The Fayetteville Board of Adjustment met on Monday December 17, 1984
at 3:45 P.M. in Room 111 of the City Administration Building, 113
West Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Chester House, Don Mills, Larry Tompkins, Robert
Waldren and "Butch" Robertson
MEMBERS ABSENT: Dennis Becker and Dr. David Crittenden
OTHERS PRESENT: Don McGuire, Bobbie Jones and Paula Brandeis
Chairman House called the meeting to order at 3:50 P.M.
MINUTES
Upon a motion from Tompkins and a second by Mills, the minutes of
the October 15 meeting were approved as distributed.
PUBLIC HEARING APPEAL 84-27
DON McGUIRE
2031 GREEN ACRES ROAD
The only item of consideration today was a Public Hearing on Appeal
84-27 by Don McGuire for property located at 2031 Green Acres Road.
Requested is, 1. a variance to park on both side property lines; a
15 ft. setback is required and, 2. a variance of 5 ft. on the 15 ft. re-
quirement between street and parking area (with 202 landscaping).
McGuire, a State Farm Insurance Agent, stated that he is considering
buying the property located at 2031 Green Acres Road and, because
he is a visible type business he said he would like to provide convenient
parking in front of the building for propspective customers. He noted
that the Planning Commission has granted a variance on the driveway
safety zone to help facilitate the desired parking arrangement and
that Dr. Singleton, his prospective neighbor on the north, may allow
him access to a drive leading to additional (staff) parking in the
rear of this property.
McGuire said he would like to preserve the full-grown tree in the
front yard if at all possible and he requested a variance from this
Board to allow parking on both side property lines as well as reducing
the requirement from 15 ft. to 10 ft. between the street and the parking
area (with 202 landscaping) in order to provide enough parking and
manuevering room.

In answer to a letter received from a prospective neighbor, Dr. David
Crittenden, McGuire said he proposes to spend approximately $20,000
to remodel this building if he buys it, which will add to and not
detract from the aesthetic value of the neighborhood. He added that
there will a large visible space between his proposed driveway and
the next door building.
After much discussion between Board members, McGuire and Administrator
Jones, it was determined that McGuire could arrange four parking places
(including one handicap space) on his 75 ft. wide by 43 ft. deep available
area, leaving the required 5 ft. between side property line and parking
and also, beginning the parking 15 ft. back from the street right-of-way
as required. The parking places are to be 9 X 19 except for the handicap
space which will be 10 X 19 and the manuevering space between parking
spaces will be 24 ft.
MOTION
Waldren moved to table this item until Jones can make a determination
if a building permit (for proposed improvements) can be issued without
any variances being granted. Robertson seconded and the motion to
table passed 5-0-0.
There being no further business, the meeting was adjourned at 4:20
upon a motion, unamimously approved, by Tompkins.
