HomeMy WebLinkAbout1983-01-03 MinutesA meeting of the at 3:45 P.M., in and East Avenue, MEMBERS PRESENT: MEMBERS ABSENT: OTHERS PRESENT: MINUTES OF A BOARD OF ADJUSTMENT MEETING Board of Adjustment was held on Monday, January 3, 1983, Room 209 of the Continuing Education Center, Center Street Fayetteville, arkansas. Chairman Chester House, Larry Tompkins, Don Mills, Robert Waldren, Dennis Becker, Dr. David Crittenden. "Butch" Robertson. Mr. and Mrs. John Stout, Bobbie Jones. Chairman Chester House Called the meeting to order. Dr. Crittenden arrived during the discussion of the first item. Chairman House opened the public hearing on Appeal No. 82-20 for John H. Stout at 102 Nolan Avenue, Zoned R-1, Low Density Residential District, on an application to vary setbacks. APPEAL NO. 82-20 John H. Stout 102 Nolan Avenue Mr. $ Mrs. Stout were present to represent their request. Mr. Stout stated that he would like to construct a bathroom on the East side of his house and flush with the North wall of his house He said the North wall is only 5 ft. from his North property line and the Zoning Ordinance requires 8 ft. from the roof overhang for a side setback. Mr. Stout said he would like to make it "look good" East and North and then go South and put the rest of the rooms on it. In answer to a question from Mr. Waldren, Mr. Stout said this would be an additional bathroom, and that he did not know what the existing overhang on the house is but that he wanted to match it. Mr. Tompkins asked why Mr. Stout was requesting the variance, was there a mechanical reason or was it just aesthetic. Mr. Stout said he was requesting the variance because he did not think it would look good to meet the 8 ft. setback to either him or his neighbor. He said it would just be a place for leaves and things to collect. He stated there was no mechanical reason. Chairman House said that at the time this house and the others around it were built the rule was they could build within 5 ft. of the property line. The property has since been annexed into the City and the structures are now non- conforming. He said it was his thinking that this is not a case of hardship or such, but that by keeping the wall straight they would not have a place for leaves to gather in corners which act like a vacuum. He stated he would be in favor of the variance. Mr. Stout said that he would like to change the roof line from what it is now and make a "T" and also roof over his existing patio to the South of the proposed bathroom. In answer to a question from Mrs. Mills, Mrs. Stout stated that this would be the addition of a bathroom and closet space off an existing bedroom. Mr. Waldren moved to grant the variance as requested; Mr. Becker seconded the motion. The motion was approved 5-1 with House, Mills, Waldren, Becker and Crittenden voting "Aye"; and Tompkins voting "Nay." Upon a motion by Tompkins and a second by Mills, the minutes of December 6 and December 20, 1982 Board of Adjustment Meetings were approved unanimously. Bobbie Jones reported that the Planning Commission update study is still in sub -committee and no recommendations have been proposed.
