HomeMy WebLinkAbout1985-06-03 Minutes• A meeting of the Fayetteville Board of Adjustment was held on Monday, June 3, 1985 at 3:50 P.M. in Boom 111 of the City Administration Building, 113 W. Mountain Street, Fayetteville, Arkansas. MEMBERS PRESENT: Chester House, Don Mills, Robert Waldren, Larry Tompkins, Dennis Becker, Jerry Allred and Gerald Boyd MEMBERS ABSENT: None Chairman House called the meeting to order and the minutes of the meeting of May 20th were considered. MINUTES The minutes stood approved unanimously upon a motion by Tompkins and a second by Mills. APPEAL 85-A MEADSTART-EOA 246 E. SIKTH STREET AT WILLOW • REQUEST WAIVER OF PAVED PARKING REQUIREMENT The second item on the agenda was Appeal 85-15, a request to waive the requirement that one to five parking spaces by paved (Art.8 Sec.10 (d)(5), submitted by EOA-Headstart for property located at 246 E. Sixth St. at Willow; Ivory Conley representing. Ms. Conley explained that Headstart has contracted to rent a building on Sixth Street for office space but will be required to pave the parking lot as they will have five parking spaces. She said she would like to gravel the lot because the property will revert to residential use when Headstart no longer rents it. Mills asked how long Headstart anticipates remaining at this location and Conley replied that, although the grants are awarded from year to year, she would expect to be at this location for about three years. Conley said Headstart does not have the money in their budget to pay for paving and it would have to come out of her pocket. Mills asked what it would cost to pave the parking and Conley replied that she could get gravel for no cost and Becker noted that paving would cost about $1.45 ft. n U q1 Board of Adjustment • June 3, 1985 Page 2 Tompkins said it appears that some of the parking spaces in the drawing are in the front yard setback. He expressed concern for site distance with the current design and suggested an alternative parking design which would require a larger turn -around area. Tompkins, Becker and Waldren measured the proposed parking plat and determined the amount of space necessary for the five required spaces with adequate maneuvering room. Tompkins said he didn't have any problem with the request if it were re -designed so as not to create a site distance safety problem. The clerk explained that there is the possibility of sidewalk being required on both Sixth Street and Willow for which the Planning Adminis- trator is willing to accept a Bill of Assurance if acceptable to the City Manager. (Sidewalks have recently been required to be installed on a neighboring street, Washington). After further discussion, it was determined that the owner of this property (Lamar Pettus) has agreed to install sidewalks as required. A citizen in the audience expressed his concern that the cars in the proposed lot may get loose and come down the street into his house or possibly hurting children at play. • It was determined that there would be no children, routinely, at the Headstart Administrative Center but the gentleman explained that he was concerned about other children at play down the street. Discussion ensued regarding the possibility of adding another drive so that there would be no backing out into the street. Allred remarked that parking spaces should be marked and contained with wheel stops. Becker inquired about a wheel chair ramp and Conley replied that one is presently being built as it is required by State regulations. Tompkins commented that gravel lots throw quite a lot of dust when conditions are dry and Waldren noted that it could be watered down. Conley stated that most of Headstart"s clients visit their individual centers and that this office will mainly house staff, only two of whom are present all day long with the remainder in and out for a total of approximately ten vehicles per day using the parking lot. Chairman House asked if there were any more responses either for or against this petition. There being none, discussion returned to Board members. Allred said he was in favor of this appeal with some modification • of ingress/egress and the parking reverting to that of normal residential usage when Headstart vacates. Mills agreed. 1/2 • Board of Adjustment June 3, 1985 Page 3 Boyd said he agreed, as long as the vehicles could be contained within the parking lot. Waldren agreed, stressing proper ingress/egress. Further discussion ensued regarding number of parking places desired and how far the present drive on Willow is from Sixth Street and the size of the house -to -be -office. It was decided that five parking spaces are required. NOTION Becker moved approval of this request. Mills seconded adding that she would like to have the entire parking area well defined for safety purposes and to keep the chat from washing out. Becker accepted this amendment followed by discussion. Tompkins said he had a problem with the current parking design as it would take the exiting traffic too close to Sixth Street. Becker further amended his motion to include one-way traffic via a circle drive and installation of wheel stop devices around the entire • perimeter of the parking lot in addition to the parking reverting to regular residential parking upon Headstart vacating the premises. The motion to approve this variance passed 7-0-0. • 93
