HomeMy WebLinkAbout1982-05-17 Minutes• • MINUTES OF A BOARD OF ADJUSTMENT MEETING A meeting of the Board of Adjustment was held at 3:45 P.M., Monday, May 17, 1982 in the City Manager's Office, City Administration Building, Fayetteville, Arkansas. MEMBERS PRESENT: MEMBERS ABSENT: Chairman Chester House, Bob Dr. David Crittenden, Larry Don Mills. Waldren, Dennis Becker, Thompkins, Butch Robertson. OTHERS PRESENT: J. B. Sanders, Bobbie Jones, Cynthia Stewart. Larry Thompkins moved the minutes of the May 3, 1982 meeting of the Board of Adjustment be approved, Butch Robertson seconded. The motion was unanimous. MINUTES The next item of business APPEAL NO. 82-11 was Appeal No. 82-11, J. B. Sanders, J. B. SANDERS 1717 Overcrest Street, application to 1717 OVERCREST STREET vary setbacks. Mr. J. B. Sanders was present to represent. The Chairman opened the public hearing and asked for comments in favor of the requested variance. Mr..Sanders addressed the Board. He stated he moved to Fayetteville from West Fork. There, the setback on the rear line is 5 ft. for outbuildings. He first poured a slab for the building 5 ft. from the property line. He discovered that would place the structure on an easement and moved the structure and poured another slab outside the easement at a cost of about $500.00. The previous slab is still there. He said that moving the structure would be very expensive. The structure is outside the easement, but Mrs. Jones has informed him he must set back 10 ft. from the easement (20 ft. from the rear property line). He requests a variance of 9 ft. 6 inches. Crittenden asked how far from the property line the building sits. Mr. Sanders stated it sits 10 ft. 6 inches from the property line. Bobbie Jones said a setback of 20 ft. is required from the rear yard. Crittenden asked if Mr. Sanders owns both lots. He stated he does. Bobbie Jones said that since there are two platted lots involved, they have to be considered one parcel of property because the storage structure sits on a separate lot from the house, and a principle structure must be placed on a lot prior to the placement of any outbuildings. Waldren asked if this storage structure sits on a concrete slab. Sanders replied it does. Crittenden asked if the neighbors on Lot 17 are aware of the structures existence. Sanders replied they are. Bobbie Jones stated they had been mailed an agenda. 76 • Board of Adjustment Meeting May 17, 1982 Page 2 c pG Chester House stated he lives in the same neighborhood as the Sanders. CD He said they had done much to upgrade the neighborhood. Not only has Mr. Sanders cleaned up trees and the area in general, he has also done some landscaping. House stated he would have to abstain from the voting, but that he felt the Sanders had definitely improved the neighborhood and that he had no objection to the request. LS Bob Waldren stated there was sufficient room for the utility companies c7 to service their lines between the property line and the structure. (Mr. Waldren is in the engineering department at'SWEPCO). Larry Thompkins asked if the variance were granted if it would go with the whole South line of both lots. Bobbie Jones stated something should be stipulated that this will go with this particular structureif the Board C]' wishes to restrict this variance.to this situation. House asked for further comments either in favor of or against the request. There was no further discussion. Bob Waldren moved the variance be granted for this particular structure only. Dennis Becker seconded. The motion passed (3-2-1) with Butch Robertson, Dennis Becker and Bob Waldren voting "Aye", Dr. Crittenden and Larry Thompkins voting "Nay" and Chester House abstaining, his abstention going with the motion. There being no further business, the meeting adjourned at 4:10 P.M. 77
