A meeting of the Fayetteville Board of Adjustment was held on Monday,
July 21, 1986 at 3:45 P.M. in Room III of the City Administration
Building, 113 West Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Don Mills, Larry Tompkins, Robert Waldren,
Jerry Allred, Dennis Becker and Gerald Boyd,
MEMBERS ABSENT: Dennis Moore
Chairman Mills called the meeting to order and the minutes of the
July 7, 1986 meeting were considered.
The minutes were unanimously approved as distributed upon a motion
by Tompkins and a second by Mills.
APPEAL 86-9 SETBACK VARIANCE
BRDCE T. SEED - 2106 BRIARWOOD
Today's item of consideration was a request submitted by Brune T. Reed
to vary the front yard setback from the required 25' to 20'. The
property is zoned R-1, Low Density Residential District.
• Mr. Reed stated the request is to vary the front setback so they may
add a 8' porch to the front of their home. Reed stated the porch
would not be enclosed and it would be supported with post and have
a concrete pad. Reed noted this would add aesthetics to the house
as well keeping the afternoon sun out of the front window and protection
from the weather.
Tompkins inquired to the possibility of a 4' porch as opposed to an
8' porch. Reed stated it would possibly keep the sun off the window
but for the aesthetics he felt it would look terrible.
Mills asked how deep the concrete pad was and Reed stated 8'.
Waldren asked if the slap was already in place and Reed answered yes.
Reed stated the difference from the front property line to the overhang
on the house is 29' and the porch would come out 9'with a 1overhang
past the concrete slab.
A neighbor from Elm Street stated he would not be opposed to this
addition.
Reed submitted a petition from the surrounding neighbors stating they

had no objections to the addition of the porch in question.
The public hearing was closed and discussion returned to Board members.
Tompkins stated
the house
is well maintained and
the neighborhood
is beautiful. He
noted with
the lot located on the corner the variance
would not impede
the sight
distance. Mills stated
she looked at the
house from both
directions
and felt there would be
no loss of sight
distance. Tompkins stated
he had no objection to
the variance as
requested.
Becker stated he
also had no
objection to the request.
MOTION
Allred moved to
grant the
variance as requested.
Waldren seconded
and the motion to
approve passed 6-0-0.
The Board of Adjustment as a whole, requested a letter be sent to
• the Planning Commission asking that further consideration of the proposed
Tree Ordinance be withheld until such time as all the existing Ordinances
can be reviewed and updated.
MOTION
Waldren moved to forward the request to the Planning Commission, seconded
by Allred, the motion passed 6-0-0.
There being no further business, the meeting adjourned at 5:25 p.m.
