment April 6, 1987 Page 2 Allred said they had wanted surveyors to set houses on lots, and here they have one. Allred said being this was the third owner he would have no problem with a variance. Boyd agreed with Allred, and felt this was a hardship. MOTION Becker moved to grant the variance as presented, seconded by Moore. The motion to approve passed 4-1-0, Becker, Allred, Moore and Boyd voting "yes" and Tompkins voting "nay". Mills advised the Board of Adjustment members to attend an update meeting held by a committee of the Planning Commission. She said the meeting date and time was planned for April 21, 1987 at 4:00 p.m, in Room 111 of the City Administration Building. There being no further business the meeting adjourned at 4:55 p.m. L_J 1
