HomeMy WebLinkAbout1984-02-06 Minutes• • MINUTES OF A BOARD OF ADJUSTMENT MEETING The Fayetteville Board of Adjustment met at 3:45 P.M., Monday, February 6, 1984, in Room 209 of the Continuing Education Center, Center Street And East Avenue, Fayetteville, Arkansas. MEMBERS PRESENT: Chester House, Don Mills, "Butch" Robertson, Robert Waldren, Dr. David Crittenden, Dennis Becker, Larry Tompkins. MEMBERS ABSENT: None. O THERS PRESENT:. Guy Bingham, Carl Austin, Mr. & Mrs. Brooks, Bobbie Jones. Chairman Chester House called the meeting to order. The first item considered was Appeal No. 83-24, Scott Ebbets, 1616 North College Avenue, on an application to vary setbacks. SCOTT EBBETS 1616 North College Ave. APPEAL NO 83-24 This appeal had first been heard on January 16, 1984, with six members of the Board present. At that time the vote on a motion to grant a partial variance failed because of a 3-3 tie vote. The matter was scheduled for the present meeting when all seven members of the Board of Adjustment could be in attendance. G uy Bingham, Construction Manager for MAPCO Petroleum; Carl Austin, District Manager for MAPCO Petroleum; and Mr. and Mrs. Brooks, the property owners were present to represent the appeal. Mr. Bingham passed around some photographs of other canopies in the town. He stated theirs is not an unusual request; they would like to be reasonably as close to the street as they can and would like to furnish shelter for their customers. He said the present main building will not be moved, but will be remodeled into a convenience store. They have two pump islands, one of which is 15 ft. from the street right-of-way. They wish to construct a canopy which will overhang that pump island by 10 ft., thus being only 5 ft. from the right-of-way. The canopy will extend all the way back to the main building. Mr. Bingham said there is about 12 ft. from the street curb to the street right-of-way line, so the canopy would be 17 ft. off the street curb. He said they are in a low place, and would n ot obstruct (vision) up or down (the street). No one else present wished to speak for the request. There was no one present to oppose the request. Board of Adjustment February 6, 1984 - Page 2 Waldren moved that a variance be granted to permit a canopy MOTION t o extend to the outside edge of the outside island (the island nearest the street). This would amount to a 5 ft. variance, or a 15 ft. setback. Crittenden seconded the motion. The motion failed to pass on a 3-4 vote with Waldren, Crittenden and Becker voting "Aye" and Mills, Robertson, House and Tompkins voting "Nay". Tompkins moved that the minutes of the January 16, MINUTES 1984 Board of Adjustment Meeting be approved as submitted. Robertson seconded the motion. The motion passed 6-0-1 with Milts abstaining. At Tompkins' request Bobbie Jones reported on some progress being made by the committee assigned to "update" the General Plan. She advised that the committee is currently trying to formulate some incentives to encourage development of "passed o ver" parcels of property in an effort to fill in the undeveloped areas close in where all the services are available. Members of the Board asked that she also ask the committee to consider something that might make it easier for people to remodel or add to existing structures. Mrs. Mills said that buyers can e xpect around $8-9,000 closing costs on a $35,000 house. Mr. Tompkins related that in St. Louis they had used a tax incentive to encourage development of industrial property --- they would pay no taxes for up to 25 years.
