A meeting of the Fayetteville Board of Adjustment was held on Monday,
August 4, 1986 at 3:45 P.M. in Boom 111 of the City Administration
Building, 113 West Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Don Mills, Larry Tompkins, Robert Waldren, Jerry
Allred, Dennis Beaker, Gerald Boyd and Dennis
Moore
MEMBERS ABSENT: None
Chairman Mills called the meeting to order and the minutes of the
July 21, 1986 meeting were considered.
Tompkins made the following correction: Page 1, fifth paragraph:
Waldren asked if the ... slab ... was already in place and Reed answered
yes. Upon a motion from Tompkins and a second from Beaker, the minutes
were aaaepted as corrected.
APPEAL 86-10 SETBACK VARIANCE
FULTON-STANTON CO., 864 EDEN CIRCLE
Today's item of consideration was a request submitted by Fulton -Stanton
Company to vary the front yard setback from the required 25' to 24'.
• The property is zoned R-2, Medium Density Residential District.
Dave Stanton stated the house was nine years old and had changed hands
a few times. Stanton noted this was the first time title insurance
had been required and the one foot is primarily overhang and porch,
and without approval of this variance the buyers would not be able
to acquire their loan.
Mills asked Stanton how many times had the home been sold and he stated
three times.
Tompkins asked who caught this enforcment after the third sale of
this home and Stanton explained this was the first time a survey had
been required by the lenders. Tompkins inquired to what it would
cost to bring this home into conformance and Stanton estimated approxi-
mately $7,500.00, Tompkins then stated the home extends further out
than any other house on the block.
Tompkins asked if the variance was for the 1' in violation and Stanton
explained he was asking for a waiver of 1' for that part of the roof
structure in violation.
Beaker questioned the meaning of a sentence on the application as

to other homes in Clover Creek, Phase one, conform to city and subdivision
setback requirements and Stanton stated there may be probably 1 and
possibly 2 others that do not conform.
The public hearing was closed and discussion returned to Board members.
Waldren stated this was a reasonable request and he had no objections.
Tompkins said he agreed with Waldren as to the request.
Allred stated he had no problem with this request.
NOTION
Waldren move to grant the variance as requested. Moore seconded and
the motion to approve passed 7-0-0.
OTHER BUSINESS
Mills stated their letter was submitted to the Planning Commission
concerning the Tree Ordinance.
• Tompkins stated a new draft of the Tree'Ordinance had been distributed
at the last Planning Commission meeting. Tompkins said the draft
the Board of Adjustment had read and was going to respond at this
meeting had been revised.
A new revised and up to date revision of the Tree Ordinance was distri-
buted at this meeting for a response to the Tree Ordinance at the
next Board of Adjustment meeting.
There being no further business, the meeting adjourned at 4:15 p.m.
